Civil liability is as old as the Constitution. If it had anything to do with a police state then the Founding Fathers were dictators.

THE ABILITY OF ONE PRIVATE CITIZEN TO SUE ANOTHER PRIVATE CITIZEN HAS NOTHING TO DO WITH A "POLICE STATE."
Police states, by definition, are about the power of the state over individuals, not the rights of redress one private citizen has against another private citizen in a constitutionally authorized civil court.
As Ed Koch once said: "I can explain simple things to you a hundred times, but I can't comprehend them for you."
The state has to expose private citizens to that liability.

He ran from the rear of the flight onto the jetway according to the posted article. According to people familiar with firearms who have posted on another article about this incident, they would have and could have shot him if he was on the plane and it was in the air. From what they have said even if they had missed and hit the cabin wall or window, it wouldn't have caused a major problem with the aircraft itself.
