Coming soon: Rubio ‘birthers’
The Daily Caller ^ | August 24, 2011 | Matt Lewis

Despite my hopes, Sen. Marco Rubio will not run for president in 2012. But that doesn’t mean he won’t soon be within a heartbeat of the presidency. As the New Yorker’s Ryan Lizza asked on Twitter: “Is it time to rename GOP primaries ‘the contest to become Marco Rubio’s running mate’?”

Indeed, despite his protestations, Rubio has to be on the short list of potential GOP running mates.

But the downside is that there is already a movement afoot (led by some on the fringe) to disqualify him from serving as president (which would presumably disqualify him from serving as vice president). That’s right — some are arguing that Rubio is not eligible because he is not a “natural born citizen.”

Here’s how the logic works (according to World Net Daily’s Joe Kovacs): “While the Constitution does not define ‘natural-born citizen,’ there is strong evidence that the Founding Fathers understood it to mean someone born of two American citizens.”

Kovacs (and he is not alone) goes on to reason that Rubio’s “eligibility is in doubt” because — though his parents were legal U.S. residents when he was born — they were not yet naturalized citizens.

’ there is strong evidence that the Founding Fathers understood it to mean someone born of two American citizens.”

I thought Obama’s father was a non-citizen?

Thank you kind Sir for that brief synopsis. I’m keeping for future arguments.

Also Marco Rubio, a true gentleman, kept Former First Lady Nancy Reagen from falling yesterday. I’m keeping this man him high on my list of future leaders. Ronnie would be proud Nancy!

Interesting thread.

I believe that Marco Rubio meets the constitutional requirements that describe a 'natural born citizen' and is legally qualified to be Vice President of the United States. I base that statement primarily on the information offered in post #14. If that information is in error, I'm sure others will submit explanations as to why. However, I expect this issue won't be seized on by the left because it brings Barack Hussein Obama's very questionable claims to U.S. citizenship and his qualifications to be president into the spotlight, and the DNC doesn't want that.

Not quite. Obama has a better claim than Rubio. Obama had one citizen parent and one legal resident parent.

Better claim to what? You're either a U.S. citizen or you're not. Vitter notwithstanding, the 21st century interpretation of natural born citizen, as evidenced by Barack Obama, is pretty straightforward. Were you born in America?

Rubio was a U.S. citizen at the moment of his birth. Parents notwithstanding, he as an individual is no different legally than Barack Obama.

(I realize this is nothing but inflammatory, but I'm making this point for a reason. The Democrats will burst into flames if they try to attack Rubio on this. The wheels will fall off their support in Hispanic communities, and it's a monster of the Democrat's own making. The rules should naturally be more legally clarified than this, but until they are, we may as well play the game to our advantage while we can.)

Oh, I agree with you.

For those who think parentage matters, however, Obama has a much better claim than Rubio.

I could go without all these machinations. He’s eligible for every office in the land but two. Those are the breaks. We can pick a different VP. There’s plenty to choose from.

The mythical third type of citizenship, “Natural Born Citizen”, does not exist.

Sure it does. It's a person who has citizenship at birth. It's one of the two categories.

Well, if Romney gets the GOP nod, I dunno if the NBC thing will be brought up. After all, his father is a Mexican.

Do both parents have to be US Citizens to make the child NBC?

No, he’s eligible to be VP. Screw this crap. Rubio should be the VP candidate next year for the GOP.

Rubio’s parents weren’t born in the U.S. OK. And Obama’s old man wasn’t born in the U.S. So let the libs try and make something of this. If this POC Obama can be President, then Rubio can be President (or Vice-President). I’m sick of the double standard.

Interesting.

Still, I doubt that Rubio will be the VP..

The polling and trends from Florida are all going Republican. Obama is polling very poorly down here. I think it's more likely that Santorum or maybe Kasich will be the VP choice for 2012. If the Republican ticket can pick up Pennsylvania, that would be a big gain. Ohio is also less Republican today than Florida.

If he’s smart, Rubio will let the “birthers” stew for a few months and very publicly prove his eligibility.

I would love to see him prove it in multiple small, very public disclosures; each time, asking the media to ask the same of Obama.

If you think that it means the individual has to have two US citizen parents born in the US (which it does not), Obama’s father was indisputably born elsewhere and was certainly not a US citizen, so by that standard, Bambi wouldn’t have qualified.

However, this information was known and there was no objection to his running. The only objection to either Obama or McCain was based on the place of birth, Panama outside of a military base in the case of McCain, and somewhat shadowy in the case of Obama.

Hence, based on precedent, Rubio certainly qualifies. Anyone who is trying to say otherwise is probably doing so simply because they are scared to death that Rubio will run - and win.

I think his main drawback to the general voting population is that he’s young, and of course he himself has just said that he doesn’t want to run for any other office but wants to serve out his term in the House. But I’ve heard him speak...and if he ran, he’d win. So the Dems are scared of him.

I like Rubio, but is he a natural born citizen

Not that it matters. People here seem to love him more than they love the Constitution.

Both Rubio and Obama are NBCs, period, end of story.

Why would the Framers have put that specific term in the Constitution? They set out eligibility requirements for Senator, Representatives and POTUS. Only the last has that phrase inserted in those qualifications.

Because they didn't want naturalized citizens to be President.

However, this information was known and there was no objection to his running.

There were lots of objections, especially on this forum, most of them historically and constitutionally invalid, IMO.

But it's just not accurate to say nobody objected.
