PHILADELPHIA - A Lafayette Hill attorney filed a lawsuit in federal court Thursday challenging Sen. Barack Obama's claim to United States citizenship. The action seeks to remove the Democratic candidate from the November ballot.
To be eligible to serve as U.S. president, a person must be born in this country. According to Obama's birth certificate, which his campaign posted on its Internet site in June to quell rumors that he is foreign born, the Illinois senator was born in Hawaii on Aug. 6, 1961. On Thursday, Philip Berg filed a temporary restraining order in federal court to bar Obama from running for president, claiming the Democratic candidate was actually born in Africa.
"We really don't believe he was born in Hawaii," Berg said. "We think he was born in Kenya."
The presidential candidate's father, Barack Obama Sr., was born and raised in a small village in Kenya, according to Obama's campaign Web site.
Berg's suit claims the senator's grandmother, brother and sister, who live in Kenya, believe they were present during Obama's birth in the African country.
Obama's mother, Ann Dunham, grew up in Kansas, and his parents met at the University of Hawaii when Dunham was a student there, according to the Obama campaign. Eventually, Obama's father returned to Kenya, and his son grew up in Hawaii with his mother and for a few years in Indonesia after Dunham married an Indonesian man, Lolo Soetoro. Also, Obama lived with his maternal grandparents in Hawaii.
"If he was born in Hawaii, and he was adopted in Indonesia by Lolo Soetoro, (Obama) would lose his citizenship," Berg said.
The Obama campaign has a special section on its Web site, "Fight the Smears," that debunks the birth certificate story and other reports that have circulated about him during the campaign.
"It's part of a smear campaign," said an Obama campaign volunteer who identified herself as Rachel. "There are just so many lies out there."
The lawsuit claims three "independent" document forensic experts performed extensive tests on the digitally-scanned image of Obama's "Certificate of Live Birth" posted on the campaign's site and found the document to be "a forgery."
Jerome Corsi, author of the book, "The Obama Nation: Leftist Politics and the Cult of Personality," has also deemed the birth certificate phony, according to The Annenberg Political Fact Check, www.FactCheck.org.
The Annenberg Political Fact Check, a project of the Annenberg Public Policy Center of the University of Pennsylvania, aims to expose deception and confusion in U.S. politics.
Recently, FactCheck.org staffers "touched, examined and photographed" the original birth certificate kept at the Obama campaign headquarters in Chicago and concluded the document is genuine.
"The evidence is clear: Barack Obama was born in the U.S.A.," FactCheck.org staffers concluded.
Sean Smith, Obama's Pennsylvania communications director, was contacted Friday about the suit but declined comment.
The civil suit filed by Berg will be reviewed by the U.S. Federal Election Commission, according to Patty Hartman, a spokeswoman for the U.S. Attorney's Office for the Eastern District of Pennsylvania.

Actually, “this person” studied this very topic in grade school on a US military base. At that time the prevailing wisdom was that those of us born overseas were not constitutionally qualified to hold the highest office in the land.
“This person” didn’t think that was fair then, and still doesn’t.
The prevailing wisdom may have shifted in the intervening decades, and there have been a few laws passed in a futile attempt to clarify it (only snarling if up further!), but the underlying question is still open.
Back in February Sen Claire McCaskill tried to get a law passed to specifically allow McCain the ability to hold that office. (Curiously, Obama tried to broaden it to include any descendant of military personnel born over seas!).
The bill failed.

It says “No person except a natural born citizen, or a citizen of the United States, at the time of the adoption of this Constitution, shall be eligible to the office of President; neither shall any person be eligible to that office who shall not have attained to the age of thirty five years, and been fourteen Years a resident within the United States. “
By “natural born” it means natural born citizen. You can tell by the use of the word “citizen” right after “natural born”.

I heard Philip Berg on the radio this PM. He told three lies right off the bat and then starts his case on Obama’s birth certificate
It's impossible to know anything about this action without knowing the particulars - including the run-down on Philip (Phillip?) Berg.
And the action could conceivably be an action INTENDED to be thrown out, thus indirectly nullifying substantial inquiries into similar realms of Obama's background, origins, and qualifications.
The problem with Obama's origins and POTUS qualifications may not be just in the context of Hawaii, but in having MULTIPLE citizenships: re Article II of the U. S. Constitution.
Most people assume BO has been vetted just cause he’s a senator and “someone must have checked” but these are bad assumptions. POTUS requires you be natural born. There may be other classified positions that require this but most positions don’t have that strict a criteria. And a candidate registers in each state to run for POTUS. According to my congressman, it is then up to the state to certify elegibility.
A great deal of detective/technical work has been produced on these threads on the COLB topic. Alot is wild speculation. But, what is certain is that someone is hiding something regarding BO’s origins and he has not provided any documentation to dispell the rumors.

I've been picking this issue apart for months, and I think I have a pretty good grasp of the ugly truth here.
Mark Twain was right about laws and sausage.
If it were up to me, I'd say the Founding Fathers were right in wanting to limit who could hold the office of president, and I'd define 'natural born' as BOTH parents American citizens, born on US SOIL, and RAISED on US soil.
That'd take 'em both out!

To be completely precise he was born on Coco Solo Naval Station (it's in the upper right corner of your pretty little map). At the time of McCain's birth, it was a US Naval submarine base and the duty station of McCain's father.
He was born in the military hospital on base. His birth certificate - just like mine, my kids', and probably even yours - records the city of birth, not the hospital of birth.
I just wanted to interject that small clarification - please carry on with your insightful commentary.

I don't think so. A lot of us have long suspected that Hillary's best shot would be a last minute candidate switch that would avoid a protracted campaign which could focus on her legacy of scandals.
So the 'rats run a well spoken black man who is not eligible. When they have to pull him, it's not their fault. The court made them do it. They thought he was eligible.
The 'rats get mega points with the black community for having nominated him, even when he gets pulled. Hillary comes riding in to save the day. With Bill now playing the part of the first black first lady. The press goes wild. Gives Hillary a honeymoon. McCain gets even less coverage.

your point is mute in regards to McCain because Mom and Dad McCain where there with the US Navy. Not because they were camping around the world. Disqualify McCain you disqualify every military brats citizenship.
Regarding Barry, according to his school papers in indonesia he was a citizen of indonesia, there for not a citizen of the US, because they don’t offer dual citizenship. Have you ever seen a kid with so many names. Its really scary and reads like an episode of Americas Most Wanted.
The gonads of these people is breath-taking, but it amazes me that our process does not determine elligibility prior to nominiation not aftwards. They spend tax payor money and franklly i think this i’m running for president started as a way to promote his stupid books and morphed into this.
I do not think he is elligible if not because of his place of birth but his acceptance of an indonesian citizenship. Now lets see if someone is willing to prove it.
