South Dakota only passed its amendment by 52% in 2006, one of the lowest margins, especially considering the year. Anyone from there know why it only passed by 2% back then?

When the formula for defining marriage is simply whatever judges, pols, or the voting majority think it is at any one time you are going to get things like this. Pope Leo XIII warned about it 130+ years ago.

In Loving v. Viginia it was state laws being struck down on the grounds that they were a violation of the 14th Amendment. There was no amendment to the Virginia Constitution defining marriage as between people of the same race. In South Dakota there is, and marriage has always been a state matter. I find it very disturbing that state Constitutions can be tossed aside like this where there is no clear violation of the U.S. Constitution.
