When DEMS want to "work something out" that means they are losing the fight. Otherwise, they would be *itching their brains out in front of the nearest camera about "right wing radicals".

Prior to the Dems filibuster on 10 of Bush's judicial nominees there was exactly ONE, count 'em, ONE filibuster of a judicial nominee... and the circumstances were completely different.

LBJ nominated his close friend Abe Fortas as Chief Justice just a few months before he was to leave the White House in 1968 (i.e., LBJ was a lame duck). At the time there were a scandal associated with Fortas, who was already sitting on the Supreme Court. BOTH Republicans AND Democrats entered into a filibuster to avoid a vote on Fortas, so he would not face the indignity of a sitting Supreme Court Justice BEING VOTED DOWN on the floor of the Senate. Fortas did not have sufficient support on the floor of the Senate to get confirmed. Fortas subseqently resigned from the SCOTUS some time later.
