Cameron and Tyler Winklevoss say they not Mark Zuckerberg invented Facebook. And they are willing to risk $160 million for the chance to prove it.
The ambitious young Olympic rowers made famous in the Oscar-nominated "The Social Network" are taking their last shot at the gold in London in 2012 and in San Francisco, where they are contesting an out-of-court settlement they reached with Facebook three years ago. If they prevail, their legal appeal would overturn the settlement, now worth in excess of $160 million because of the soaring value of the privately held company.

Contesting a settlement you already signed is almost certain to make the judge laugh at you.
So they had reached a deal earlier and now they don’t like it so much so they want to change the rules. Sounds like a bunch of democrats to me.

Can’t remember who it was, but I agree with the commentator who said that the very fact that these d-bags got a settlement at all is an indictment of our legal system. They had no case, yet they made enough of a legal fuss that they had to be paid millions to go away, and now, they’re back at the trough wanting more. Our legal system is a giant tax on creators and innovators, allowing parasites like this to demand a chunk of every successful new idea that someone else comes up with.

Enough is enough. Wouldn’t accepting a settlement mean that they pretty much accepted the fact that Mark Z founded Facebook. If I was on the jury, I would say just that “enough is enough”. You lost. Go enjoy yourself with the 160 million.
The issue has no down side for them. Except for the filing fee, they keep what they have if they loose, notwithstanding what the article says in the opening sentence, and if they win they can ask Zuck for more.
The movie does not provide any insight into how the twins expect to prove that it was their idea. As I recall, if Zuck altered their idea even a little bit, it becomes his idea. And he did alter it quite a bit again, according to the movie version.
Zuckerberg is a thief regardless of what anyone reads to the contrary in the media.
You nailed the key point..this has no downside for them. However, just to be clear, this current lawsuit is different from the first one. This suit contends that the financial information that was provided to them which led them to agree to the terms was not accurate. IOW, Facebook at the time was worth much more than they were led to believe, and Zuckerberg knew it.
$160 million for an “idea” not trademarked or otherwise copyrighted?
Sounds more than fair to me. Especially considering these guys haven’t done any work in building the company or system.
What if their idea had peaked as a Harvard University “face book?” That was the idea.
I would go even further and say “You voided the settlement by coming back for more so you get NOTHING! Return the $160 million immediately.”
