WASHINGTON: The Supreme Court ruled Thursday that foreign terrorism suspects held at Guantánamo Bay, Cuba, have rights under the U.S. Constitution to challenge their detention in civilian courts.
The justices handed the Bush administration its third setback at the high court since 2004 over its treatment of prisoners who are being held indefinitely and without charges at the U.S. naval base in Cuba. The vote was 5 to 4, with the court's liberal justices in the majority.
Justice Anthony Kennedy, writing for the court, said, "The laws and Constitution are designed to survive, and remain in force, in extraordinary times."
It was not immediately clear whether this ruling, unlike the first two, would lead to prompt hearings for the detainees, some of whom have been held more than six years. About 270 men remain at the island prison, classified as enemy combatants and held on suspicion of terrorism or links to Al Qaeda and the Taliban.

McCain has shown conservative to many times he is willing to screw us. After all he brags about reaching across the isle to "get things done"

Actually- this ruling just inspired Judge Nap on FOX to say this was a GREAT and HISTORIC ruling- one of the finest in 50 years, he said..

McCain became the presumptive nominee with 31% of the total primary vote. Winner take all, open primaries helped him become the nominee. He gamed the system. McCain was the only top tier candidate of either party not to win his home state by more than 50%. He won AZ with 48% of the vote.
Because the GOP nominated its maverick as the standard bearer, issues like amnesty, cap and trade legislation to address global warming, and drilling in ANWAR and offshore are off the table in the national election. Obama and McCain hold similar views. Amnesty will destroy this country with a stroke of a pen and cap and trade will wreck the economy. Some choice.
If McCain can vote on the basis of principle and conscience over party, why can't conservatives do the same thing? RAMM

Actually, another ruling that came down leaves the door open for us to extradite the criminals to Iraq or Afghanistan to be tried and punished, which ultimately leaves the door open to quick trial and hanging. If the President plays this right, the detainees could end up with less procedural protection than before.
The laws and Constitution are designed to protect the citizens of the United States of America. The Constitution is not applicable to the enemies of the USA in wartime.
The leftist oligarchy in the SCOTUS is doing its level best to dismantle the Republic...

My guess is that Anthony Kennedy is McCain's kind of Justice.
