The Senate passed a MEANINGLESS, non-binding resolution, which proved NOTHING, except that the Senate is clueless. In that John McCain being born in PANAMA (a foreign country) can NOT be a NBC. He was born in the City of Colon's hospital, where the US had no legal authority. This didn't matter since Panama is a FOREIGN COUNTRY. Get it? FOREIGN. NOT a US territory, not the US. HIS long form birth certificate is available for anyone to see.

You cannot retire if your court martialed and seperated on a dishonorable discharge, or other than honorable. I do not believe he will face jail time. I do think he will be quietly retired though. They will most likely ask him to hand in his retirement papers, and they will be thrown on top of the stack, instead of most O-5s and O-6s having to wait months for their answer.

The only way Obama has gotten away with this is he studied the laws enough to know he could pull it off with the short form. Thats just my .02$.
Of course even if the Lt Colonel is morally right he is going to lose this one, he’s gone.

He was born to US parents to a serving memeber of the Armed Forces. That, since the adoption of the Constitution of the United States makes McCain an NBC. Same if born to a US Diplomate in a foriegn country.

After thinking on it a little more, he obviously wants to challange Obama's legitimacy in court in the form of a court martial. What he's not realizing is that it won't ever get to a court martial stage or if it does, the members will refuse to consider that a valid defense. Considering if he gets dishonorably discharged (probably the most likely outcome), he won't have any hope of getting his pension and may end up doing prison time, I would say he has a great deal to lose if it blows up on him.
However, never say never, he could get the right people on the board for his CM and actually challenge Obama. I'd call those some mighty long odds though.

A commander-in-chief should not be excused from fulfilling meaningful requirements that those serving under him in rank are regularly required to fulfill.
The presenting of a birth certificate is a routine, not extraordinary, matter
Col. Lakin will undoubtedly now, not make full Colonel. But he has shown in his way that as a conscientious military officer, he ranks above the usurper currently in the Oval Office.
