California: FERC hammered on energy pacts

WASHINGTON -- West Coast senators blasted the Federal Energy Regulatory Commission at a hearing Thursday for its reluctance to order revisions to billions of dollars' worth of long-term electricity contracts because of massive market manipulation by power sellers.

"The issue today is whether FERC is capable of doing its job," charged Sen. Marie Cantwell, D-Wash.

The commission's report, produced after a 13-month investigation into market manipulation during the power crisis, recommended enforcement action against roughly three dozen energy and natural gas companies that could cost them their opportunity to sell at unregulated prices and force return of profits made from the gaming.

Sort of makes it sound that the report primarily blames these companies. It doesn't.

The commission's view is the best kept secret in the media.

Read the report. In fact, just read the first paragraph of the "at a glance" section to see what this secret is that the media won't talk about.

It explains this observation of the author:

But in a public discussion, the commission appeared to be split 2-to-1 against approving requests by California and the Pacific Northwest states to rewrite high-priced electricity contracts negotiated during the height of the crisis.
