Nor was Obama’s father permanently domiciled in the United States like WKA’s parents were. The Treaty with China stated that those Chinese persons who chose to become permanently domiciled had changed their allegiance. So while they were not citizens, they were considered nationals. Gray could have used that for his justification of WKA’s citizenship, but he didn’t WHY? Because he used it to muddy the waters and protect the POTUS who nominated him to the SCOTUS bench. WKA is not only bad law, it was written by a man with material reason to want to protect Chester Arthur, a man JUST as ineligible for POTUS as Barack Obama is.
