If they waive the confidentiality, do they have to give the money back??

The monies are paid with the understanding of a confidentiality agreement. I suspect the lawyer is just trying to get his 15 minutes of fame by even discussing this.

I have signed many of these types of documents when contracting with someone to design something they want to retain the rights to. Each is different in many way but where they are all alike is the penalties for divulging the details of the item.

I have no restrictions on speaking in generalities and in a case as Cain’s the confidentiality is typically directed to the specifics of the settlement, names of the parties involved and any other details that attorneys can agree to and submit to their clients.

This douche-bag attorney saying that the chin height comment was not a part of his clients complaint and then say because Cain mentioned it was cause that Cain broke the NDA is beyond stupid.
