Best wishes and prayers to your family. Hopefully, he is well represented.....here is a HUGE recommendation, especially if he is not successful in today's attempt. If this has not already been done tell your brother to work towards a COURT ORDERED psychological evaluation of the mother.

Praying for your brother and the kids. I know what he is feeling, This happened to me 4 years ago with my ex husband. I am so sorry your brother is going through this!

I came here and asked for prayers when I filed for sole custody of my daughter, and asked for prayers again when I went to court - I feel that the prayers that the Freepers offered up were of genuine help in those times of need - I now have sole custody of my 12 year old daughter, with supervised visitation for her mother.
My prayers go up for your brother Eric, and for his children, and for you as well. More and more, the courts are beginning to see that mom is not always the best choice, and I pray that this is the case as well in this situation.

My brother seems to have a good attorney (she's Christian as well), but the problem will be getting the court to recognize and admit the evidence my brother has discovered, because my sister-in-law will probably fight having a psych eval.
