DOJ letter:'TSA would likely be required to cancel any flight'(FEDs threaten air blockade of Texas)

The U.S. Department of Justice sent a letter to House and Texas Senate leaders Tuesday -- reportedly in person -- threatening a shut-down of airports if HB 1937 is passed.

The letter claims Rep. David Simpson's (R-Longview) anti-TSA-groping bill is against federal law and the Supremacy Clause of the U.S. Constitution. We include the text of the DOJ's letter, as well as a portion of Simpson's reply, below.

I can't encourage you too much to STUDY THE ISSUE. Everything I posted makes tremendous sense once you realize that I used to OWN MY PROPERTY from the center of the Earth to the outer reaches of the Universe!

It was mine ~ all of it. If you wanted to fly your plane into MY SPACE you could be sued for damages because you would be unlawfully SEIZING my property.

What the courts did (and Congress certainly followed with various pieces of legislation) was CUT OFF MY OWNERSHIP RIGHTS to a certain degree.

That's right the government TOOK my property, to wit: AIR SPACE, and turned it over to the MILITARY and OTHER PRIVATE PARTIES, a la Kelo a long time ago. But, the fifth amendment says they owed me something, so they invented "safety" and "convenience" and a couple of other things to the list of benefits to me for them taking my stuff.

It all starts with MY PROPERTY and MY RIGHTS.

The guy flying the plane has his own property. He gets to use MY PROPERTY provided he does various things. You get to be his passenger using HIS PLANE to use MY PROPERTY provided you do certain things.

Currently someone wants to flash a light in your a$$ as your price of admission to SOMEONE ELSE'S PLANE that's going to USE MY PROPERTY as a road.

I think it is reasonable for every manner of thing to be done to make sure that plane isn't going to drop on my house as it violates my property rights. Else, I want my property restored and then that plane owner isn't going to be allowed to fly over my property, and when that happens, he isn't going to have a seat available for you to be a passenger unless he can figure out how to traverse the nation without violating someone's airspace.

I brief, it's not your 4th amendment rights at stake, it's mine! It's also my 5th amendment right to demand just compensation for the seizure of my property without a warrant.

Well, that is interesting. I wish I had that crystal ball of yours because I just got off the phone to State Sen. Dan Patrick's office and Dan, David and staffers are all just as busy as can be restructuring HB 1937 for resubmission in order to address the supporters concerns.

You sound like the libs and the rinos here who were upset when KBH got beat.
My guess is if you actually live in Texas...you moved here from some wimp state up north. We Texans know he’s a cowboy...which is why put him in office. You got a problem with out Governor who made this the top hiring state in the country...then you can pack yer frickin’ Prius and move to California. I hear the Governors there are a real treat.

I understand your argument, and I'm not going to say it doesn't have some validity, but first of all, it ignores the extremely infinitesimally small probability of an airplane landing in your yard due to failure of the US government to 100% assure that no explosives are on board.

There are more than 10 million airline flights per year in the United States. In 10 years, that's 100 million flights.

We have 300,000,000 citizens.

During the past 10 years, how many jet airplanes have crashed into a citizen's home?

During the past 50 years, how many jet airplanes have crashed into a citizen's home due to terrorist hijacking?

During the past 50 years, how many jet airplanes have crashed into a citizen's home due to the fact that government officials failed to intimately grope the genitals of a terrorist?

The odds of your home getting smashed by an airplane because of a TSA failure are about as close to zero as you can possibly get. Do you also want the government to breathalyze every single driver on every single road before allowing us to get into our cars - many of which most likely pass along the road right in front of your house and might veer into you at any moment, or worse - might veer into YOUR car while you are peacefully driving along the highway sober?

I ask, because your odds of dying due to a failure of the Highway Safety Agency to breathalyze every citizen are HUGELY higher than your odds of death or damage from even a legitimate TSA failure.

But all of that COMPLETELY ignores the original point I made, which you seem to have missed. That point is, THE STUFF THEY ARE DOING IS IN NO WAY GUARANTEEING THAT THAT AIRPLANE *DOESN'T* CRASH ON YOUR HOUSE.

In light of that, please allow me to repeat my original point.

Neither the sexual assault of American citizens nor their irradiation using these machines are capable of stopping a determined terrorist from smuggling explosives on board. Neither can assure your security from the terrorists.

So why, then, are Americans being groped and irradiated? If that's not unreasonable search and seizure, I don't know what is.

And now I'll answer my own question. WHY? The answer is a liberal answer. It's so that you, and the other voters, will FEEEEEEEELLLLL good. It's so that you will FEEEEEEELLLL that something is being done to assure your safety, when in fact, the only thing they are assuring is the invasion of individual rights and psychological trauma of the 6-year-old kids who have some stranger stick their hands down the front of the kids' pants.

Both "security measures" are easily defeatable.

Nullification of what? Did Congress pass a law giving the TSA the right to grope people's genitals? First I've heard of that!

Article VI of the Constitution states:

This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.

The Constitution, Laws and Treaties of the Federal Government have supremacy - not the dictates of every half-witted bureaucrat!

Like most human beings I reasses the relative value of the risk of a particular event based on prior experience with similar events.

So, what are the odds of an airplane just falling out of the sky and landing on an intersection within 1/4 mile of your house and killing a driver who is on the phone with her husband discussing what he needs for their barbeque planned that evening.

One in a trillion?

Hmmmm, that happened right here!

What are the odds of a plane under the control of AlQaida terrorists flying over your house? Pretty slim, right? Well, happened here. They "turned left" in fact.

Myself ~ I've missed several flights that went down.

Stuff happens! I prefer that it be minimized.

What all the southern block should do if force every Federal Office, installation and operation out of their borders. This is nothing less than a declaration of economic war by the Federal Government against a sovereign state. If these Federal Dole locations were closed, their denizens would have to move....good deal all round.

I understand that. But even by your own accounting, the odds of an airplane crashing into your home as a result of a TSA failure are very small.

The other side of the odds is not small at all. If you want or need to get across the country quicker than you can go by car or train, there’s pretty much a 100% chance that you’re going to be groped or irradiated. If you have to travel by airplane for a living and make, say, 30 trips a year, the odds are pretty much 100% that you’re going to be groped or irradiated not just once, but 50 or 60 times a year.

That’s simply unacceptable to me, and to a lot of others - EVEN IF it increases the level of safety in our society.

But the fact is, IT’S A USELESS EXERCISE designed only to make the sheep FEEEEEELLLLLL good. It’s not going to stop a terrorist from getting his bombs on board. If you’ve kept up on the details of effectiveness of these methods, you know that. And so do the terrorists.

We know none of the gropings, et al, work unless they're performed on Moslems ~

Obviously profiling is called for, but so is a better immigration policy.

At the same time I'd rather be groped by 60 than go down in 1 plane crash.

There’s probably no prohibition on the state of Texas setting up its own ADDITIONAL security check. This could apply to every person entering the airport at any point ~ and profiling could be used.
