What would happen? Would Biden be Pres elect which would put Hitlery in as VP? IMAGINE if this was the plan all along by the Clintonistas!??? This way, Hitlery is in no matter what! I would not put it past them, not one bit.

Article XX: Section. 3. If, at the time fixed for the beginning of the term of the President, the President elect shall have died, the Vice President elect shall become President. If a President shall not have been chosen before the time fixed for the beginning of his term, or if the President elect shall have failed to qualify, then the Vice President elect shall act as President until a President shall have qualified; and the Congress may by law provide for the case wherein neither a President elect nor a Vice President elect shall have qualified, declaring who shall then act as President, or the manner in which one who is to act shall be selected, and such person shall act accordingly until a President or Vice President shall have qualified.
What the Constitution says is that Biden would "act as President until a President shall have qualified".
What this means, the "shall have qualified" part, is unclear to me. If Obama was born in Kenya, then nothing can happen to remove his disqualification. Under a simple interpretation, it means that Biden would "act as President" until January 20, 2013. But an alternative scenario would be that the House of Representatives would have to elect a President from among the top three electoral vote getters who were qualified, i.e, John McCain, John McCain, or John McCain, and after the House election, Biden would resume his elected office of Vice President under President McCain.
The real good news is that Hitlary is a natural born criminal and not anointed by rabid communists and guilty racists. Further, it has already been established by the left that discrimination against women is a virtue. Hitlary is a political fight that can be waged without actual war. I am not so sure about the first not quite American Dictator.
I think Biden would become acting president and could likely serve all four years. Hillary wouldn’t be VP. Biden would appoint a VP and he would have to be approved by the Senate.
Don’t know for sure, but I think any appointments made by Obama - anybody chosen to serve with him and on his cabinet, would be nullified. President Bush would stay in office an additional 90 days until a special election could be held. That was what I heard on another discussion about this yesterday.
Since the electoral votes have not yet been counted, it's possible that the ones cast for Obama for President would be declared invalid. In that case no one would get a majority of the electoral college votes and the election would be thrown into the House of Representatives. They are constrained to pick from the top three vote getters, which would be McCain, unless some Obama elector was "unfaithful" and voted for someone else..say Hillary. Then the House could choose between that person or those persons, and McCain. I don't think the uber majority Democrat House would pick McCain.
Now if this did no come through until after the votes are counted, well then it's a mess, but Biden would be acting President under the 25th amendment, until a President shall have qualified. I don't know if that means it would go to the House per the 12th amendment or not, I guess that's all that would make sense, since the Constitution clearly does not provide for an election "do over".

It might matter if they DQ Obama before or after being sworn in. McCain could still get in there if Obama is blocked from being sworn in. It might be Biden if Obama is DQ’d after being sworn in.
