Mr. CORNYN. I ask unanimous consent that when the Senate completes its business today, it stand in adjournment until 11:30 a.m. on Monday, May 23. I further ask that following the prayer and pledge, the morning hour be deemed expired, the Journal of proceedings be approved to date, the time for the two leaders be reserved, and that the Senate then return to executive session and resume consideration of the nomination of Priscilla Owen to the Fifth Circuit Court of Appeals, provided that the time from 12 noon until 1 p.m. be under the control of the majority leader or his designee and, at 1 p.m., the Democratic leader or his designee be recognized; provided that floor time then rotate between the two leaders or their designees every 60 minutes until 4 p.m., at which time the majority leader or his designee be recognized until 4:45 p.m., to be followed by the Democrat leader or his designee from 4:45 p.m. until 5:30 p.m.

Mr. CORNYN. Mr. President, on Monday, the Senate will resume consideration of the nomination of Priscilla Owen to serve as a circuit judge on the Fifth Circuit Court of Appeals. Monday will be the fourth consecutive day the Senate considers the Owen nomination.

Over the past 3 days, a number of Members, on both sides of the aisle, have come to the floor to speak on the nomination. We have conducted over 25 hours of debate, and we will continue on Monday. Moments ago, we filed a cloture motion on the nomination, and that will ripen on Tuesday of next week.

On behalf of the majority leader, I remind my colleagues the leader has announced our next rollcall vote will occur Monday afternoon at 5:30. That vote will be on a motion to instruct the Sergeant at Arms to request Senators' attendance. Senator Frist will have more to say about next week's session on Monday.

LBJ in 1965-67 had a 67-33 Senate majority. From 1967-69, it was 64-36. PLUS, he could make any United States Senator sit up and bark like a dog.

Easy to do with those majorities; not so easy at 55-44-1 when six or seven of the 55 are wobbly.

Anybody have a summary of the "Byrd Option" examples that Hatch cited? My first impression is that they are "weak" in that they represent lesser changes to procedural/praliamentary hurdles than changing the cloture hurdle represents.

One example was the "bundling" of a motion to enter executive session (which is not debatable) with a motion to proceed to a certain nominee (which could, before, be opposed by an objection). By bundling the move to executive session and the choice of nominee, Byrd avoided the stalling tactic of objecting to proceed on the nominee (an "all or nothing" objection, or at least one as to timing of taking up the nominee).

Are these examples all cited in the Gupta and Gold article?

The Senate debated the nomination of appeals court hopeful Priscilla Owen for four days last week and is set to vote on a motion to end the Owen debate on Tuesday.

The vote has larger implications than the fate of one nominee — it will likely determine what could be the most consequential battle of Bush's presidency. At stake: Bush's ability to steer the courts in a more conservative direction.

Bush demands ‘up-or-down vote’
The president on Monday insisted anew that all of his judicial nominees receive a vote by the full Senate as a dozen lawmakers raced to avert a showdown that threatens to paralyze the chamber and Bush’s agenda.

“My job is to pick people who will interpret the Constitution, not use the bench from which to write laws,” Bush said from the White House. “And I expect them to get an up-or-down vote, that’s what I expect. And I think the American people expect that as well — people ought to have a fair hearing and they ought to get an up-or-down vote on the floor.”
