A 72-year-old woman is pulled over for speeding, then tasered and sent to jail. Kathryn Winkfein says she drives to Austin about twice a month to do her shopping. But on a Monday afternoon, a Travis County Constable deputy pulled her over, on her way back to Granite Schoals.
"Due to being a construction zone, and workers being present," Pct. 3 Constable Richard McCain said, "it was 45, she was doing 60."
Winkfein admits she was speeding in the dangerous strip of Highway 71 and Bee Creek.
"He explained to her," Constable McCain said, "sign the ticket stub, it's not an admission of guilt. It's a promise to appear in court. She didn't want to. She said take me to jail."
That's when the officer says Winkfein exited her vehicle and didn't cooperate.
"She refused to get off the side of the road, he said to her, Ma'am, you're under arrest. She used profanity," the Constable said. He adds she got violent, and the officer used a taser on her.
Winkfein showed FOX 7 her taser scars.
"Here and here. Two places, side by side. It's unreal. It's like an electric shock," she said.
A shock Winkfein believes she didn't deserve.
"I wasn't argumentative, I was not combative. This is a lie. All of this is a lie, pulled away from him I did not," she said, reading the arrest affidavit.
The great-grandmother was taken to the Travis County Jail, where she was booked for resisting arrest and detention. She was released shortly after. Now, Winkfein has hired attorneys to protect her rights.
When asked if it was appropriate for the arresting officer to have used a taser, Constable McCain answered yes.
There is no situation that can’t be made worse by the addition of a cop.

WOW, close call ! Thank God he had a taser or he would have had to put a bullet in her to save himself.
No way this vicious Amazon Granny could have been otherwise subdued by any mere mortal man.

On one of the Amazing Police Video episodes, a cop pulled over a guy for speeding (I think in NH). The guy was screaming so loud you had a hard time understanding him. I thought blood was going to squirt out of his eyes. The cop maintained a perfectly calm, respectful demeanor throughout. When given the ticked, the guy ripped it to shreds and threw it at the cop's chest. The cop calmly told the guy that if he didn't pick it up, he'll ticket him for littering. The guy got out of his truck screaming at the top of his lungs, picked up the pieces, and drove off. That's probably in some training video now - how to maintain your composure to get the job done.
These same citizens will someday vote whether the retirement contracts of the policemen will prevail or not in economically stressful times. Cops can be really dumb sometimes.

Don’t know what happened here, but I do know my grandmother would have used words the cop never heard before and probably kicked his butt.
I’m thinking more along the lines of “I’m not signing this %#@(%$) thing you (@%)@%. You can go @%@^ yourself and take that badge and @(%$@ it up your @$$.” That kind of thing is not legal.
I might have said that a little differently, myself. Just a thought.

The taser was probably the safest thing the cop could do. Forcibly cuffing her could have broken a bone, then look at the lawsuits. God forbid she broke a hip or something. Zapping her calmed her down quickly I imagine, allowing for a save restraint.
At her age a curtsy could’ve sent her to the hospital with a broken hip; a shoe-smooch coulda broke her back in half.

How do you know it wasn’t the best way to handle the situation, you weren’t there. If you’re standing on the side of a major highway and the old lady is flipping out maybe that is the right thing to do.
If you watch the video news report, that’s not the way that line went down. She was reading from the report, “’Pulled away from him.’ I did not.”
It’s a funny Yoda line, though.
Fortunately, dash cams are often inoperative at times like this.

Ms Winkfein and her attorney need to make the case that the taser is an instrument of torture. I am sure it is a lot worse than a caterpillar crawling on your face.
