"Barack Obama is not legally a US natural-born citizen according to the law on the books at the time of his birth; a law that was in effect between December 24, 1952 and November 13, 1986, when the law was changed.

What is actually astounding ( and I think revealing) is the fact that the Obama campaign has not hit back head on and concretely to put this issue to bed once and for all.
The lack of doing that is curious and to me, implies some inconvenient “truths” of some type may be lurking around this whole question— and the now increasingly likley birth certificate forgery.

The birth certificate on his website (and Daily Kos) has been clearly demonstrated to be a forgery based on his sister Maya's real birth certificate. The big question is: why? His sister was born in Indonesia. How could she have a Hawaiin birth certificate?

If he was really born in Hawaii, to an American citizen this is going to go nowhere. There will be no momentum to do some sort of bizarre technical action on this, and might even make Obama “sympathetic”.
The question is whether this Birth Certificate thing will prove to be something that makes someone in the MSM dig further.
Ironic how Obama is taking a vacation in Hawaii I would say.

There is no way to put this issue to bed because the believers are operating under a faith based system that rejects evidence which contradicts their beliefs and accepts assumptions and speculations as facts when it supports their belief.
This phenomena is interesting to observe and learn from because we may all be subject to this effect.

You know, if this is possibly really true then Denver will be a mess! I could see the Clinton’s not caring at this point whether they tore the party to pieces since they feel they have been dissed by it. I don’t think Hilliary if she steals the nomination could piece enough of it back together before November to win but she sure could make it an interesting fall! If you live in a city I’d be stocking up on groceries and amo soon.

This article brings up the question of whether Obama's Mama Stanley was old enough to qualify to confer citizenship on her child. She does not appear to have been, by the explicit criteria in the stated law. His place of birth is irrelevant.
From the author:
Presidential office requires the person elected to be a natural-born United States citizen if the child was not born to two US citizen parents.
US Law very clearly stipulates: If only one parent was a US citizen at the time of your birth, that parent must have resided in the United States for at least ten years, at least five of which had to be after the age of 16.
Barack Obamas father was not a US citizen, and Obamas mother was only 18 when he was born, which means although she had been a US citizen for 10 years, his mother fails the test for being so for at least 5 years prior to Barack Obamas birth.
In order for her child to have been a natural-born US citizen, his mother would have had to be 21 at the time of his birth.
In essence, Mrs. Obama was not old enough to qualify her son for automatic US citizenship. His mother would have needed to have been 16+5 = 21 years old at the time of Barack Obamas birth for him to have been a natural-born citizen. Barack Obama instead should have been naturalized, but even then, that would still disqualify him from holding the office of President under current law. At best, Barack Obama is only a naturalized US citizen. This is an issue that must be clarified before the election.

while the burden of proof is on the accuser in criminal cases, I’m not so sure that applies here. he is, after all, running for President - should HE have to prove eligibility? or is it up to us to do the impossible, and prove a negative?

The law applies when only one parent is a US citizen. Place of birth is not the issue here. Conference of citizenship by a mother who had not resided in the US for 5 years beyond age 16 - is the issue.

Bill Clinton said recently that the constitution defines who is qualified to be president....you're right. He was asked about Obama's qualifications, but instead of addressing Obama's experience and abilities, he gave the Constitutional answer.
And instead of phrasing the answer like "Obama is qualified under the Constitution...", he said "The Constitution defines who is qualified...", which leaves open the possibility that Obama may not qualify.
The Clinton's choose their words extremely carefully. As weird as this seems, the Clintons may be expecting this issue to explode.
