HPD: Woman fatally shoots car burglar

A woman fatally shot a suspected car burglar Monday night in the parking lot of her northwest Houston apartment complex, police said.

The woman told Houston police she shot the man about 9 p.m. after she spotted him breaking into her car parked outside the apartment in the 5900 block of Pinemont at Alabonson.

The man still had a screwdriver in his hand when the woman opened fire with a shotgun. The door lock to her car also had been popped open, officers at the scene said. He was pronounced dead at the scene.

Sounds like an open-and-shut case of justified shooting to me.

It’s the old “shoot em in the leg or shoulder” fallacy. Read up on it.

Have you ever been the victim of a crime or break in? I have, several times and when it happens to you, you just want the guy dead on the spot. All of your care, concern and feelings of mercy for the guy, go right out the window.

Personally I think every burglar, car thief and mugger should be shot dead on the spot, dragged back to their “home” neighborhood and hung from a lamp post.

I’ve been the victim of crimes, yes, and didn’t like it one bit. Wanted them dead for a while, but I got over it since he got away.

I’ve also killed people in war, and even though it was self defense, it’s not a fun thing.

If I’m ever the victim of a break-in again, I’ll hold the son-of-bitch for you, send you an e-mail, and you can come here and kill him (or her)

If she was not under direct threat, she may very well be haunted by that fact the rest of her life, because she could have kept the gun on him while she called the cops, or maybe just wounded him.

That may depend on what kind of rap sheet, if any, the dead guy had...

In NJ, a sling-shot (which, for some unknown reason, they call a “slung shot”) is a prohibited weapon, in the same general category as an assault rifle.

In times past, a slung shot was a lead weight with an attached cord which was slung by holding the cord. It was completely different and much more deadly than a sling shot.

One of Abraham Lincoln's more famous cases as a lawyer was the defense of a man accused of killing another with a slung shot.

If someone is breaking into my home while I am in it, I can shoot. If they flee after seeing what was waiting for them in my home, I can not. The threat of bodily harm is over.

The law in Texas is very direct on this issue. You can use deadly force to prevent theft. "To prevent the others imminent commission of arson, burglary, robbery, aggravated robbery, theft during the night time" Texas penal code 9.42

You can also use deadly force against an individual that is fleeing with your property at night time. The code assumes that at night you can not tell if the bad guy is armed and deadly. Therefor the law comes down on the side of the victim and assumes the bad guy is a deadly threat if it is night time. She will walk.

Killing for an attempted robbery does not warrant a death.

If he attacked her, than it’s a different story.
