Bill Kristol Rips Miers Nomination: W "Flinched"

In a just-completed interview on Fox News, Weekly Standard editor Bill Kristol made no effort to sugar coat his criticism of President Bush's selection of Harriet Miers as his Supreme Court nominee.

Among Kristol's comments:

There is no way to say she is the best-qualified.

It really looks like W, faced with pressure and criticism, "flinched."

This is an insult to the well-qualified conserative women W has appointed to the federal bench.

W could have appointed Miers to a federal judgeship before but didn't do so. Could reflect his views on her qualifications up till now.

He's spoken with a number of leading conservatives already this morning and they are disappointed.

Kristol stated more than once that he was surprised by the pick and was obviously disappointed, to the point of seeming almost angry.

If Kristol doesn't like her, she must be ok. He is still smarting from the McCain loss.

Bush supporters should have a template by now explaining how us pikers don't understand the genius behind various Bush moves which are obviously wrong headed on their face.

Because of decades of judicial activism, the Supreme Court is now a political body as much as a legal one. Every supreme court appointment now has important political outcomes. It shouldn't but it does, the result of judicial activism by the court.

Accordingly, Bush can only pick nominees who have a thin file or no file. Any nominee who has a long history on the bench (a big file of whatever political leaning) is subject to violent opposition, no matter what positions have been taken in the past. Judicial activism has created a Frankenstein monster.

Mier has no judicial file. That is why Bush picked her.

How can ANYONE know how she or anyone else "new" will decide cases?? Sheesh, We've made lots of mistakes in the past ( the GOP nominees) so perhaps it's best to nominate a qualified person that Bush knows her heart.

The truth is, no one will know how either Roberts or Meiers will vote on a given issue until the vote takes place. I will reserve my judgement until that time.

But I will say this: If we've been "Souterized" again, I will consider the Republican Party a "non-choice."

I suspect she's a sacrificial candidate and she knows it. She's agreed to be beated to death in Senate hearings, after which Dems will proclaim victory. Bush then nominates a true constitutionalist, and an exhausted Senate Dem club doesn't have the energy or will to oppose him/her.

Geraldine Ferraro now on Fox saying fairly nice things about Miers.

Meanwhile, Linda Chavez is saying her phone ringing off hook with calls from unhappy conservatives.

My $.02: Judiciary committee will, at best, approve her 9-8 (Specter votes, Not Present). All depends on Specter; not out of the question that he would reject. Then vote would be 9-9. Then in full SEnate, best she would do is 52-48.

She is going to pass 90-10. This is the best candidate the Democrats could have hoped for.

Bill Kristol isn't exactly a stand-up guy for the President or for Rummy. And I could care less what he says.

Whatever people think of Kristol, I have the sense he is speaking with some authority for the inside-the-beltway conservative establishment.

You've got to be kidding! She will be easily confirmed. The Demos will go along with this. Bush is a politician and knows what he is doing (though it has nothing to do with what you and I want).

The speculation is that she is not a true-blue conservative. Why would Specter not vote for her if he voted for Roberts? And the Dems probably realize she's the best they could hope for.
