Terri's husband isn't the enemy, guardian says

Wolfson's report is based on court files, depositions, medical records and interviews with everyone involved.

That said, I begin with the most explosive allegation:

Did Michael try to kill Terri?

Wolfson laughs. "No!"

Wolfson's report states that in the four years after her collapse, Michael "had insistently held to the premise that Theresa could recover and the evidence is incontrovertible that he gave his heart and soul to her treatment and care . . . In late autumn of 1990, following months of therapy and testing and formal diagnoses of persistent vegetative state with no evidence of improvement, Michael took Theresa to California, where she received an experimental thalamic stimulator implant in her brain. Michael remained in California caring for Theresa during a period of several months."

Says Wolfson now: "Michael was adoring of her. One nursing home complained he was hostile and abusive of the staff in championing her care. She was immaculately kept. In 13 years, she never had one bedsore."

There are a LOT of people who are open to lawsuits by Mike Schiavo when this is all over.

As for DeLay and to a lesser extent Frist, they will soon regret parroting the Schindlers' propaganda in such a way, methinks.

Hell, even if Mike Schiavo were now somehow to be charged with some sort of crime, the jury pool is now poisoned. So much for those who still hold out THAT hope.

IMO, the republicans are doing the right thing for all the wrong reasons.....but it's the right thing to do.

How do you sentence to death a living innocent person.

Think about it...the GOP has just told the American people that all they would have had to do all these years on issues like

Social Security
Tax Reform
Tort Reform
Energy Reform
Downsizing Government
Improving Defense
Winning the Terror War
And a host of other issues was to show a video of a PVS woman and to repeat a slew of wild propaganda. To use crazed emotion and hyperbole instead of facts and reason.

We've long prided ourselves on, and even boasted about, being the party of Reason and facts and logic. We no longer have that ability.

If your refering to the removal of the feeding tube, the issue first came up in 1998 and went into all kinds of litigation and two years later Greer ok'ed the removal. They stood by and didn't do diddly squat.

In late 1991, 1½ years after Terri’s collapse, Michael Schiavo became involved in an intimate relationship with Cindy Shook. The romance continued for approximately one year. It can be documented that the two spent a weekend at the Don Caesar hotel in St. Petersburg Beach and they also contacted a Century 21 Realtor on the premise of purchasing a home.

In May of 1992, at the apex of the romance, Schiavo had Terri’s 2 pet cats euthanized to clear the way for his moving in with Cindy and her pet dog.

In the summer of 1992, Schiavo moved into his parent’s home. We can speculate with reasonable accuracy, it was at the instructions of his attorney, since the living arrangement would be contrary to Schiavo’s "loving husband" image they were projecting for the upcoming November 1992 malpractice trial.

In April 2001, Cindy Shook (married name Brasher) was interviewed by an investigator working in Terri’s behalf. Unwilling to come forward because of her immense fear of Schiavo, Cindy had to be subpoenaed and was then subsequently deposed on May 8, 2001 to try and learn more regarding her intimate knowledge of Michael Schiavo’s character traits.

Excerpts; May 8, 2001 Deposition:

Cindy Shook describing Schiavo’s possessiveness.

"he’s very jealous. He stalked me at my…at where I worked after I stopped dating…when he would get mad at me he would tell me, I would rather be laying in bed in the nursing home with her than with you. I mean he can be the most incredibly mean person"

When asked if she were afraid that Michael would physically harm her or if he would harm children.

"I am concerned about retaliation because I have a child -I have children and a husband. I know him, I know what he told me I said he could be a very mean person."

She spoke of how Schiavo stalked her for close to a year after the breakup and that she received repeated phone calls.

"He came on the floor looking for me several times. I felt it was out of character for him to get a job as an orderly at the hospital That was concerning to me. When he would come up to the floor looking for her she was not scared the first time but later was scared.

In town I would look up when I was driving…not at my work- she would look up in the rear view mirror and there would be Michael Schiavo. I would look up and he would be behind me in traffic. It continued for several months after he didn’t work at the hospital. She would change lanes, try to make a turn and he would do the same. He did this about ten times.

One time he was behind me in traffic he got next to me in a two-lane going the same way, and he changed lanes basically right on top of where I was at, and I had to swerve not to be hit. I had to swerve off the road. Michael ran me off the road. I considered it as stalking, dangerous and guessed potentially life threatening."

Cindy thought about getting a restraining order. She talked to an off duty police officer in her building

They discussed marriage. She said Schiavo asked what would you do if I asked you to marry me. He never discussed getting a divorce.

Cindy said Schiavo got angry when asked questions about Terri saying:

"this had destroyed his life and he was being robed of a normal life."

Regarding Terri’s care, according to Cindy Shook, Michael Schiavo said,

"How the hell should I know we never spoke about this, my God I was only 25 years old. How the hell should I know? We were young. We never spoke of this."

Michael Schiavo resides and owns real estate with another woman, Jodi Centonze, whom he has called his fiancée (a person whom he has been found, through private investigation, to have known from his hometown in Pennsylvania around the time of his marriage to Theresa in 1986 and with whom he has had at least 2 known and admitted to children in the last 18 years). As regards to guardianship, in later court testimony (deposition of September 27, 1999), Michael Schiavo when asked if he would relinquish guardianship to Terri’s parents said: Basically I don’t want to do it. In answer as to why he didn’t want to do it he added: Because they put me through pretty much hell the last few years in the litigations to save their daughter from being subjected to an untimely, unjustified death, and that was the only reason. He then states: I am Terri’s husband and I will remain her guardian. Shortly thereafter Felos asks for a minute with his client. He takes Michael aside and when they come back Michael in answer to a question from Felos in regards to if there was any other reason why he refused to give up the guardianship adds: because Terri’s parents wouldn’t honor her wishes.

So if Michael was a "nice guy", you'd have no problem with him carrying out his wife's wishes?

Is that what this is about? That he's not a "nice guy"? I was unaware that that negated his rights.

they fall directly along the line between "Fiscal/National Security Conservative" and "Religio-Social Conservative". Those in group #2 have now demonstrated that things such as State's Rights, rule of law, and reason instead of emotionalism matter not a whit when they WWAAAAANNNTTTTT something.

...think more carefully about signing Living Wills and making their intentions clear.

This is truly the only good that may come from this awful nightmare.

MY Durable Power of Attorney is 15 years old, and am going to update it this week so that no one, no one at all, can come between my wishes and my son's promise to carry it out.
May anyone attempting to keep me trapped in a non-funtioning brain and body, roast in you know where.
I'm sorry for those of you who truly believe you are doing right by prolonging this poor woman's ordeal, and that includes her poor parents.

May God forgive us all.

Precisely.

We have Living Wills and have an appointment in April to make sure everything we want in there, is in there.

And I told my parents last night in no uncertain terms, they are NEVER to keep me alive or fight my husband or sisters on this, if it's all within the scope of my Living Will.

And, btw, THIS is when Michael finally put his foot down. This is court testimony:

Court testimony provided by members of the Schindler family included very personal statements about their desire and intention to ensure that Theresa remain alive . . . at any and all costs. Nearly gruesome examples were given, eliciting agreement by family members that in the event Theresa should contract diabetes and subsequent gangrene in each of her limbs, they would agree to amputate each limb and would then, were she to be diagnosed with heart disease, perform open-heart surgery. Within the testimony, as part of the hypothetical presented, Schindler family members stated that even if Theresa had told them of her intention to have artificial nutrition withdrawn, they would not do it.
