This is a follow-up to a story posted last week, when the woman was first charged.

You know, I rather like this idea--it appears to happen only in Norway, though--of having the guilty party not only pay a civil penalty (imprisonment), but also reimbursing the victim in some way; from all the "crime news" I've read from Norway, it seems to be the practice.

Ping for the Norway ping list.

There must not be much happening in Norway today; that is, unless some of the real news from Norway is not translated into English.

I understand the point, but this case seems to land on the loophole in your theory -- and that is, that a man can "perform" when he's asleep, and thus at a time where he hasn't consented and may even (although I have trouble with this point) object!!

Oh, yeah? What about my pal in high school and the female shot-putter? She plied him with Jack Daniels and then held him down and spanked his monkey....

The man was reported to have said when he woke up,

"If you don't stop that in 5 to 10 minutes, I'm calling the cops."

You can't rape a man.

Five big, ugly lesbians with a broom handle could probably do a very effective job of raping a man.

The question really is: What is the definition of "rape" as opposed to "sexual assault"?

Well, it sort of boggles the mind, but I think "sexual assault" would probably be a better term, than "rape."

However, given "gender equity," one is not surprised.....

"You can't rape a man."

I didn't think so either, but what would you call this? What if the sexes were swapped and the woman had woken to find the man performing oral sex on her? Would that also not be rape? At the vary least, she molested him.

Yes, but that's a different kind of rape, not on point here.

Lauralee's point is that for the type of 'rape' at issue here, a man's performance is coextensive with his willingness, so to speak -- therefore if he engages, he was willing.

And there is some good logic there, but the case at issue hits an exception to the logic -- the "sleeping" exception.

I disagree. A mans body responding to stimulation doesn't equal consent.
