The Truth About Brad Carson’s Attack Ads

Brad Carson and the national Democrats are running ads alleging that Dr. Coburn committed Medicaid fraud. These charges are completely false.

Last Friday, Senator Nickles said, "I've never seen such a blatant attempt at character assassination in a campaign." In fact, these attacks expose yet another of Brad Carson’s flip flops and his attempt to hide from his record. Last month Brad said, "I have pledged to run a campaign that our state can be proud of and one that is focused on issues – not one that stoops to the level of assassinating my opponent’s character."

Unfortunately, Brad has now decided to run a campaign relying on attacks rather than issues.

FACT: The allegation of performing a medical procedure without consent was put to rest more than a decade ago when it was thrown out of court.

Last Friday, Walt Haskins, who served as Dr. Coburn’s attorney in that case 12 years ago, stood up at two press conferences to respond to Carson’s attack ads and untrue allegations. Keep in mind that Walt Haskins is a Carson campaign contributor and has donated the maximum to his Senate campaign. But Haskins was so outraged by these false charges, he decided to come forward to address them.

Here is what Haskins said: "The suggestion that Tom Coburn would sterilize a woman against her will, a criminal act, a vicious act, that he would do that is preposterous to anyone who knows this man’s character. At the trial of this case, there was not a single witness who supported this patient’s version of events. Everyone who testified said she asked to have [a tubal ligation] done. And these statements that Brad made, and I know Brad, I like Brad, but those statements about Tom Coburn’s deposition admitting Medicaid fraud are simply false.

Haskins said that he was particularly shocked by Carson’s attack ads because he personally told Carson at a fundraiser in August, "that I had defended Tom in a case in Muskogee County, and that it was a silly case, that the facts simply wouldn’t support it."

FACT: The allegation of Medicaid fraud is a total fabrication first raised by the leftist website, Salon.com.

On Monday, Dr. Michael Ritze, a prominent Tulsa physician, stood up at a press conference with five other doctors in Tulsa and said: "There was no Medicaid fraud in this case. As doctors, we are tired of these attacks on dedicated doctors like Dr. Tom Coburn."

Also on Monday, Mrs. Patty Raines, a CPA and an expert on medical billing, stood up at a press conference in Oklahoma City and said: "Billing only for the procedure to treat an ectopic pregnancy, without mention of an elective sterilization of a minor and receiving payment for said life-threatening condition by the Oklahoma Medicaid System is not fraud."

She cited the following:

Oklahoma Health Care Authority Title 317, Chapter 30, Subchapter 5, subsection 8-i-(3)

“If the multiple surgery on a person under 21 years of age involves tubal ligation; removal of the tubes and ovaries, or other procedures for which specific codes exist, the sterilization procedure is not compensable. No consent form is necessary since sterilization may not be paid for persons under 21 years of age.”

Essentially, if a procedure is “not compensable,” meaning it is not qualified for reimbursement by Medicaid, then you do not file a claim with Medicaid for it. This is exactly what Dr. Coburn did. He filed a claim only for the life-saving procedure treating the ectopic pregnancy, and did not submit a claim for the tubal ligation which he performed at no charge to his patient. It would have been illegal for him to file a claim for a procedure in which he did not charge the patient.

In response to liberal Democrat Attorney General Drew Edmondson’s claim that this was Medicaid fraud, Patty Raines said, "absolutely false.” Again, claim was sent in accordance with the regulations 317-30-5-8-(i)-(3))

On Tuesday, the Oklahoma Congressional delegation held a press conference to express their unanimous outrage at these charges. Here is a sampling of what they said.

Senator Inhofe: “This is the most dishonest, hateful and immoral campaign in the history of Oklahoma.”

Congressman Istook: “Brad Carson's smear campaign is a new low in Oklahoma politics. Oklahomans are getting sick of the nastiness coming from Brad Carson.”

Congressman Lucas: “Dr. Coburn does not deserve the kind of attack and smear he is facing.”

Congressman Sullivan: “Brad Carson, with his training as a trial lawyer, knows he shouldn't spread these lies about a good man. We don't want to elect a liar to the United States Senate. It's deplorable.”

Congressman Cole: “I'll give Brad Carson some free political advice: this is backfiring. The voters will reject the personal attacks made by Brad Carson.”

These are the facts. Regardless of what Brad Carson tries to say, he can’t escape the truth.

Carson has the most despicable ads I have ever seen and that is saying a lot. Carson is a liberal Clintonite who will owe allegiance to Ted Kennedy, Tom Daschle, and Hillary Clinton if he were elected. Oklahomans are working hard to make sure that does not happen!

Can you ping the OK group? These are the facts the next time the doom and gloomers invade one of the threads about this Senate race.

Heard another NRSC ad on the radio this afternoon that went after the Carson liberal voting record. It says he talks one way in Oklahoma and votes another way in Washington.

How may campaigns do you think end with God Bless You?

Am so impressed with the people from the Coburn campaign and Dr. Tom himself -- he is going to make a great Senator in D.C. Time to end all the pork and Dr. Tom is one person who can help! :)

This has become a backbone of Democratic strategy. Throw out any outlandish, unfounded acquastion possible. Then hope there is insufficient time for the Republicans to respond. It would appear that at this one instance, they came out with their lies too early and fortunately gave time for a solid reponse.

They thought they could paint Coburn as a wild eyed crazy lunatic. The problem is this has become standard procedure for Democrats. Before, it used to only be in the final moments of the campaign when they would really swing the hammer. It's just revealing what they really are like.

LOL!!! Our biased Attorney General went in with Gore in the Florida deal after Bush won Oklahoma with over 60% of the vote and he also threw in against the Boy Scouts with CT. The AG is a piece of slime if you ask me and fits in with Carson!

Thanks for this post! I'm emailing it to my relatives who are vacationing in another state--should be back before the election though.

One question--someone on another thread somewhere mentioned that the so-called headlines they show in that awful commercial are actually from letters to the editor, not the editorial staff? Do you know if that is true? If so, I want to pass that on, too.

Gads, we're recording as much as we can, so we can zap through those commercials. The 'rats must have deep pockets for this one!

Oklahoma Attorney General Drew Edmondson is the son of former US Representative and two-time Senatorial candidate Ed Edmondson, and the nephew of former Governor and US Senator J. Howard Edmondson. His father's races against Dewey Bartlett in 1972 and Henry Bellmon in 1974 were (as I remember) both full of mudslinging on Edmondson's part. J. Howard was in his last weeks as Governor when US Senator Robert S. Kerr died in January of 1963. His political career was essentially ruined when he resigned as Governor and his successor, George Nigh, appointed him to the US Senate position. He was defeated in the democrat primary in 1964.

Another Edmondson family member, I believe it is Drew's niece but it could be his cousin, was involved with a robbery and murder in Louisiana within the past ten or fifteen years. I can't remember all of the details but it would be a good time to post them if someone can find them.

There is a column in this morning's paper from a Lionel Van Deerlin which attempts to present Brad carson as a conservative. Talking about how he represented "little Dixie" and all that nonsense.

My question for Mr. Van Deerlin is what the hades is conservative about an endorsement from Moveon.org and several left wing special interest groups.

Carson's values are more like Massachusetts than Oklahoma and anybody that says otherwise is a blad faced pathological liar. Mr. van Deerlin, you sir are a bald faced pathological liar!!!!!!!

Folks, don't let these idiots fool you into thinking Carson is conservative. Carson is nothing but a pablum-puking leftist who will seel this Senate seat to these leftist groups and leave us Oklahomans out in the cold. That's the last thing we need right now with our nation at war.

Let's support Dr. Tom. The real Oklahoman and help him win this seat.

It is the liberal Oklahoma Attorney General -- wish we did have someone like Ashcroft that was honorable. Don't think Edmonson has an ounce of honorable blood in his whole body.
