During the 11:00 p.m. (CST) newsbreak, Donna Fuducia reported that Karl Rove told James Dobson that 80% of the potential SCOTUS nominees on the President's list declined his offer because of they didn't want to undergo the grueling confirmation process. Perhaps this sheds new light on the reason why W chose Miers.

Completely believable. Everyone remembers the Clarence Thomas nomination. For tens of millions of Americans who do not follow supreme court rulings, the one thing they most associate with his name now and for the rest of his life is the alleged harassment of Anita Hill, the pubic hair on a coke, porn videos, etc.

District and Appeals court nominations are one thing, but, as is now being demonstrated (and will continue to get worse) with Ms. Miers, the Supreme Court is completely different.

Do you think people have forgotten the attempt by the NYT to get behind the sealed adoption records of Justice Roberts' children to dig up dirt on him?

Of course. Absolutely. Without a doubt.

How anyone could refuse such a call to duty simply boggles my mind. There is no way that I could refuse this call and keep faith with those in my family who have died in the service of our country.

What a nominee has to endure in the present day is most regrettable. But many 18 year old boys have been called out to defned that Constitution on the field of battle and have been died or maimed in service to our country.

Service on the Supreme Court defending our Constitution is every bit as important as those who fight and die on the battlefield. And a lot less lethal. I have contempt for anyone who gets the call to defend our Constitution and declines "for personal reasons."

Connie Callahan? I don't know anything about her, but her name was mentioned and all the conservative lawyer types said she was a known moderate. I believe she would be GWB next choice if H. Miers goes down.

The question we need to ask is WHY? And then we need to find out who has allowed this situation [cough...ahem...McCain...cough...Specter] and then we need to make them pay. We need to hurt them so bad that anyone who tries to pull this crap in the future would be so scared of the consequences to even think of it.

This is a disgrace. The SCOTUS confirmation process has really hurt good people like Clarence Thomas and now it has prevented people from publishing if they want to be confirmed. And all because the Left is determined to use any means whatsoever, including personal smearing, to defend a horrible decision in 1973.

Now we see that potential nominees want out because of the lynching. Sad. This is NOT what was intended with the confirmation process.

But people on the Left and Right agree -- IT'S ALL BUSH'S FAULT!! We don't even know what his options were, but so many here have viciously attacked him. That's OK; he still has loyal supporters. He's fought for good judges so far and he hasn't stopped now.

BUT, I did hear this today....that Miers was NOT a part of the choosing of other judicial candidates because she's only been the Gen'l Counsel to the Pres since February....anyone else hear this?

Damn the RINOs is right. If Bush was the leader we should have, he would have come right out and explained the situation, named the offending Senators, and then declared total war against them. Instead of most of the conservative movement in the nation turning against Bush, he would have had them as footsoldiers in his war against the RINOs and the evil Dems who are destroying our nation.

I think GWB didn't want to let it out, but all the critical conservatives intimating that all their favorite candidates would leap at the chance didn't give him much choice. I think it shows H. Miers has guts aka my tagline.

Oh for God's sake! It's a judicial position, and all these people already have judicial positions. They just don't want to put themselves or their families through the media exercise of digging through their garbage.

Nobody's being elected Pope here. And, in the last conclave, even cardinals took their names out of consideration.

I would not want my kids to hear all of the contrived sh*t they would dredge up. Nor any of the real sh*t they would put on international airwaves. I think it is believable. Once Meirs is confirmed, this debate needs to take on a life of its own. In fact, President Bush should come out and tell this without naming names who refused . It would expose the vileness of the left and reamalgamate the base. He absolutely should do it.

I doubt it's true, but even assuming it is, it makes Miers more courageous than 80% of the potential nominees.

All those principled conservatives would run away like scared chickens from a nomination to the Supreme Court, is that what we're being asked to believe? It's BS.

So, you think Bush would appoint another "moderate" if Miers fails? Sometimes, "moderate" seems to be little more than a code word for "person who supports the murder of babies". Seriously - I don't care if he puts someone on the court who thinks that businesses are the source of all the world's evil and global warming is a proven fact - I just can't stand to think that our president would put someone like that on the court.

No, wrong. Why should these people suffer for deciding in favor of their families. The fact is, it is none of our business. These people have the right to make these decisions without our scorn or anger.

The fact that Miers IS the remaining 20% is the reason that I am supporting her if she doesn't back out.

Everyone seems to be assuming that if Miers goes down, we'll end up with a more Conservative and/or more originalist candidate. I am afraid we'd end up with a repeat of the Bork / Ginsberg / Kennedy debacle.

If this is true and I don't believe it then it says more about Bush's leadership skills the anything else.

Who is going to refuse to serve if asked by the President of the United States. I did not like Bill Clinton but had he asked me to serve I would, no one turns down the president of the United States when he personally asks for thier service.

We tend to forget the politically correct rinos. They don't do what GW tells them. Republican appointments to SCOTUS have been disappointing. Only way we'll find out about this one is if she's confirmed. Personally I'd like to see a constitutional scholar who is not a judge or a shark...er.. I mean an attorney.
