MIDWAY Midway police have shut down a lemonade stand run by three girls, saying the stand lacked a business license and required permits.
The girls had been operating for one day when Midways police chief and another officer cruised by. They had been trying to earn enough money to go to a water park.
The girls needed a business license, peddlers permit and food permit to operate, even on residential property. The permits cost $50 a day or $180 per year.
Midway Police Chief Kelly Morningstar says police didnt know how the lemonade was made, who made it or what was in it.
One girl, 14-year-old Casity Dixon, says the three had to listen to police and shut down.
The girls are now doing chores and yard work to make money.

Everyone move to Midway where all crime is non-existent. Cops have only kids’ lemonade stands to bust to keep busy.

She should have sent in a SWAT team to taste the lemonade.
Ironically, this exact example was used at my police academy under the topic “Spirit of the Law vs. Letter of the Law.”
In a time where common sense trumped everything else, it was reinforced to us in no uncertain terms attempting to enforce laws like this on children selling lemonade would make us a law enforcement pariah, and would earn a cuffing about the neck and shoulders from the sergeant.
On a somewhat related note, I was the the local district court the other day and noticed that of the 100 infractions on the docket, nearly 70% were for speeding 5mph over (above 40mph) which means the cops are now writing willy-nilly for 5mph over on the freeway.
I’m ashamed of my former profession...Or at least of what it’s become. :(
They better have union cards. Actually, they are getting a very good education on doing business in the USA in 2011. They need to consider moving their stand to China

Since the Police Chieftess wants to enforce the law, maybe the kids can help.
This is from last fall in New York, in another report it stated that the kids brought attention to the firemen’s
cook-off.

This time, volunteer firefighters had to douse plans for their almost-annual chili cook-off fundraiser when a health inspector discovered that more than 30 home kitchens would be used to prepare the chili.
Just last month in Westchester County, a town councilman called the cops on two 13-year-old boys who were selling cupcakes, cookies, brownies and Rice Krispie treats in a park. They didn’t have a permit.
The firefighters were disappointed but understanding about having their chili feast canned.
Daniel Goswick, a chief at the Piermont Volunteer Fire Department, said Thursday that the fundraiser had been held off-and-on for eight years without any problems.
“Nobody got sick or anything,” he said. “But the guy from the county is just doing his job. I can’t bad-mouth him. It’s unfortunate, and we’re disappointed.”
The firefighters’ own advertising got them into trouble. Rockland County Health Commissioner Joan Facelle said her department learned of the cook-off when an inspector saw a notice for it.
“Once we saw a potential risk to the public, we had to pursue how they were going to implement it,” she said. “We learned they were going to prepare the chili in various homes and bring it to a central location, and a permit can’t be issued for that.”
They key problem, she said, was that the chili would be offered to the public. Health Inspector John Stoughton said there’s an exemption for covered-dish church suppers and the like, because they’re prepared for “a limited distinct group” and any outbreak of sickness could be more easily traced. The regulation is a statewide one, he said.”
I’d like some of the Policemen, officers, whatever they call themselves in this forum explain this to me. You guys certainly can’t do PR for shit.

The fire fighters should have turned this around by

public only to the firefighters who would then each
eat a bowl of chili for every five dollars donated.
