[WI] Judge rules voter ID law unconstitutional [makes temp injunction permanent]

Madison - A Dane County judge permanently enjoined the state's new voter ID law on Monday - the second judge in a week to block the requirement that voters show photo identification at the polls.

"A government that undermines the very foundation of its existence - the people's inherent, pre-constitutional right to vote - imperils its legitimacy as a government by the people, for the people, and especially of the people," said the eight-page opinion by Dane County Judge Richard Niess. "It sows the seeds for its own demise as a democratic institution. This is precisely what 2011 Wisconsin Act 23 does with its photo ID mandates."

Niess' ruling goes further than the one issued by another judge last week because it permanently halts the law. Tuesday's order by Dane County Judge David Flanagan blocked the law for the April 3 presidential primary and local elections, but not beyond that.

The latest order may make it harder for the state to put the voter ID law into effect before the April 3 election because it would have to win two appeals in less than four weeks. Attorney General J.B. Van Hollen has asked for a stay of the earlier order, and he is expected to appeal it this week.

Kevin Kennedy, director of the state Government Accountability Board, said his election agency is telling local clerks to keep training to implement the law so they're prepared to do so if it's suddenly restored.

"We'll just live with what is there," Kennedy said.

Whether Wisconsin's photo ID law will stand is widely considered to be decided by a higher court - a point the judge in the case made from the bench during a hearing Friday. There are four lawsuits pending against it - two in Dane County court and two...

Yes, the Supreme Court has upheld voter ID laws. I don’t understand how this garbage with activist judges continues and no one restrains them. Why aren’t they impeached for crying out loud?

And this is what is happening while the media is focused on flukes birth control issues — obama and company are continuing to undermine this country day by day.

I have no problem with a thousand dollar reward for turning illegal aliens in.

This could easily be avoided by self-repatriation.

I am not a big fan of the government being so heavily invested in us having I.D. available upon demand.

The prevalence of more and more “Eastern Block” style situations within our borders causes me to wonder how we ever got along without this. There was a time when none of ths was necessary, and it seems the more we have this, the more they seem to think we need to increase it.

It seems to me we need to stop and think bout this long and hard.

Agreed. Add asset seizure beyond a fixed deadline for self-repatriation.

Before I go on, I should make it clear I'm not trying to be argumentative here.  You didn't give me any reason to have to state that, but I do want you to know.

hink you’ll have to convince me that it would be any more difficult than voting as an alien. In either case, you give a name which may or may not be yours, an address at which you may or may not reside, and present documents that may or may not be real or (in jurisdictions that allow it) have some registered voter whose registration may or may not be legal vouch for you.

Let's address the situaiton as if a state does not require a photo I. D.  That way we can aleviate the problem with documents or verification.  If you think we need to address that too, just respond with that opinion and we will.

For years I was rather concerned about people claiming to be someone else, from some other address, and voting in their stead.  Then I thought how would I go about doing that.  I'm not sure it would be that easy.

You have to know someone who is registered who will not be voting.  You need to know where they lived.  You need to know where their precinct polling station is.  I don't know one person that I could game to use their personal information to vote like this.

Explain to me the process that you see someone following to carry out this type of voting, once or even multiple times.


It helps if it’s part of a large, organized effort to flood polls with more same-day registrants than workers can process with due attention.


Well, there's your problem IMO.  I don't believe in voting prior to the main day.  I don't believe in a person being able to register the same day.

Anyone wishing to vote should go through the same process everyone else did, and that process should cut off registration long enough prior to voting day, so that the person is fully registered and their voting pamplet can be deliverd a couple weeks before the election.

The Left makes a big deal out of being magnanimous so that more people can vote, but the real goal is to corrupt the election process.  We should refuse to allow it.

You are correct.

Nevertheless, “Pre-Constitution voting rights” (during Articles of Confederation time) were given only to white Protestant males, and in only 4 or 5 states to free black males, Catholic males and Jewish males.

Are these the rights that the judge wishes to emmulate?

Couple of points. Texas was halted just in the last few days not by a judge, but by the Dept of Justice interfering.

Second - there was a Supreme court ruling that is only a few years old (like circa 2008/9?) that explicitly states that Picture ID requirements ARE Constitutional. I don’t understand why a lower court isn’t bound by this? It is - but the judge is ignoring it!

Yes I think that’s a reasoned additional incentive.

Allow six months beyond some point in time for foreign nationals to liquidate, beyond which they would forfeit assets.

These so called “judges” are criminals. They are aiding and abetting their ‘RAT massas to make sure that voter fraud can continue. It’s time to start putting some of these “judges” in jail.

Republicans should start to take notice of the fitness of the judiciary. If a judge rules something Constitutional or un-Constitutional, and is later corrected by the final court of competent jurisdiction, that original, offending judge should be brought up for removal based upon incompetence. It’s clearly in the best interest of the citizenry that those who judge the the law should at least be able to understand its proper application.

Yes, an appeal to a higher court will probably overturn the ruling. Until then, the injunction stands.

So will they have to show their voter registration card? In Texas you have to have SS# and DL # to obtain one. This should suffice for an ID. But even in Texas( to my experience) they still ask to see your DL along with voter registration card. I really do not seen what the big fuss is about. States need to know if you are a citizen or not before you are allowed to vote,and if you are voting in multiple counties which happens down here. If you are an illegal or do not have a voter ID card you should not be able to vote....period.

And it shouldn’t IMO. This judge seems to be playing a losing long game, so he can hand the Dems a win in the short term.

The Left is reaching a desperation point as it relates to November.

If Obama wasn’t half-Black, they’d have dumped his ass months ago.
