Rush's Attorney Roy Black on Scarborough Country

If you missed the interview last night with Roy Black, attorney for Rush Limbaugh, go to Rush's website and listen.

Mr.Black mentions that the State Attorney has continued to harass Rush due to volumns of email and letters they have received from "concerned" citizens who want something done about Rush!

There is no there there. They are being urged to continue to try and find something to pin on Rush through the urging of the DNC!

If you are so inclined, call, write, fax or email the office and let them know how you feel about the railroad job of Rush.

Anybody who can't figure this out is terribly stupid. Hillary has to take Rush out or she will have a terrible time running in 2008. She cannot afford for Rush to be there to constantly remind people of her failures .. as well as the failures of her husband. I mean .. she will not want the story of the pardons .. or taking the White House property .. or thousands of staffers who made the White House kitchen a fast food restaurant .. or the military people who were not allowed to wear their uniforms within the White House.

Hillary is out to get Rush off the air. However .. she is not good at strategy and therefore did not think out this plan .. so it will fail. And .. the democrat loss in 2004 may be sooooooo devastating that she will not have enough support to mount a campaign in 2008. Now .. wouldn't that be a shame ..??

Dear Mr. Krisher:

Pursuant to Florida's Government in the Sunshine Law, this is a public records request regarding the Rush Limbaugh Investigation.

This request is specifically not for material being used in the ongoing investigation. This is a request for the unsolicited letters and records of phone calls from those unrelated to your investigation. As this are only letters urging you to pursue Mr. Limbaugh, rather than providing evidentiary leads, providing these letters would in no way hinder your investigation.

We desire copies of all such unsolicited urgings whether in support or opposition to Mr. Limbaugh. This includes but in not limited to, body of letters, dates of letters, names, and return addresses whether physical or electronic. This also includes all communications between your office and and any political party official as it relates to Limbaugh investigation.

This is for all those comments which are directly related to cultivating evidentiary material for the Limbaugh case.

Please respond within 7 days of receipt of this letter.

Landmark Legal Foundation Seeks Documents from Palm Beach Prosecutor

HERNDON, Va., Jan. 15 /PRNewswire/ -- Landmark Legal Foundation today filed a freedom of information request with the Palm Beach County State Attorney's Office (SAO) seeking any and all information of communications to or from the SAO or any of its employees and outside individuals or groups relating to Rush Limbaugh. Mark R. Levin, President of Landmark, stated: "We want to know why Palm Beach County State Attorney Barry Krischer waited 10-months before investigating allegations against Rush Limbaugh -- only after stories appeared in the National Enquirer. We're concerned that once the story became public, Mr. Krischer, an elected prosecutor, may have been pressured to use extraordinary tactics and resources to punish Rush for his viewpoints." Levin added: "As the details of this investigation have appeared in the media, they've become increasingly troubling. False news stories claimed Rush was being investigated for money laundering and for a role in a drug ring, among other things. And now, Mr. Krischer is pursuing Rush on a 'doctor shopping' theory, for which he has no evidence, which is why he seeks access to Rush's confidential medical records. 'Doctor shopping' was not a priority of Mr. Kirscher's office prior to now. His office only brought such charges in one previous case, which was eventually dropped after the subject of the investigation died. Even elected prosecutors must, at all times, be above political influence. Mr. Kirscher's judgment raises serious questions about the impartiality of his investigation." Levin said further: "There also are numerous leaks coming from 'sources close to the probe' which are obviously intended to smear Rush. It is a felony in Florida to leak investigative information. Michael Edmondson, Mr. Krischer's spokesman, has been accused in open court and on television of being the source of some of these stories. Despite this 'journalist shopping,' Mr. Krischer has taken no steps to investigate and prevent these leaks. And Mr. Edmondson remains his trusted spokesman. Landmark will file suit against the SAO if it fails to produce the requested information." I suspect we have a troll here. First, I could swear that seven drug overdose deaths a day in one state would cause more than ordinary alarm. Most addicts don't die of overdose, althoug many die young.

And as you have pointed out, Rush hasn't been charged with anything, and I doubt if he will be. First, we would have heard if he had been caught with excessive pills. Second, the evidence of doctor-swapping is likely to be thrown out on technical grounds. That pretty much leaves his confession of being an addict, which will go nowhere in court.

I composed it. It is intended to be legally sufficient for a Ch 119 request. No I did not send it. Some may find it useful it they wish to make such a request.

It has to be obtained pills by fraud. He had to lie to have those pills.

THEN if he had pills illegally, did he have enough to be declared a dealer.

The more I see in this matter the weaker their case becomes even if they do charge him for political gain.

What pills? Admitting you are an addict does not provide the state with any usable evidence. We are talking about a vice her, a victimless crime if it is a crime. Do you expect Rush to provide the prosecutor with evidence?

I am amused by folks who think that because Rush has apparently broken some laws that he ought to turn himself in. I suspect the majority of FReepers have engaged in bedroom acts that are technically felonies in most states. Have you turned yourself in?

whooooo, I am in Rush's corner.

Being an adict is in no way a crime.

I was just pointing out the legal uphill battle the SA is fighting. They have to leap a significant number of hurdles to make this case happen. They also have the added goal of trying to avoid the drug court intervention program. (something they can't control if Rush qualifies based on the charges.)

I don't see how they can bring criminal charges against someone against whom they have no substantial evidence and who has already been self-admitted for treatment.

All they will get out of this is ammunition to embarrass Rush, and that opportunity has come and gone.

Not at all...Rush has not been charged with any crime as yet. But I dont adhere to the notion that Rushes ideological reference has any bearing on his guilt or innocence.

Now, what we do know is Rush has admitted to taking large amounts of opiates in quantities inconsistent with known medical practices. Now...that leads us to the fundamental question, By what method did Rush procure those opiates and was that method legal?..if the answer is yes then Rush has not committed a crime..if the answer is no the Rush has committed a crime. Quite simple. If their is sufficient evidence to charge Rush on one or more of the counts indicated then it shall be a juries job to decide barring Rushes plea agreement to one or more of the charges.

I think the SA has painted himself into a corner. The DNC used him to try and embarras Rush. (how did the DNC get wind of this?) Or the SA just wanted to make his own political capital and was just too clever for his own good.

They are now stuck. If they don't charge they are weak. If they do charge they are screwed.

If the public emails and letters turn out to be a sham, their only salvation is to drop everything and say they were fooled.

Apparently there has been an extensive and organized attempt to influence the PB State Attorney into going after Rush. Below is an example of the kind of thing they have been doing. This is from a post from a liberal website.

This is an incredible story. It is now obvious that all one has to do to legally go after a citizen is send the State Attorney a bunch of nasty emails. So much for Justice is Blind. Well, at least in Palm Beach, FL!

What should be of political concern to us regarding Rush's situation is that even a man of his standards can be driven to doctor shopping and addiction because of the failure of the medical system to properly treat pain. This failure is a direct result of the policy of the DEA to attempt to bust any doctor that prescribes more pain relievers than are prescribed on average by his peers. Doctors are afraid of being disciplined or arrested so they refuse to properly treat pain, resulting in the patient going to more than one doctor in search of relief.

What most people do not know is that pain patients can be safely medicated with heavy doses of opiates these days and then weaned off of the opiates. If the patient cannot be weaned off, there is a new drug on the market, which the FDA refuses to allow doctors to use for the purpose of treating addiction, that completely weans the patient with virtually no side affects within about one week. It is called ibuprenorphine. Currently, it is only legal to use on chronic pain patients. But it is non-abusable, as powerful as morphine, and easily weaned from. Meanwhile, it completely blocks the effects of any opiates the patient may attempt to take.

We need the federal and state governments out of medicine and that is what Rush's problem demonstrates.

A few years ago, my son had a kidney stone, which was difficult to see on those X-rays, or whatever they use to detect kidney stones. He was in his late twenties, and when his doctors couldn't find any reason for his pain, they gave him stronger and stronger pain killers, finally oxycotin. He became addicted, of course, and begged them not to prescribe more pain killers, but just to find the stone and take it out. Since he was young, and they didn't see a stone, they thought he was just looking for drugs! A year later, he'd lost his job because he'd been in such pain and couldn't drive, what with the pain killers...and they finally sent him to Boston and a specialist, who found the stone. That doctor said it was rare, hard to detect, but they see cases like his maybe once every three or four years. They had to remove half his kidney, and he had to kick the drugs, too. He's fine now, but I have sympathy for people enduring pain who end up hooked. Too many doctors write prescriptions instead of getting to the bottom of your pain problem. It's a vicious circle.

The irony is Rush was a very strong advocate of strict drug laws.

He rarely talked about it, and his most quoted comment about it from some years ago had to do with the illogic of lowering certain penalties based on race.
