Federal grand jury meets on Palin hacking case

As a federal grand jury convened to hear testimony about the hack of Alaska Gov. Sarah Palin's e-mail account, the lawyer representing the college student suspected of accessing Palin's messages called his client "a decent and intelligent young man" in a statement issued to the media today.

"The Kernell family wants to do the right thing, and they want what is best for their son," said Wade Davies, a partner in the Knoxville, Tenn., firm of Ritchie, Dillard & Davies PC, in the statement. "We are confident that the truth will emerge as we go through the process. David is a decent and intelligent young man, and I look forward to assisting him during this difficult period."

Meanwhile, a Chattanooga, Tenn., newspaper reported today that a grand jury had convened at the federal court there, but had not filed any indictments.

The Chattanooga Times Free Press said the grand jury met this morning, when the three roommates of David Kernell, 20, of Knoxville, appeared. The session ended without an indictment, said the paper, whose Web site was offline as of 3 p.m. Eastern time.

Kernell, a student at the University of Tennessee-Knoxville, was originally linked to last week's hack of Palin's Yahoo Mail account by self-appointed sleuths on blogs and message boards after someone identified only as "Rubico" posted a message claiming to have accessed Palin's mail. Others subsequently connected the Rubico handle to the e-mail address "rubico10@yahoo.com," which was in turn linked to Kernell.

Yesterday, the webmaster of a Georgia-based proxy service confirmed that his server logs showed the intruder used an IP address belonging to an Illinois Internet service provider that serves the Knoxville apartment complex where Kernell lives.

Then, the Kernell baby-daddy can rat out the Obama staff people.

Well, y-e-e-e-e-s, I'm s-u-u-u-re he is. All the "decent and intelligent young men" I know break into other peoples property with the intent of doing them harm. It's one of the things that show their decency and intelligence.

I could go on about this "young man," but, well, you get the idea.

He’s not gonna do any time. The Federal guidelines for a first time offender is probation.

No but my son wouldn’t do this.

He committed a felony by illegally gaining access to the email account. Then he sought to use that illegally obtained information to impact a Presidential election.

True, but sentencing a 20 year old to 25 years for a stupid act like this is cruel and barbaric, to say the least.

I am so glad I did not have to grow up in this period of history. We now live in a era pretty much devoid of either mercy or compassion. America's best days are definitely behind us.

The schmuck deserves at least as much as the Watergate burglars and organizers got. What’s the difference here? Where are thge investigating reporters Hoffman and Redford (played in the movie by some long forgotten hacks)? Let’s stop posturing about compassion and mercy, the scum was working to compromise a Federal election.

Compassion and mercy are fine. Seeking to blackmail a VP candidate is pretty serious don’t ya think?

They are with that kind of attitude. Thats one difference between Obama and McCain/Palin. Obama thinks America is broke and McCain/Palin thinks America is great and could be greater.

Americans are the best because we think we are and don’t accept any other alternative. Attitude is everything.

I am inclined to agree. However, I do think there should be consequences. His debt to society should fit the crime. Personally, I’m not sure what that would be. He did commit a form of identity theft, but not for profit. Maybe he should be fined, with the fine going to the Palin campaign, and placed on probation that bars him from ANY internet activity for a period of 4 years.

What do others think?
