Obama administration calls for halt to Texas execution

WASHINGTON — The Obama administration took the unusual step Friday of asking the Supreme Court to stop Texas from executing a Mexican citizen convicted of raping and killing a 16-year-old girl.

The administration said the court should delay the planned July 7 execution of Humberto Leal for up to six months to give Congress time to consider legislation that would directly affect Leal's case.

The 38-year-old native of Monterrey wasn't told he could contact the Mexican Consulate after his arrest in the murder of Adria Sauceda. His lawyers say police violated an international treaty by not telling Leal he could have consular assistance.

I thought that the Supreme Court just finished their session and would not be back in session until October. Seems the execution will happen before then.

they’ll even ship him.

US post... but will have to keep the per package weight down in order to avoid incurring any exorbitant fees

Thanks. If I didn’t remember this case..and frankly had to look it up. It isn’t clear from a brief read if Bush was required to file stay or if it was done for political reasons. If it was some legal “treaty” mumbo-jumbo...then Perry might have to follow suit.

It does look like Medellin was ultimately executed.

I’m of the opinion that real legal issue is compliance with the treaty.

Does the treaty REQUIRE the defendant to be notified that he has the right to contact the consulate? If not, then there is no reason to stop the execution

Even if there is the requirement - Was he notified by anyone prior to his trial that he has the right to contact the consulate? Including his defense team?

Did someone else, acting on his behalf, contact the consulate? Perhaps a relative?

If he did contact the consulate, or if someone contacted the consulate on his behalf, there is no reason to stop the execution

Was he afforded the opportunity to contact the consulate and then refused? This would require a proof positive in that it is a bit of a negative. In other words, there would need to be a document that showed he chose not to contact the consulate.

I see this as a blatant campaign stunt by Obama to paint Governor Perry as a “killer” in anticipation of him throwing his hat into the ring. and I also see it backfiring in Bam’s face bigtime.

Bingo!! I do not see Rick Perry as a true conservative. He is part of the establishment. Didnt Perry support that Trans Highway linking from Mexico thru US thru Canada? Also if one notice the media is not attacking Perry like Palin, so that tells me alot. I agree Obama have been told by the establishment to hand it over to Perry. They think we haven’t figured it out.

Perry giving zero and the SC the finger over this sews up both his legal (born here) and illegal Latino vote, since the victim was not a 16yo white cheerleader.

Much as I despise Rove, he was correct in that if you have 40+% of the hispanic vote, you’re in. Even ACORN can’t cheat its way around that.

My God I’ve become cynical.
