Indian Hospital defends disabled woman against author’s call for euthanasia

MUMBAI, February 1, 2011 (LifeSiteNews.com) - Doctors at Mumbai’s King Edward Memorial (KEM) hospital are concerned for the life of Aruna Shanbaug, a former nurse at KEM who suffered serious brain damage when she was strangled and raped in 1973, and who has been cared for by hospital staff ever since.

The Indian Supreme Court ordered an investigation into Shanbaug’s condition after a journalist, who wrote a book about Shanbaug, filed a petition seeking to have hospital staff discontinue feeding her.

Journalist Pinki Virani said through her lawyer that Shanbaug had been “virtually a dead person” for the last 38 years, living in a “persistent vegetative state” and thus did “not have the standard of life guaranteed by the Indian constitution.”

Virani’s petition asked the court to instruct the hospital staff to “forthwith ensure that no food is fed” to Shanbaug, according to a report in The Independent.

“This vegetative existence devoid of any human dignity is not life at all and putting mashed food in her mouth only amounts to violation of human dignity,” she said. “The continued vegetative existence of Aruna is a violation of her right to live with dignity ... she has a right to not be in this kind of sub-human condition.”

Virani’s lawyer, Shubhangi Tuli, submitted that the case was not about euthanasia, which is illegal in India, but rather about the medical definition of death. “She cannot move, she cannot hear. She only survives because she is being fed,” the lawyer said. “We are saying this is not life as guaranteed by Article 21 of the Indian Constitution.”

However, Dr. Sanjay Oak, dean of KEM hospital, disputes the claim made by Virani, saying that Shanbaug “is very much alive,” and in his affidavit filed to the court indicated that Shanbaug is not suffering, accepts food normally, responds by facial expressions and makes sounds to express her needs.

“She is on a liquid diet and loves listening to music. We have never subjected her to intravenous food or fed her via a tube. All these years, she hasn’t had even one bedsore. When those looking after her do not have a problem, I don’t understand why a party who has nothing to do with her needs to worry.”

“We have no moral right to terminate her life. I am certainly against euthanasia for Shanbaug,” Dr. Oak stated, and added “I call on her whenever I get time. I am there whenever she has dysentery or any other problem. She is very much alive and we have faith in the judiciary.”

Alex Schadenberg of Canada’s Euthanasia Prevention Coalition expressed grave concern over the Indian court being asked to rule on withdrawal of nourishment from Shanbaug – “who is not a family member or a friend from years before.”

“What is significant is that Shanbaug is not dying,” said Schadenberg. “She is a human person who is in an incredibly vulnerable condition. She is not requiring medical treatment, but rather she continues to live as long as she is fed.”

“Ms Virani has stated that the court needs to consider the medical definition of death,” Schadenberg observed. “If people with cognitive conditions are labeled as dead, then the meaning of life will be altered to a man-made definition. Who else will be defined as already dead?”

The anti-euthanasia activist pointed out that providing food and water to a person with cognitive disabilities “is normal care.” “It is not excessive, extraordinary, or burdensome and it is able to be done by anyone.”

Schadenberg warned that “if society decides that killing people by dehydration, which should be called euthanasia by dehydration, is acceptable, then society will have agreed that the most vulnerable in our society have lost their right to protection and may be killed by others.”

‘Worst attack - ever’: Planned Parenthood reeling from attacks on all fronts

February 15, 2011 (LifeSiteNews.com) - In a desperate attempt to rally pro-abortion forces to head-off proposed defunding and allegations of illegal activity at Planned Parenthood, CEO Cecile Richards sent out an email on February 14 with the subject line “the worst attack – ever.” Richards said that the “anti-choice House leadership is forcing a vote on the most dangerous legislative assault on women’s health in Planned parenthood’s 95-year history.”

“They want to shut down every Planned Parenthood health center in America,” Richards declared.

Richards was referring to the Title X Abortion Provider Prohibition Act, a measure introduced by U.S. Congressman Mike Pence (R-IN) on January 7, 2011. The bill, which was just approved by the House Energy and Commerce today, would strip Planned Parenthood, the largest provider of abortions in America, of federal Title X funds.

Title X funds are earmarked for providing “comprehensive family planning” and related services.

Pence stated, “The largest abortion provider in America should not also be the largest recipient of federal funding under Title X.”

Planned Parenthood receives over $360 million a year in federal funding.

Pence said the new legislation would prevent any abortion-providing organization, including Planned Parenthood, from receiving Title X funds. However, the bill would not reduce the total amount of Title X funds and would free more federal monies to groups that do not provide abortion.

In her email, Richards observed, “This attack ... is not an isolated incident. It’s part of a coordinated campaign meant to shut down Planned Parenthood ...”

Along with the proposed defunding legislation, recent revelations made in a series of undercover videos released by the pro-life organization Live Action have shown numerous Planned Parenthood facilities willing to aid and abet sex traffickers by helping them obtain birth control and abortions for their underage “sex workers.”

The videos have brought into question Planned Parenthood’s credibility as a self-professed provider of care for women.

Live Action’s latest videos have also resulted in calls for law enforcement investigations into Planned Parenthood’s activities.

Live Action President Lila Rose said videos of PP clinic staff in New Jersey and Richmond, VA, coaching a purported pimp and his prostitute on how to cover up their child sex trafficking operation is evidence of the endemic problem of Planned Parenthood’s willingness to aid and abet in the sexual exploitation of minors and young women.

“We are sharing the full Richmond footage and transcripts with Virginia law enforcement officials and we are formally asking Attorney General Ken Cuccinelli to conduct a statewide investigation of these heinous practices, just as the New Jersey Attorney General is opening her own investigation into Planned Parenthood’s compliance with the law in her state. Planned Parenthood needs to be held accountable,” Rose said.

On another front, a coalition of many of the country’s most prominent pro-life organizations, united under the name “Expose Planned Parenthood,” held a “vigil for victims of underage sex trafficking” February 14 in front of Planned Parenthood facilities across the country.

The website of the Expose Planned Parenthood coalition says that the vigils focused on three major ideas: that Planned Parenthood is aiding & abetting underage sex trafficking, that it is unsafe for women and girls, and that it should not be receiving tax dollars.

“Enough is enough,” says the coalition. “We must act swiftly and take a public stand against Planned Parenthood’s harmful agenda - raising awareness in the communities where we live, and calling upon Congress to IMMEDIATELY strip the abortion chain of all tax funding.”

Marjorie Dannenfelser, president of the Susan B. Anthony List (SBA List) slammed Planned Parenthood Federation of America (PPFA) for its attempt to smear Lila Rose and cover up “its protracted pattern of illicit activities.”

“Out of fear and desperation, Planned Parenthood and its president, Cecile Richards, have unleashed their attack dogs to distract from their unsafe and exploitive practices,” Dannenfelser said in a press release. “Ms. Richards has no concern about the organization’s documented and systemic willingness to aid and abet sex trafficking of minors, which tells us much about Planned Parenthood and their real agenda.”

“At its core, Planned Parenthood and its clinics are not safe for women, for children and for the public at large. American taxpayers should not be funding this organization that engages in potential criminal activity,” Dannenfelser said.

House votes to defund Planned Parenthood

WASHINGTON (BP)--The U.S. House of Representatives voted Feb. 18 to eliminate all federal funding for Planned Parenthood, the country's No. 1 abortion provider, during the remainder of this fiscal year.

It is apparently the first time a chamber of Congress has ever voted to defund the organization, which recorded more than 324,000 abortions at its clinics in 2008, the most recent year for which statistics are available.

In a 240-185 roll call, the House acted to cut off all federal government money for the Planned Parenthood Federation of America and its 102 affiliates through Sept. 30. Planned Parenthood and its affiliates received $363.2 million in government grants and contracts during the 2008-09 fiscal year. Some of that total came from state and local governments.

Representatives added the Planned Parenthood amendment to a continuing resolution to extend funding for federal agencies in the absence of a 2011 budget. Congress failed to pass a budget last year, adopting instead a resolution that continued funding for the federal government through March 4.

Pro-life advocates applauded passage of the amendment.

Rep. Mike Pence, R.-Ind., the amendment's sponsor, described the vote as "a victory for taxpayers and a victory for life. By banning federal funding to Planned Parenthood, Congress has taken a stand for millions of Americans who believe their tax dollars should not be used to subsidize the largest abortion provider in America."

Douglas Johnson, the National Right to Life Committee's legislative director, said the "landmark vote demonstrates that most House members now recognize Planned Parenthood is a hyper-political, under-regulated, out-of-control mega-marketer of abortion as a method of birth control."

A long-time legislative strategist in Washington, Johnson said it is the first time he recalls a congressional vote to cut all federal funds for Planned Parenthood.

Pence's amendment, as well as the continuing resolution it is a part of, faces an uphill battle in the Senate.

The House still had more than 100 amendments proposed to the continuing resolution the afternoon of Feb. 18 before a vote on final passage could be taken. Republicans are seeking to cut $100 billion from the budget in the resolution. In amendments approved Feb. 18, the House voted to withhold funds for implementation of last year's health-care reform law.

The roll call on Pence's amendment was largely along party lines. Ten Democrats reportedly joined 230 Republicans in supporting the proposal, although the official roll call had not been posted on the House's website by 4:30 EST.

In a Feb. 17 floor speech on his amendment, Pence said he was not conducting a "war on Planned Parenthood.... Sadly, abortion on demand is legal in America. This debate is about who pays for it.

"Nobody is saying that Planned Parenthood can't be the leading advocate of abortion on demand in America," he said, "but why do I have to pay for it?

"Nobody is saying that Planned Parenthood can't continue to be the largest abortion provider in America, but why do tens of millions of pro-life taxpayers have to pay for it?"

House approval of the amendment followed nearly three weeks of damaging publicity for Planned Parenthood. Hidden-camera videos secretly recorded at the organization's clinics and released Feb. 1-8 showed employees demonstrating an apparent willingness to aid sex traffickers whose prostitutes are in their early teens.

Live Action, which is led by young pro-lifers, released video footage from secret investigations at six clinics that showed Planned Parenthood staff signaling cooperation with a self-described pimp in providing birth control, testing for sexually transmitted diseases and/or abortions for his alleged, under-age sex workers. The pimp and a prostitute who, in some cases, accompanied him to the clinics were actors doing undercover work for Live Action. An undercover audio from another Planned Parenthood clinic in Washington, D.C., and released Feb. 10 revealed a similar response from a staff member.

The clandestine videos were shot at Planned Parenthood clinics in New Jersey, New York and Virginia from Jan. 11 to 14, according to Live Action.

Pence has been working to cut federal funding for Planned Parenthood in recent years. Two previous attempts to eliminate grants for the organization under the Title X program failed. His proposals to that effect failed by a 231-189 vote in 2007 and by 247-183 in 2009.

Title X is the federal government's family planning program, and Planned Parenthood is the leading recipient of Title X funds. Although Title X funds do not go directly for abortions, pro-life advocates contend federal money frees up other contributions to Planned Parenthood for the promotion and performance of abortions.

Southern Baptist ethicist Richard Land wrote the House leadership Feb. 16 to urge support for Pence's amendment and other pro-life legislation in the continuing resolution. "We do not believe the government should be in the business of supporting the nation's leading abortion provider with taxpayer dollars, no matter how Planned Parenthood allocates the money," said Land, president of the Ethics & Religious Liberty Commission (ERLC).

The ERLC sent an e-mail alert to constituents earlier Feb. 18 to encourage calls to House members for support of the amendment.

Pence introduced in January the Title X Abortion Provider Prohibition Act, H.R. 217, which would prohibit Title X funds from going to all abortion providers, including Planned Parenthood.

The Government Accountability Office reported only $53 million of the $363 million in government funds Planned Parenthood received in 2008-09 came through Title X, Pence said.

Planned Parenthood recently issued new rules requiring at least one clinic per affiliate to perform abortions, signaling it is prepared to gain a greater market share of the abortion business.

The Republican leadership placed several pro-life measures in the continuing resolution. Among those are:

-- Reinstatement of the Mexico City Policy, which would bar federal money for organizations that perform or promote abortions overseas.

-- Restoration of the prohibition on funds for the United Nations Population Fund, which has been found to support China's coercive population control program.

-- Re-establishment of the ban on the use of federal and congressionally approved local funds for elective abortions in the District of Columbia.

Live Action's newly released video stings are the latest in a series of undercover investigations of Planned Parenthood clinics released during the last four years.

A previous hidden-camera project by Live Action caught Planned Parenthood employees in Alabama, Arizona, California, Indiana and Tennessee seeking to cover up alleged child sexual abuse, prompting some state investigations. Another video sting showed a counselor at a Planned Parenthood clinic in Wisconsin providing erroneous information about fetal development.

In an undercover investigation Live Action conducted by telephone, Planned Parenthood workers in seven states were caught on audio tape agreeing to receive donations designated for abortions of African-American babies.

‘She was worth it’: UK mom delayed leukemia treatment to save life of unborn daughter

BIRMINGHAM, UK, February 17, 2011 (LifeSiteNews.com) - One British cancer patient has sent a powerful message about the value of life after she refused aggressive treatment for her leukemia in an effort to save the life of her unborn daughter – who was, in fact, born perfectly healthy last April.

“My doctor told me I needed to make a choice and decide whether I should keep my baby. To me, there was no decision to make,” Victoria Webster, 33, told the UK’s Daily Mail. “I had already bonded with my baby while she was growing inside me and as her mum, I had to protect her.

“Doctors kept telling me I should have a termination - but I had made up my mind, and my husband Martyn supported me.”

Webster had discovered that she suffered from chronic myeloid leukaemia, or cancer of the blood, during a routine blood test when she was 21 weeks pregnant. Doctors, who said her prognosis was good because they caught the disease so early, begged her to begin chemotherapy immediately, a treatment that would have killed her unborn daughter Jessica.

Webster instead opted for a less aggressive treatment, and waited until Jessica was born in April 2010 by Cesarean section before taking the powerful drugs. She is now reportedly responding well to treatment, and she hopes that she will soon be in full remission.

“It’s the best decision I have ever made. I can’t imagine my life without my daughter,” said Webster.

“I was terrified that even my milder treatment would have harmed Jessica, but luckily, she was perfect,” she said.

“We bonded straight away - holding her in my arms was truly an amazing moment.”

The mom from Birmingham, who also has a four-year-old son Lewis, said that when she was first told she had cancer, “bizarrely, my first feeling was one of relief.” “I thought they were going to tell me that there was something wrong with my baby,” she told the Mail. “It wasn’t until a few days later when it really hit me. ‘I was terrified that my son would have to grow up without his mummy.”

Alex Schadenberg: Save baby Joseph Maraachli vigil - Monday at 9 AM

On Thursday, I wrote a comment about the decision by the Ontario Superior Court to withdraw the ventilator from 13 month old, Joseph Maraachli. This is not a case of euthanasia but it is an injustice that will effect Ontario citizens because the Judge decided that the decision of the doctors and the hospital is upheld against the reasonable decision of the family.

All the family is wanting to do is bring Joseph home so that he can die in the care of his family.

A group of people who are supporting the Maraachli family are having a vigil for Baby Joseph and his family starting at 9 am on Monday, February 21, at the corner of Wellington and Commissioners in London Ontario (near the hospital).

Apex court seeks doctors' presence in euthanasia plea (India)

The Supreme Court today sought the personal presence of a 3-member team of doctors from Mumbai to assist it on the vexed question of permitting euthanasia (mercy killing) of a rape victim virtually brain dead for the last 36 years.

A bench of justices Markandeya Katju and Gyan Sudha Mishra sought the presence of the doctors J V Divatia, Roop Gurshani and Nilesh Shah at the next date of hearing on March 2 to help the court understand the content of the report submitted by the team.

The bench sought the presence of the expert team as purely technical terms were used in the report.

"It is quite possible that we may like to ask them questions about the report which they have submitted, and in general about their views in connection with euthanasia.

"On perusal of the report of the committee of doctors, we have noted that there are many technical terms which have been used therein, which a non-medical man would find it difficult to understand. We, therefore, request the doctors to submit a supplementary report by the next date of hearing in which the meaning of these technical terms in the report is also explained," the bench said in an order.

The apex court asked the centre to take care of all the travel and accommodation, besides payment of honorarium, if any, to the doctors.

It also permitted the Dean of King Edward Memorial Hospital and Pinky Virani, the petitioner, to present their views at the next hearing.

The apex court passed the order at the mentioning period after attorney general GE Vahanvathi and amicus curiae TR Andhyarujina agreed for hearing of the case on March 2.

On January 24, the bench had sought the attorney general's response on the tricky issue as euthanasia is not legalised in the country.

The apex court had also appointed a 3-member doctors' team to examine the victim Aruna Ramachandra Shanbaug and submit a detailed joint report to it by the next date of hearing.

"Euthanasia is one of the most perplexing issues which the courts and legislatures all over the world are facing today. This court, in this case, is facing the same issue and we feel like a ship in an unchartered sea, seeking some guidance by the light thrown by the legislations and judicial precedents of foreign countries," the bench had said in earlier an order.

The petition was filed by Pinki Virani, a writer, and her friend who brought to the court's attention the pitiable state of the victim languishing in Mumbai's King Edward Memorial (KEM)Hospital and pleaded that Aruna be allowed to die peacefully by withdrawing the food being supplied to her forcibly.

Victory Alert: Abortion Clinic Safety Passes Senate!!

In a historic vote, the state Senate today approved legislation that requires the Board of Health to create regulation for abortion centers in Virginia! After over two decades of hiding behind a veil of political secrecy, abortion centers in Virginia will now face greater scrutiny and better health standards.

After a long and passionate debate on the Senate floor, the vote was 20-20 with Lt. Governor Bill Bolling casting the deciding vote in favor of the bill!

We will provide more information on this tremendous victory later.

Virginia’s Attempt to Close Abortion Clinics

Yesterday the Virginia House of Delegates approved a bill that would hold abortion clinics to the same medical standards as hospitals, and so result in the closing of the majority of clinics operating in the State. Some estimate that 17 of 21 clinics would have to close. The bill was passed as an amendment to a bill already approved by the Virginia State Senate, where the abortion clinic provision would have been killed in committee if it had gone through normal channels.

A Constitutional challenge is certain, so it remains to be seen whether the new law will ever have its desired effect. It is interesting, however, to see both pro-lifers and pro-aborts try to seize the moral high ground by expressing their attitudes toward the bill more or less exclusively in terms of women’s health.

Everybody knows that those who worked to pass the bill did so primarily to restrict abortion, and that those who oppose the bill oppose it primarily to keep abortion both cheap and common. It is a judgment on our society that neither side can actually come out and say what it wants, at least not in the context of the particular tactic being used in this instance, which is to emphasize that abortion is a medical procedure that should be held to the same high standards as other comparable medical procedures.

There are no medical procedures comparable to abortion, of course, but it goes without saying that the argument is couched in language that recognizes the dangers of the procedure to the mother only. It wouldn’t do for pro-lifers to give the courts grounds to suspect that their real intention here is to eliminate abortion, rather than to impose high health standards for the sake of women. Nor would it do for pro-aborts to let on that they don’t give a fig for the health of women as long as abortion can be kept widely available. Thus the rhetoric:

It is a shame that this battle cannot be fought clearly on the grounds that it is gravely evil to murder an unborn baby, who has a right to life equal to that of his or her mother. But that’s not to say that nobody is genuinely concerned about the health and safety of women who make use of abortion clinics. After all, abortion would never be so unregulated if it weren’t a sacred political cow in the first place.

So this is politics, and politics is always the art of the possible. When what you want to accomplish isn’t possible in one context, you introduce it again in another context. And you keep doing that until you get a toehold. You keep doing that until you win. Those who have adopted this strategy must stay the course. And if it doesn’t work this time, they must unashamedly go back to the political well and try again.

Virginia's novel approach to ending abortion. Will it stand up in court?

The 2006 film Amazing Grace depicts William Wilberforce's campaign to end the slave trade in Great Britain. A scene from the movie depicts the abolitionist Members of Parliament discussing how to proceed in the legislature after numerous failures. The issue had become so polarized that a direct vote on the slave trade was a losing proposition. The following dialogue between Wilberforce and fellow Member of Parliament James Stephen (who was about to present his eye witness account of slave operations to the rest of Parliament) ensues:

Stephen: If we go to Parliament with this evidence, there'll be sympathy, there'll be concern, but it'll be just the same as every other time.

Wilberforce: Have you come back to preach hopelessness?

Stephen: No. No, I've had an idea. In my law books I might have stumbled across something and I want to propose it as a strategy. Nosus Decipio. It's Latin. Loosely translated, it means..."we cheat".

The abolitionists created a bill that would put most of the slave traders out of business without directly voting on trade itself. The abolitionists regulated the bulk of the slave-trade out of business.

The Virginia legislature has found a similar route to help end abortion in the state. The legislature passed a law that requires abortion clinics to comply with same regulations as hospitals. From the Richmond Times Dispatch:

Under the legislation, any physician's office performing five or more first trimester abortions a month would be classified as a hospital, subject to special regulations established by the state Board of Health within the next 280 days.

The regulations will require abortion clinics to retrofit their operations. The retrofit could mean everything from widening hallways to additional employee training, according to the Associated Press. The Dispatch reports that most of the state's abortion clinics will be forced to close because of the "lengthy and costly certification process that most clinics could not afford."

The passage of the bill was something of a cliffhanger. The Virginia senate is controlled by the Democrats, 22-18. For that reason, life bills generally die in committee. But the Republican controlled house included the provision as an amendment to a bill already passed by the senate, thereby passing the committee process by putting the bill up for a vote by the entire senate. The two Democrat senators that vote with the pro-life bloc brought the tally to 20 Yeas and 20 Nays. The tie-breaker was made by pro-life Lieutenant Governor Bill Bolling.
 
The abortion lobby will certainly challenge the law in court. But the chances are far better that a court rules in favor of a health-facility regulation than a law restricting abortions in the first trimester.

New York City Council determined to pass “police state” pregnancy center gag law next week

NEW YORK, February 25, 2011 (LifeSiteNews.com) - Pro-life sources in New York City have learned that a bill designed to gag pro-life crisis pregnancy centers (CPC), much like one in Baltimore that was deemed unconstitutional, is slated to be voted out of committee and immediately put to a full Council vote next Wednesday.

Proposed Initiative 371-A accuses crisis pregnancy centers of employing “deceptive practices” that “can impede and/or delay” women’s access to abortion.

The bill mandates that pro-life centers display a sign declaring that they do not provide abortions “in writing, in English and Spanish ... conspicuously posted in the entrance of the pregnancy cervices center; at least one additional sign posted in any area where clients wait to receive services; and in any advertisement promoting the services of such pregnancy service center in clear and prominent letter type.”

Any CPC in violation of the rule would be liable for up to a $1000 fine for a first offense, and up to $2,500 for subsequent offenses, as well as up to six months imprisonment.

The measure has been strongly supported by NARAL Pro-Choice New York, who had helped spur introduction of the measure with an investigative report that claimed CPC workers misled women about abortion. Ironically, the title of the report, “She said abortion could cause breast cancer,” portrayed as a myth a health risk that has been verified by top researchers.
In November 2010 testimony before the Committee on Women’s Issues of the New York City Council, Jeanneane Maxon, general counsel for the CPC network Care Net, pointed out the “clear Constitutional concerns” over government regulation of speech raised by Int. No. 371 for specifically targeting only facilities that do not offer abortions. “It would not matter how professional, honest, forthright, and/or legally compliant the pregnancy center is; the proposed local law would still apply only because the pregnancy center holds a pro-life viewpoint,” said Maxon.

Last month, a federal judge ruled that a bill forcing Baltimore pregnancy centers to post signs stating that they don’t refer for abortions was “unenforcable” for unconstitutionally controlling the centers’ speech.

Ed Machmann, the Assistant Director for the Family Life/Respect Life Office at the Archdiocese of New York, told LifeSiteNews.com Friday afternoon that although the city council has “been hearing quite a lot from our side,” the battle was decidedly uphill. The city council is overwhelmingly controlled by the Democrat party and led by Speaker Christine Quinn, who is an open lesbian closely allied to the abortion lobby.

“It’s a tough audience,” Machmann said. “There has been some mitigation of the terms of the bill, but they’re still dead set on passing it.” Machmann said nonetheless that pro-life forces were ready to challenge the constitutionality of the initiative in court should it pass.

There are about two dozen crisis pregnancy center offices in New York, which has been dubbed the “abortion capital of the world” for its extremely high rate of abortions, with 89,000 unborn children killed there every year. There are reportedly about 45 licensed abortion clinics in the city, in addition to an estimated two dozen more that are unlicensed.

Chris Slattery, founder of Expectant Mother Care and a top pro-life advocate in New York City, will be hosting a rally against the bill Wednesday starting at Trinity Church at 12:15pm.

“Please help us fight hard to defend a mother’s right to know the unadorned truth about abortion, to give her true help and hope, and to operate as in a free country and not a police state,” Slattery wrote in the appeal for donations.

LONDON, Ontario, February 17, 2011 (LifeSiteNews.com) - One-year-old Joseph Maraachli of Windsor, Ontario, who was to have his life support removed Monday at 10 am. against his parents’ wishes, will now not die on the day that Ontario residents celebrate as Family Day.  A hustle by pro-life and anti-euthanasia groups resulted in a change in legal counsel, which has led to at least a temporary stay of removal of the child’s ventilator. 

Alex Schadenberg, head of the Euthanasia Prevention Coalition, informed LifeSiteNews Sunday evening that negotiations are underway to transfer Joseph to a hospital in Michigan. 

In a statement released today, London Health Sciences Centre said it has received a request from a Michigan hospital “to review Baby Joseph Maraachli’s medical information regarding the feasibility and appropriateness of a potential patient transfer.” 

“Our focus at this time is to work with the family on a patient care plan and to continue to provide compassionate and dignified care and comfort to Baby Joseph,” said the statement.

Tomorrow’s scheduled vigil in support of Baby Joseph and the Maraachli family is still happening at 9 am. outside Victoria Hospital at Wellington and Commissioners in London, Ontario.

Last week the Ontario Superior Court rejected an appeal by Josephs’ parents to bring him home where he can die under their care.

“Monday at 10 am. they will kill my baby,” Moe Maraachli, Joseph’s father, had told LifeSiteNews shortly after the ruling.  “There’s no more humanity.  There’s no more chance.  I’ve tried everything for him.  No more appeals, nothing.”

Joseph was taken to Victoria Hospital in London, Ontario in October where he was diagnosed with severe neurological issues. Doctors gave him no chance of recovery.  Moe and his wife Sana have asked doctors to perform a tracheotomy so that they could take Joseph home, but the doctors refused, saying the procedure was too risky.

The Maraachlis’ daughter died from similar complications eight years ago, but in that case doctors performed a tracheotomy and they were able to take her home.  Joseph’s parents want the same for him.

But in January, the Consent and Capacity Board of Ontario sided with the hospital, and a date for removing Joseph’s respirator was set.  The family was able to hold it off by filing an appeal with the Superior Court.

Superior Court Justice Helen Rady also sided with the hospital, saying that Joseph is in a permanent vegetative state with no brain stem reflex. However, Joseph’s family members have said that the boy still responds to stimuli.

In a press release earlier Sunday, Campaign Life Coalition noted that “Baby Joseph (was) to be killed on Family Day.”

“I don’t understand it.  Do doctors’ rights now trump parental rights?” asked Jim Hughes, national president of Campaign Life Coalition.  “And what about the dignity of the child to die in the loving arms of his parents at home? This outrageous stripping of parental rights is very worrisome.”

Hospital threatens to remove baby Joseph’s life support anyway - parents denied private visitations

LONDON, Ontario, February 22, 2011 (LifeSiteNews.com) - While things were looking up for the parents of Joseph Maraachli this past weekend, the picture has now become bleaker. In the latest twist in the case the London hospital where their dying son is being cared for is seeking to remove the parents’ decision-making power after they refused to have him taken off life support. Hospital security is also denying them private visitations.

Alex Schadenberg, executive director of the Euthanasia Prevention Coalition, which has been offering support to the parents, Moe Maraachli and Sana Nader, says they are now only allowed to see their son with a security guard present.

“They fight my family. ... they put security for me.  They never give me private to pray with my son,” Moe told Fox News this afternoon.

“Security watch me and security stay with me,” he added.  “When I go to hospital I feel I am not in Canada.  I feel I’m in jail or they kidnapped my baby.”

“It’s ridiculous.  It’s not like they could pick the child up and take him home.  The baby would die,” said Schadenberg.

Schadenberg said that Moe tried to bring him in to see Joseph on Monday, but security denied him access to the room, and told him to leave the premises.  “It’s become crazy.  The hospital’s going overboard and it makes no sense,” he said.

With the help of pro-life and anti-euthanasia advocates, Joseph’s parents have been trying to have their son moved to a hospital in Michigan.  London’s Victoria Hospital, where Joseph has been treated since October, sent the records to the Michigan hospital Monday and the parents are still waiting to hear back.

But hospital officials now say that they may go ahead with removing Joseph’s life support even if the Michigan hospital or another agrees to the transfer.  Because the parents refused to have Joseph’s life support removed Monday, the hospital has asked the Office of the Public Guardian to assume decision-making power.  That office is expected to take a couple days, but could order his life support removed at any point.

The hospital originally appeared set to remove his life support on Monday at 10 a.m. after a Thursday ruling by the Ontario Superior Court.

“Monday at 10 am. they will kill my baby,” Moe had told LifeSiteNews shortly after the ruling.  “There’s no more humanity.  There’s no more chance.  I’ve tried everything for him.  No more appeals, nothing.”

But that was delayed over the weekend after the parents hired expert lawyer Mark Handelman, with the financial backing of the Euthanasia Prevention Coalition.

Though Joseph has been at Victoria Hospital since October with a severe neurological disorder, his specific condition remains undiagnosed.  Nevertheless, doctors have given him no chance of recovery.  Moe and Sana have asked doctors to perform a tracheotomy so that they could take Joseph home, but the doctors refused, saying the procedure was too risky.

The hospital says nine specialists have confirmed he’s in a “persistent vegetative state,” but the family and their close supporters disagree.  Family members say Joseph is fully responsive to touch, particularly that he hates being touched by cold hands, tickles easily, and moves his head when his hair is brushed.  They also say he responds to loud noises by turning his head toward the sound.

The hospital has warned the family that they will be banned from the hospital if they try to take videos, which is preventing the family from documenting Joseph’s responses and movements, said Sam Sansalone, who had to fight with the Toronto Hospital for Sick Children for his own daughter’s life nine years ago, and is now helping Joseph’s family as a media representative.

Over 5,000 people have rallied behind the parents through the Facebook page “Save baby Joseph”.

“This would be a second tragedy for the parents,” said Schadenberg.  “Not only must they accept that their child is terminally ill, ... but their power to even decide how to care for their child is going to be removed from them - only because they love him.”

“Because of love they’re going to have their ability to make decisions for their child removed from them - in order for the hospital to take control,” he continued.  “That’s a tragedy.”

ROME, Italy, February 25, 2011 (LifeSiteNews.com) - Father Frank Pavone, who became known as the “Terri Schiavo Priest” for his role in trying to save the life of the late Florida woman in 2005, has joined the fight to save a Canadian baby from a cruel early death.

“If I have to fly from Rome to Canada to get Baby Joseph out of the hospital and back home where he belongs, I am ready to do that right now,” said Father Pavone, who has been attending meetings at the Vatican this week.

Father Pavone said Priests for Life will pay all expenses to bring Baby Joseph and his family to a hospital in the United States that would agree to perform the tracheotomy that would make it possible for him to go home.

“The parents of this precious boy are asking only to be allowed to bring Baby Joseph home, where he can die surrounded by those who love him,” said Father Pavone, national director of Priests for Life. “It’s beyond imagination that they would have to ask. This is not an issue that belongs in the court, or in the hands of his doctors. This is their son; he needs to be home with his family.

“This couple lost a child to this same disease eight years ago so they know exactly what they are dealing with, and what to expect as Baby Joseph reaches the end of his life. The small comfort they could take from Zina’s death was to know she died in peace surrounded by those whose lives she had touched in her own short life. They want the same for Baby Joseph.”

Father Pavone was with Terri Schiavo’s parents, brother and sister in her hospital room in the hours before the Florida woman died in 2005, two weeks after a court declared she could be denied food and water to bring on her death. Like the Maraachli family, the Schindlers wanted to bring Terri home.

“This same barbaric act is what the Canadian court is asking Baby Joseph’s family to endure,” Father Pavone said. “It is cruel, it is criminal and it cannot be allowed to happen again.”

Priests for Life is the largest Catholic pro-life organization in the U.S. dedicated to ending abortion and euthanasia.

Last Thursday, Ontario Superior Court Justice Helen Rady upheld the January verdict of the Consent and Capacity Board of Ontario that supported the doctors’ move to take Joseph off life support against his parents’ wishes.  Representatives for the family announced Thursday that their lawyer is working to broker a deal with his hospital.

In the last couple days, the case has drawn attention from major pro-life and anti-euthanasia groups in the U.S. who hope to find a hospital willing to take over Joseph’s care.

Bobby Schindler, brother of Terri Schiavo and executive director of the Terri Schiavo Life & Hope Network, traveled to Ontario Thursday by invitation from the family to advocate for Joseph.  He was joined by Rev. Pat Mahoney, director of the Christian Defense Coalition in Washington, D.C.

The hospital had appeared set to remove Joseph’s life support on Monday at 10 a.m., but that got delayed when the family hired expert lawyer Mark Handelman over the weekend with the financial support of the Euthanasia Prevention Coalition.

Justice Rady’s decision was based on doctors’ testimony that he is in a permanent vegetative state with no brain stem reflex.  But the family says that footage released Thursday by LifeSiteNews belies the doctors’ claim.  The videos, taken over the weekend, show him flailing and reacting to tickling.  They also show that his hands have been tied down - a measure the hospital took after Joseph removed the tube from his throat on at least two separate occasions.

Joseph suffers from a severe neurological disorder, but his specific condition remains undiagnosed.  Doctors have given him no chance of recovery, so his parents, Moe Maraachli and Sana Nader, have asked them to perform a tracheotomy which would enable him to breathe on his own, so that they could take him home.  The doctors have refused, saying the procedure is too risky.

Their daughter died from similar complications eight years ago, but in that case doctors performed a tracheotomy and they were able to take her home.

The family has been trying to have Joseph transferred to a hospital in the U.S., where they believe he’ll get better care or at least a reassessment, and possibly the tracheotomy they need to bring him home. 

The family has also expressed concerns that hospital security is following them around and denying them private visitations with Joseph.

On Tuesday, Children’s Hospital of Michigan in Detroit, where the family had hoped to have Joseph transferred, refused to take him despite previous assurances that they would.  The family says, however, that they are far from out of options.

The clock is ticking for the family, however, as Joseph’s current hospital has asked Ontario’s Office of the Public Guardian to assume decision-making power after the family refused to have Joseph’s life support removed on Monday.  The public guardian could order it removed at any point.

Alex Schadenberg, executive director of the Euthanasia Prevention Coalition, warned in a Fox news interview that the court decision facilitates a system where doctors are authorized to force life and death decisions on patients.  He has said he believes it is far worse than the “death panels” recently debated in the U.S. as part of the federal health care law.

“It’s the hospitals and the doctors once again usurping their power over the people,” he said.  “That’s what’s happening.  And they have significant power - they have the money and the courts behind them.  It’s absolutely ridiculous.”

British Doctors Told to Advise Women Abortion Safer Than Giving Birth

Doctors and nurses in Britain are being advised to tell their patients that having an abortion is safer than having the baby, The Telegraph reports.

The draft guidance from the Royal College of Obstetricians and Gynecologists is for all doctors, nurses and counselors advising women who are thinking about terminating their pregnancy.

Its first recommendation on "what women need to know" instructs health professionals: "Women should be advised that abortion is generally safer than continuing a pregnancy to term."

The guidance also says that women who are deciding whether to have an abortion must be told that most do not suffer any psychological harm. Until now, their advice has been that while rates of psychiatric illness and self-harm in women are higher among those who had an abortion, there was no evidence that termination itself was likely to trigger psychological problems.

The experience, which she says nearly killed her, led her to become outspoken about abortion, denying that any circumstance - rape or incest included - justified taking the life of an unborn child.

“People should never, ever have an abortion. Don’t talk to me about it being a woman’s right to choose what she does with her own body. The choice is between life and death,” Russell declared in one quotation widely attributed to her.

In another quotation cited by IMDB.com, Russell said that when she found herself pregnant at 18, “The only solution was to find a quack and get an abortion. I had a botched abortion and it was terrible. Afterwards my own doctor said, ‘What butcher did this to you?’ I had to be taken to hospital. I was so ill I nearly died. I’ve never known pain like it.”

Even decades after the procedure was made legal in America, loss of fertility remains a common side effect of abortions: post-abortive women telling their stories through Silent No More Awareness frequently testify to losing the ability to bear children as a consequence of their abortions.

Her struggle conceiving led Russell to adopt three children and to found the World Adoption International Fund in 1955. She also started the ‘Hollywood Christian Group,’ a weekly Bible study she hosted at her house for Christians in the film industry. Russell, who divorced once and was married two more times, is survived by her three children, six grandchildren and 10 great-grandchildren.

After confirming her death on Monday, her family suggested that donations be made in her name to Care Net Pregnancy & Resource Center at 121 W. Battles, Santa Maria, CA, as well as CASA of Santa Barbara County, a group that helps abused children find a court advocate.

Care Net, which oversees a nationwide network of 1,100 pregnancy centers, specializes in helping women facing unplanned pregnancies by providing practical help as well as emotional support.

Exclusive: ‘Her passion was for pro-life’: daughter-in-law tells Jane Russell abortion story

SANTA MARIA, California, March 2, 2011 (LifeSiteNews.com) - A “pillar of strength” - these were the words Etta Waterfield used to describe her mother-in-law, Jane Russell, who will be remembered by millions as a timeless beauty and talented actress of the silver screen.

But according to Waterfield, Jane’s true legacy lies in her deep devotion to the Bible as a born-again Christian, and her tenacity living out that faith as a pro-life advocate following a tragic botched abortion at the age of eighteen.

“Mom was to the world a movie star, but her passion was for the children. Her passion was for pro-life,” Waterfield told LifeSiteNews.com in a telephone interview Tuesday afternoon, two days after Russell passed away of respiratory failure in her Santa Maria home at the age of 89.

Russell’s story began in the San Fernando Valley of Southern California where she grew up as the eldest and only girl in a deeply Christian family of five children. The loss of a child - Jane’s older brother, who died at 18 months old - was what inspired her own mother’s zeal for reading the Bible, a hunger she passed on to her daughter.

The death of a child would also later exert a powerful effect on Jane’s life: when the eighteen-year-old star was already well on her way to a successful career in film, an illegal abortion took the life of her unborn child, and left her unable to bear children ever again.

According to Waterfield, the young Jane already “felt horrible” about the moral evil committed in the abortion, which was so badly botched she nearly died. “She knew it was wrong,” she said. “But she as a young teenager, she felt she was trapped and her career starting to take off, and it was an inconvenience, and she thought that was the best solution, knowing all along that it wasn’t.”

But it was because of the open arms of her own mother, Geraldine, that Jane was encouraged to “let the Lord figure out” how to turn the experience to good.

“Grandma Russell was by her side after she had the abortion and she said, ‘Daughter, the Lord will turn this around for good if you allow him to work in your life. There is no condemnation from Him, nor will there be any condemnation from our lips either,’” said Waterfield.

Jane carried on, she said, bearing courageously the responsibility of an abortion that wound up giving her “a heart for children,” particularly those who were difficult to place in adoptions, such as older and disabled children. Russell was to found the World Adoption International Fund (WAIF) in 1955. According to Waterfield, through Russell’s efforts adoption advocacy, she helped find a place for over 40,000 children in permanent homes who may otherwise never have found them.

And despite losing her fertility, she became “mom” and “grandma” to many: having adopted three children, she left behind six grandchildren and 10 great-grandchildren at her passing. In particular, Waterfield said, Russell was passionate about using her fame as a well-loved actress to open the word of God to others.

“She made a mistake, but she is the perfect example of what the Bible says: what Satan has meant for bad, God will turn around for good if you allow him to work in your life,” said Waterfield. “That’s Mom right there: those thousands of children - that abortion turned into a blessing.”

Waterfield, who ran for the California State Assembly as a conservative Republican candidate, said that she was largely inspired by Jane’s zeal for conservative social issues, particularly for the pro-life movement, something she laments has gotten almost no media recognition. “Media will never put that out there because it’s politically incorrect to them,” said Waterfield. “But you get her one on one, or on a stage ... and she’ll tell you different. She was never afraid of talking about it.

“There are so many people that have had abortions that are so ashamed of it, and carry that burden. It doesn’t have to be a burden.”

As Russell lay on her deathbed, Waterfield said that she rejoiced to think of the meeting that lay in store for her.

“I whispered in her ear and said, ‘Mom, now you can hold your baby for the first time. You’ll be able to see your baby,” she said, tearing up. “And you know, I just wish I could see that reunion. Because of that baby, she was able to do so much for children.

“That’s her legacy: it’s not Hollywood, it’s the children. That’s how I want the world to know her.”

Death penalty sought for ‘house of horrors’ abortionist based on victims’ youth

HARRISBURG, Pennsylvania, March 3, 2011 (LifeSiteNews.com) - Because Philadelphia abortionist Kermit Gosnell’s victims were only minutes old, state prosecutors have said they will seek the death penalty against the abortionist.

The gruesome nature of Gosnell’s abortion business, which involved routine infanticide, sent shockwaves through national media outlets earlier this year, after state investigators stumbled upon the filthy facility.

Gosnell, 70, and several of his accomplices at the inner city Women’s Medical Society clinic, were arrested in January. The abortionist was charged with the murder of one of his adult clients mid-abortion, in addition to seven newborns killed after failed abortions. According to testimony by former employees, Gosnell and his assistants killed “hundreds” of babies by severing their spinal cords rather than killing them in the womb, because the abortionist was too unskilled to administer the lethal injection in utero.

Two of the employees who assisted in abortions without any medical license are, like Gosnell, being held without bail.

Prosecutors on Wednesday filed documents enabling them to seek the death penalty, noting the age of the victims as an aggravating factor. State officials also filed for more time to decide whether they will seek a similar fate for three of Gosnell’s accomplices. Defense attorney Jack McMahon said that the death penalty “makes no sense,” according to the Philadelphia Daily News.

“He’s a 70-year-old man with no previous record,” said the attorney. “And Pennsylvania hasn’t carried out an execution in years [since 1999]. The reality is, there will be no death penalty for Mr. Gosnell, so why clog up the court system with a death-penalty case that is death penalty in name only?”

A Grand Jury report in January issued scathing indictments of both the Pennsylvania Department of Health and the Department of State for turning a blind eye to the clinic. The report said the government agencies had allowed the clinic to wallow in filth for years, and ignored several complaints lodged against the abortionist, while allowing his official record to remain clean.

Since then, several state employees have been terminated for the oversight failure, which took root in the state agencies after pro-abortion former Pennsylvania Governor Tom Ridge took over for Bob Casey in 1995.

Pro-life Gov. Tom Corbett, who took over the office in January, has expressed his anger at the handling of the affair. “This doesn’t even rise to the level of government run amok. It was government not running at all,” said Corbett. “To call this unacceptable doesn’t say enough.”

Dr. Eli Avila, who has been appointed by Corbett to head the state health department, said Wednesday that new draft regulations due at the end of this month mandate at least one unannounced inspection of all the state’s abortion clinics, and that Avila himself planned personally to visit each site.

LONDON, Ontario, February 28, 2011 (LifeSiteNews.com) - Dying one-year-old Joseph Maraachli, whose parents are entangled in a legal battle after doctors refused to perform a simple procedure that would allow him to die at home, should have had that procedure “a long time ago,” a pioneer in the field of neonatology has told LifeSiteNews.com.

But the physician’s statements come on the same day that the hospital where Joseph is being kept has said it is willing to send him home, but with an important catch: they still refuse to perform the tracheostomy that allowed a sibling of Joseph’s who had a similar condition to live another six months at home. Instead they will simply return Joseph home, and then remove his ventilator, after which he will almost certainly die within a matter of minutes.

This solution is unacceptable to the family, Alex Schadenberg of the Euthanasia Prevention Coalition told LSN this afternoon. Schadenberg has been working closely with the hospital to have their wishes respected.

“They need to do a tracheostomy,” said Dr. Paul Byrne, an Ohio neonatologist with nearly five decades of experience and a former president of the Catholic Medical Association.  “If the baby is stable otherwise, and has a tracheostomy, then the baby can be taken care of at home.”

In a “public information campaign” launched Sunday night, London Health Sciences Centre, where Joseph has been treated since October, defended their refusal to perform the tracheostomy.  They called the procedure, which involves inserting a breathing tube through a tiny slit in the throat, “invasive,” and said it is “not a palliative procedure.”

“It is frequently indicated for patients who require a long term breathing machine,” they wrote.  “This is not indicated for Baby Joseph because he has a progressive neurodegenerative disease that is fatal.”

This wording was repeated in today’s statement in which the hospital said Joseph could go home to die.

But Dr. Byrne told LifeSiteNews that “there’s no case” when a child is on a ventilator where the tracheostomy wouldn’t be indicated.

The hospital is now asking Ontario’s Office of the Public Guardian to intervene and allow them to take Joseph off his ventilator, after the parents have continued to refuse consent.  That office has been unsuccessful in asking other family members to consent instead, and could intervene itself any day.

Dr. Byrne called the attempt to have the state remove Joseph’s ventilator “terrible, absolutely terrible,” and insisted that in his fifty years in neonatology he’s never removed a child’s ventilator.  “I’ve never seen a time to turn off a ventilator,” he said.  “If a baby has a disease process that’s so bad that they’re going to die, then they die on the ventilator anyway.  So you don’t have to stop the ventilator.”

He also criticized the common phrase “life support,” saying, “Life is either there or it’s not there. You don’t have to hold up the life.  What we do in medicine are actions ... that support the vital activity of respiration.”

“Assuming doctors can do something to support the vital activities, we ought to do them,” he explained.  “And a tracheostomy ought to be done, and the baby ought to continue on the ventilator.”

Though doctors have said Joseph is in a “vegetative state,” Dr. Byrne called it a “made-up term” similar to the notion of “brain death,” which he said was invented “simply to get beating hearts for transplantation.”

Even Joseph’s doctor in London has admitted that the tracheostomy could prolong his life.  “A tracheotomy would likely provide for a longer period of life, however, in our view would not result in improvement of well-being and could reduce quality of life,” Dr. Douglas Fraser told the Ontario Consent and Capacity Board in January.

Along with their public information campaign, the hospital announced Sunday that they are considering legal action against unnamed individuals who they say have alleged that doctors might “kill” Joseph or that his death would be a case of euthanasia.

Joseph suffers from a severe neurological disorder, but his specific condition remains undiagnosed.  Doctors have given him no chance of recovery, so his parents, Moe Maraachli and Sana Nader, have asked them to perform a tracheostomy which would enable him to breathe on his own, so that they could take him home.  Their daughter died from similar complications eight years ago, but in that case doctors performed a tracheostomy and they were able to take her home.

On February 17th, Ontario Superior Court Justice Helen Rady upheld a January verdict from the Consent and Capacity Board of Ontario, which had supported the doctors’ move to take Joseph off life support against his parents’ wishes.  The hospital had appeared set to remove Joseph’s life support last Monday, but that got delayed when the family hired expert lawyer Mark Handelman with the financial support of the Euthanasia Prevention Coalition.

Justice Rady’s decision was based on doctors’ testimony that he is in a permanent vegetative state with no brain stem reflex.  But the family says that footage released Thursday by LifeSiteNews belies the doctors’ claim.  The videos, taken last weekend, show him flailing and reacting to tickling.  They also show that his hands have been tied down - a measure the hospital took after Joseph removed the tube from his throat on at least two separate occasions.

The family has been trying to have Joseph transferred to a hospital in the U.S., where they believe he’ll get better care or at least a reassessment, and possibly the tracheostomy they need to bring him home. 

In the last couple days, the case has drawn attention from major pro-life and anti-euthanasia groups in the U.S. who hope to find a hospital willing to take over Joseph’s care.  Family members of euthanasia victim Terri Schiavo travelled to London last week to advocate for Joseph and Fr. Frank Pavone, national director of the U.S.-based Priests for Life, has pledged to pay for Joseph to be moved to a hospital in the U.S.

Alex Schadenberg, executive director of the Euthanasia Prevention Coalition, warned in a Fox news interview that the court decision facilitates a system where doctors are authorized to force life and death decisions on patients.  He has said he believes it is far worse than the “death panels” recently debated in the U.S. as part of the federal health care law.

“It’s the hospitals and the doctors once again usurping their power over the people,” he said.  “That’s what’s happening.  And they have significant power - they have the money and the courts behind them.  It’s absolutely ridiculous.”

Baby Joseph’s lawyer dropped from case: prayer vigils planned

LONDON, Ontario, March 1, 2011 (LifeSiteNews.com) - The expert lawyer representing dying one-year-old Joseph Maraachli, whose hospital is seeking to remove his ventilator against his parents’ wishes, was removed from the case today.

Mark Handelman, who the family hired with the financial backing of the Euthanasia Prevention Coalition, had been negotiating with the hospital, and was successful in having the hospital delay removing the ventilator.  It is unclear at this point what effect Handelman’s removal will have on Joseph’s cause.  LifeSiteNews was unsuccessful in reaching Joseph’s parents as of press time.

At the same time, the Washington-based Christian Defense Coalition announced Tuesday that they and the Terri Schiavo Life and Hope Network are holding two prayer gatherings in London, Ontario this weekend for Joseph,

The prayer and public witness events will be on Saturday, March 5, from 12:00-2:00 p.m. and Sunday, March 6, from 1:00-3:00 p.m. in front of the London Health Sciences Centre’s Children’s Hospital.  They will be held on the corner of Wellington and Commissioners Rd.

There will also be a rally in support of Joseph’s family on Saturday from 4:00-6:00 p.m.  Location to be announced.

Rev. Patrick J. Mahoney, director of the Christian Defense Coalition, traveled to Canada last week with Bobby Schindler, brother of Terri Schiavo.  The two met and prayed with the family, pledged their support, and sought to connect them to legal assistance and to help to locate a hospital for Joseph in America.

“We are gathering for prayer and public witness as we stand in solidarity with Baby Joseph and his family,” said Rev. Mahoney.  “We will not be silent when it comes to this tragic crushing of human rights. ... We must always speak out with passion and courage when we see the dignity of human life trampled.”

“We support the family as the ones who should be making the final decision on how to best deal with this beautiful child,” he added.  “The courts and the hospital have completely disregarded the wishes of the family and are crushing their parental rights.”

March 3, 2011 (LifeSiteNews.com) - The case of baby Joseph started out fairly clear, but as time has passed many people have interpreted it as something it is not.

Joseph Maraachli was born without any problems. Then in May 2010, the Maraachli family brought Joseph to the Children’s Hospital in Detroit because he was unable to breath. After several weeks of treatment, Joseph went home with his family in good health.

In October 2010, Joseph experienced a similar problem with breathing. His parents were driving home from Toronto and stopped at the hospital in Ingersoll, Ontario. From there he was transferred to the Children’s Hospital in London, where he remains.

Who has the right to decide?

The baby Joseph case concerns the question of who has the right to decide what is in the best interests of baby Joseph.

The hospital decided to withdraw the ventilator from Joseph, which would result in death, likely occurring within a short period of time. Joseph would die while gasping for air.

The family decided that they wanted to bring Joseph home to die while in their care, in the same way that they cared for their first child who died of a similar condition more than 8 years ago. The family asked that a tracheotomy be done to allow Joseph to breath on his own, so they could bring him home.

The issue is, who has the right to decide? Does the hospital and doctor, or does the family have the right to decide on how to care for their terminally ill child?

Not about futile care

This case is different from most of the similar cases because it is not about a family requesting treatment that is futile, burdensome or extra-ordinary.

The family is not asking for a portable ventilator to be set up in their home, even though this would be a reasonable option. They are not asking for in-home nursing care to be provided. They did not ask for experimental treatment plans.

The family only asked to bring Joseph home; but to do so would require Joseph to be capable of breathing on his own. This is why they requested that a tracheotomy be done. A tracheotomy is not a difficult procedure; it is not futile, burdensome or extra-ordinary.

Not about euthanasia

Some people have suggested that to withdraw the ventilator from baby Joseph would constitute an act of euthanasia. This is not true.

Euthanasia is an action or omission that directly and intentionally causes the death of another person with the intention of relieving suffering. Euthanasia is a form of homicide.

If the ventilator is withdrawn from baby Joseph, he is likely to die, but he may survive. If he dies, his death would be caused by his medical condition and not because of a direct and intentional action or omission. Even if the intention is to cause his death, the reality is that his death is not direct because it is caused by his medical condition and therefore is not euthanasia.

The precedent set by the baby Joseph case affects everyone

If I have a massive stroke, I am not competent, I am unable to swallow effectively and I have not indicated in any way what I would want in such a circumstance and my wife would like an intervention done to allow me to be effectively fed, but the doctor says no, what will happen?

The precedents that have been set by the baby Joseph case and similar cases would force my wife to hire a high-priced lawyer to defend her right to provide reasonable care for me. She would face a well-paid lawyer who is financed by the hospital.

If the Consent and Capacity Board sided with the hospital she would be forced to appeal the decision to the Superior Court, which would cost an excessive amount of money, simply to defend her right to have basic care provided for me.

In the courts, legal precedents, like the baby Joseph case, would be used to convince the judge that the decision of the doctor and the hospital is correct.

We are all at risk, unless decisions like those made in the baby Joseph case are reversed, or unless the legislation in the Province of Ontario is not amended.

I continue to support the plight of baby Joseph and the Maraachli family and I continue to hope that the family and the hospital can achieve a mutual agreement. Maybe Joseph should be sent home and cared for on a portable ventilator?

“Priests for Life has hired a jet that is standing by now to fly Baby Joseph and his parents anywhere in the U.S. at a moment’s notice,” said Fr. Pavone in a press release today. “We need one hospital with a sophisticated neo-natal unit and the courage to actually agree to take this child. It’s becoming increasingly difficult to explain to the public why it is that not one has committed to do this yet.

“I am urgently calling on any U.S. hospitals or administrators who are willing to help to contact my team at the following email address: jghorn.pc@mac.com,” he said.

“Life is in the balance. It’s time for the American spirit to rise to this occasion and say Let’s roll!”

The American Center for Law and Justice (ACLJ), a constitutional law firm, announced yesterday it has been retained by the parents of Baby Joseph to explore options to get their son medical treatment in the United States.

“This has been a tragic case where the parents desire only to receive proper family-centered care and medical attention that will allow ‘Baby Joseph’ to live out his final days at home naturally with his family,” said Jay Sekulow, Chief Counsel of the ACLJ. “We are exploring all options with the parents and are representing their interests in the United States only.  We’re working with the parents to determine the likelihood of bringing their son to the United States to receive the medical treatment he needs and deserves.”

Prayer and public witness events in support of Baby Joseph will be on Saturday, March 5, from 12:00-2:00 p.m. and Sunday, March 6, from 1:00-3:00 p.m. in front of the London Health Sciences Centre’s Children’s Hospital.  They will be held on the corner of Wellington and Commissioners Rd.

Over 13,000 people have rallied behind the parents through the Facebook page “Save baby Joseph.”

Baby Joseph's family gets help from 'a mama grizzly'

The parents of a terminally ill Windsor, Ont., baby are being represented by a prominent U.S. lawyer who has ties to Sarah Palin.

CeCe Heil is connected to a Washington law firm, which has fought for right-wing Christian causes throughout the United States.

Heil said she hopes to find a hospital in the U.S. that will agree to care for Joseph Maraachli, who has been on life support for months at a hospital in London, Ont., due to a fatal neurological disease.

Doctors want to remove his breathing tube, and a judge has sided with them, but the family of the 13-month-old boy wants a tracheotomy performed so he can be taken home to die.

Palin supported Heil in her unsuccessful bid to represent the Republicans in the 5th Congressional District Congress in Tennessee in August 2010. The former Alaska governor and candidate for vice-president described the Nashville attorney, who has sought to become a member of Congress, as a "tough mama grizzly."

The Canadian lawyer who had been representing the family announced earlier in the week that he was no longer doing so. No explanation was offered, but there was speculation it had something to do with the decision on whether to appeal a Feb. 17 decision by a London judge that paved the way for Baby Joseph to be removed from life support.

The Maraachli family has received support from the Euthanasia Prevention Coalition, a Canadian group, and from a number of U.S. pro-life groups.

Rev. Frank Pavone, national director of Priests for Life, told the website LifeNews.com that his organization is prepared to transport Baby Joseph and his family to a U.S. hospital if the American Center for Law and Justice can find one that will take the little boy and do the tracheotomy procedure his parents want.

“Priests for Life and other pro-life and pro-family organizations have been negotiating with hospitals across the United States for more than a week to have them agree to admit Baby Joseph,” he told LifeNews.com.

Also offering his support this weekend will be Bobby Schindler, who is flying to London from Florida. His sister, Terri Schiavo, was at the centre of a much-publicized, end-of-life battle in the U.S. five years ago.

“We’ll be joining the good people of Canada, and just doing what we can to show support for this family and let them know we’re behind them, and we’ll do what we can,” Schindler told CBC News.

He said Maraachlis should be allowed “to care for their baby properly and not be forced to have to end his life this way.”

The London Health Sciences Centre has said it is willing to pay to transfer Baby Joseph home on a breathing machine. Once home, the baby would be placed in the arms of his family before the machine is withdrawn. The family has refused that offer.

(Baby) Joseph's father prays for a miracle

Moe Maraachli says he is praying for a miracle, but not only for his dying son.

He said, after a small rally in a London hotel with about two dozen people, he wants the stone removed from Baby Joseph’s doctor’s chest and “put a heart for him.”

“Maybe he be human like us.”

Maraachli, 37, wants his son’s doctor to put in a tracheotomy and send his baby home to Windsor to die. The grieving dad hasn’t changed his sad tune since his son’s condition has worsened since he was admitted to hospital.

But more people keep joining in the chorus.

There were motional and strong words in the latest chapter in the case of the baby with the irreversible neurological disease who has been in the London Health Sciences pediatric critical care unit since October.

On Saturday, in the rain, there was a vigil outside the hospital with people attending from across North America, and particularly members of the U.S.-based Christian Defense Coalition and Terri Schaivo Life and Hope Network — named after the Florida woman who was at the centre of a high profile U.S. battle over the removal of her feeding tube. The groups entered the campaign to support the family’s desire to get Joseph home within days of the court decision.

Later in the afternoon, the group rallied at the Lamplighter Inn and Patrick Mahoney of the Christian Defense Coalition vowed they will continue in their search to find another hospital willing to take Baby Joseph on, after disappointment earlier this week when a Detroit hospital decided not to have Joseph transferred there.

They plan to be back on the corner of Wellington and Commissioners roads again Sunday and encouraged the vigils to continue each weekend.

“I’m sure if we ask God for a miracle, miracles (will) happen,” Maraachli told the group. In the past weeks since a Superior Court ruling not to allow an appeal of a decision by the Consent and Capacity board, the baby with the terminal diagnosis has become a lightning rod for public opinion about life decisions.

Baby Joseph is on a breathing machine and is fed through a tube. Doctors say his neurological condition has deteriorated so much he is in a “persistent vegetative state” and is blind and deaf, with no brain stem function.

The family wants Joseph to have a tracheotomy— an incision in the child’s wind pipe — so they can take the boy home and care for him by ventilating and removing secretions, like they did when their daughter Zina suffered the same condition and died eight years ago.

Doctors, including a world-renowned expert from the Toronto Hospital for Sick Children, say the procedure isn’t an option. It’s too risky, causes a number of complications including pneumonia and wouldn’t improve Joseph’s well-being or his quality

of life.

The doctors want to remove the breathing tube in hospital and provide palliative care until the child’s death.

They have said consistently that if he did breathe on his own after the removal of the tube, he could go home.

When the doctor presented his case to the health ministry-appointed board, it was noted that there had been “many attempts” to have the baby breathe spontaneously on the ventilator, but within minutes, the ventilator reverts to a backup rate” because there hasn’t been any breathing.

At the rally, a basket was passed around the room, raising $4,000 for the family to help with their struggle. They also had t-shirts and CDs from a local performer on sale with all the money going to the family.

All of the support has been moving, Maraachli, 37, said.

The father came to Canada from Lebanon 11 years ago. “You are all my family,” he told the two dozen people at the hotel rally.

Maraachli said after the speeches that he doesn’t trust the doctors anymore and believes they are misleading other hospitals who might take Joseph on. He said they won’t let him have Joseph’s medical records and can’t understand why there is extra security in place.

“I think they mislead too much . No comment for the reason. I don’t know why,” he said.

“Joseph, he doing well. He’s not (getting) worse. He’s good,” he said. .

“I give him his bath. He’s stretching. He knows me when I come talk to him. His head is moving to me.”

The father said he believes his son can breathe on his own and “just has trouble with secretions.”

“They put him on machine They said the machine keep him alive. They’re wrong. They play God on earth,” he said.

He said his hope remains that they can take him home and “when the brain tell him to stop breathing, no more breathing, he die by God’s hand. That’s all I ask.”
