One month ago Trump certain Rubio eligible, today not so much
Legal Insurrection ^ | February 21, 2016 | Professor William A. Jacobson

I called it - as soon as Rubio rose to second place, Trump would cast doubt

(VIDEO-AT-LINK)

About a month ago, when Donald Trump was claiming that Ted Cruz probably was not eligible to be president, Trump was questioned by Jake Tapper about whether Marco Rubio was eligible.

Trump exhibited some legal understanding of the issue, citing an op-ed written by Harvard Professor Laurence Tribe. Trump's conclusion was that he had no doubts Rubio was eligible:

"It's a different [than Ted Cruz], very different thing because he was born here. He was born on the land."

(VIDEO-AT-LINK)

As the attacks on Cruz's eligibility rose in intensity and Trump threatened suit, I predicted that Trump would have a hard time holding that line if Rubio rose in the polls and became Trump's main challenger:

Will The Donald also sue to keep Marco Rubio off the ballot if Marco gains momentum again and runs attack ads? After all, many of the people who claim Cruz is ineligible also claim Rubio is ineligible because his parents were not citizens at the time of his birth in the United States. (Yes, I address that claim also in my prior post.)

I think Trump should sue. I'm not just saying that. I don't know that Trump has standing, but he's probably closer to it than most people out there. So go ahead, Donald, file the lawsuit, don't just threaten it. And do it against Rubio too. I'm sick of hearing the threat. Just do it.

After the South Carolina primary, Rubio arguably is Trump's main challenger.

And as I predicted, Trump didn't hold the line on Rubio being eligible.

Today Trump was interviewed by George Stephanopoulous. When asked the same question Jake Tapper had asked a month ago, but now said he was not not familiar with Rubio's situation, and had never looked at it. Despite having told Tapper he looked at it. And unlike his lack of prior concern, now he was not certain:

"I'm not sure, let people make their own determination ... I don't know. I've never looked at it, George, honestly, I've never looked at it. Somebody said he's not and I retweeted it."

(VIDEO-AT-LINK)

Nothing has changed in the Constitution. Only in the political landscape.

For my August 2013 analysis of why both Cruz and Rubio are eligible, regardless of where they stand in the polls, see natural born Citizens: Marco Rubio, Bobby Jindal, Ted Cruz

I’m sorry it hurts so many feelings that natural born citizen is an exclusionary term meaning one can only be a US citizen and nothing else, born here of citizen parents.
Naturally a US citizen because there is no other possibility.

Barry Soetoro/Barack Hussein Obama should be proof enough of the wisdom of the founders when they tried to prevent him from being President by requiring someone who could only be a US citizen and nothing else.
Born here of citizen parents.
Naturally a US citizen because there is no other possibility.
One cannot be anything else and also be a natural born citizen.

Obama told us he was born a British Subject.

Who believes Washington, Jefferson, Adams, Jay, Monroe, Madison, etc. would have found him to be a natural born citizen?

Rubio and Cruz think they should get away with it because Barry Soetoro/Barack Hussein Obama got away with it.

Usurpation Day, January 20, 2009, happened with the complete cooperation of both parties.
They want the Constitution changed without the hassle of amending the Constitution.

The bench was the reason the GOP went along with the fig leaf resolution for McCain as cover for Obama.
Jindal, Rubio, Haley and Cruz were all up and comers and the future of the party and ineligible.

Hmmm...sound exactly what he said about Cruz, and then turned around on it.

I distinctly remember his saying in the 1st or 2nd debate that he, Trump, had had his lawyers look at Cruz and that he was fine.

Then when Cruz rose in the polls he turned around on that.

Now Rubio is rising in the polls...expect the same.

But primary politics is a hard, rough and tumble thing. These guys all have to weather these types of storms...it will make them stronger.

Rubio was born in the US of two Cubans (non-US citizens).

He’s not NBC.

If the US had annexed Cuba back in the 1850s, when the Democrats were trying to find more land that could become slave states, neither Cruz nor Rubio would have a problem.

If Kasich were to rise in the polls, Trump would go after him too. Kasich's ancestors weren't US citizens at the time of the ratification of the US constitution, so how can he be a "natural born citizen"?

Trump’s view about who is eligible is irrelevant. Neither Cruz or Rubio is eligible. Trump’s kids have a foreign mom and aren’t natural born citizens either.

With the refusal to raise the issue of NBC with Obama, that clause is dead, along with the rest of the Constitution. We need a Conservative to try to build a Constitutional Republic again. Until that happens, one can't say that those who call those who point out that Obama is not a NBC cranks and loonies and then switch around and claim that the natural born citizenship clause is applicable only to Conservative Republicans. We should not take this garbage anymore from the lib/commies or Ann Coulter, who attacked the so-called birthers against Obama as cranks

Trump’s wife was a legal United States citizen when the kids she had with him were born... were they not?

They were born in the USA to a US citizen Father. And, a LPR mother.

Melania Trump became a naturalized US citizen before Barron William Trump, the youngest child, was born, however, prior to Congress changing the law, from 1790 to 1950, wives and children automatically became citizens of the country of the husband/father respectively. This fact is easily available at the Library of Congress, history of immigration and naturalization, therefore, according tot he US Constitution and the laws in place at that time, ALL of Trumps children would have been considered ‘natural born’ citizens at birth.

Tribe is the professor who taught both Obama and Cruz constitutional law. He’s recently said that the NBC question is not ‘settled law’ and Cruz should know that.
