Feds sue to block Arizona illegal immigrant law

PHOENIX (AP) -- The U.S. Justice Department on Tuesday filed a lawsuit challenging the constitutionality of Arizona's new law targeting illegal immigrants, setting the stage for a clash between the federal government and the state over the nation's toughest immigration crackdown.

The lawsuit filed in U.S. District Court in Phoenix argues that Arizona's law requiring state and local police to question and possibly arrest illegal immigrants during the enforcement of other laws such as traffic violations usurps federal authority.

While they’re at it, maybe Obama and Holder would like to tell us what other federal laws they don’t want the states to enforce. Maybe they’d prefer that local cops and highway patrol ignore speeders on the interstate highway system, and let the FBI handle it. Stuff like that.

Who do they think they’re kidding?

You hit the nail on the head. This will be laughed out of court and just wait until it gets up to the USSC. Roberts will get his revenge yet again for Obama’s SotU speech.

I doubt if there is a breathing human who thinks Az is wrong and who thinks 0dumbo is right to sue a state who is trying to get the POS to enforce our laws.

But if as reported by WaPo part :”The filing is expected to include declarations from other U.S. agencies saying that the Arizona law would place a undue burden on their ability to enforce immigration laws nationwide, because Arizona police are expected to refer so many illegal immigrants to federal authorities.”
surely even MSM will have to laugh.

So let me gert this straight, we can’t let Az enforce existing FEDERAL laws because if we do the fed agencies will be too busy?

I’m not sure it will be laughed out of court at first. Of course, Holder will have shopped this complaint to the first and foremost Federal Court he can assure himself of agreeing with him. Arizona will have to appeal the loss. Eventually it will make it to the big league. The key damage Holder hopes to do is to enforce a ban on implementation throughout the November elections and possibly to 2012 for Bammer’s reCoronation.

Yeah...and the judge slaps them with a "filing a frivolous lawsuit" and fines the gobmint $1B to be paid forthwith to the Great State of Arizona to build a fence (subcontracted to the Israeli government who have great designs and experience in building fence),

On appeal the next level court also throws out the gobmint case and doubles the fine to $2B.,......

I hope Arizona makes a huge spectacle of the complete failure of the feds to control the border and the consequences of it for the people of Arizona.

This is another example of how Obama views the federal gov’t as the supreme master over all.

People like Obama support the federal gov’t using highway funding as a carrot to force states to change their speed limits, drinking ages, etc.

This filing falls within the purview of the 9th circuit.

iirc, the 9th is no friend to original intent...

I wish I could agree but the utter lack of organization I am seeing from the Republicans is downright scary. There seems to be this attitude on the Republican side of the aisle that all they have to do is show up and they will win by default. That might be the case for the dems when the voters are unhappy wtih the Republicans, but with the MSM doing the dems dirty work there is NO such thing as a default win, ever!!!

I wonder if the ONLY purpose of this is to delay as long as possible, maybe hoping they can get amnesty shoved through congress before Nov?

If I do something illegal, I might go to jail. So, if someone comes to the US illegally, why shouldn’t they be deported or punished somehow?

It is remarkable, really - Mr. Obama doesn’t make that many mistakes. Nope. That’s not the problem with him and his. The problem is he does EVERYTHING wrong.

That’s quite an accomplishment.

AZ could easily enforce other laws that will clearly discourage illegals and most importantly their legal employers. There are thousands of laws and codes that any employer or leasor would be subject to should the State and local governments be so interested in applying them. Further, I doubt seriously that AZ would be in defiance of the stay if it were to ask for proof of citizenship when disbursing State benefits. Failure to provide proper identification would be grounds for with holding of benefits. Finally, AZ could easily put on a dog and pony show during the trial by rounding up known drug/coyotes and charging them under State law. That would make a nice backdrop to AG Holders show trial.

All we heard was that sealing that border was a number 1 priority....AND IT WAS A FEDERAL JOB. But the Feds have failed miserably but there was a lot of money shoveled into this "sealing".

This is all about money and votes. Bet the kitty was spent...but it did "0" to stop the flow.

Maybe so. I don’t know the Phoenix Court makeup.....I DO know that they would do it if at all possible. I firmly believe that the evil that runs this country will ‘deem’ immigration ‘reform’ to have passed before the November elections (they just ‘deemed’ a fictional budget to have been passed so why shouldn’t we expect a bunch of new Mexican brother and sister Americans to be added to our citizenship rolls just in time to vote for Democrats?
