Maryland Court Rules Pit Bull Dogs Are "Inherently Dangerous"

A new ruling makes it easier for anyone attacked by a pit bull or pit bull mix in Maryland to take legal action against the dog's owner. The Maryland Court of Appeals ruling declares pit bulls as a breed are "inherently dangerous," and the owner of a pit bull or a cross-bred pit that attacks is strictly liable for damages, as is any landlord who rents to a pit bull owner.

The Maryland SPCA, which arranges adoptions for dogs that need homes, currently has three pit bulls under its care: a five-month-old Brutus is scheduled to be adopted this week, Ayoki is available and Valentina will be put up for adoption soon. But the SPCA is concerned that it may be harder to find adoptive homes and families may abandon pit bulls after the recent ruling.

"We believe that an animal's behavior should be the determining factor in whether or not the animal is considered dangerous," said Cheryl Bernard Smith, of SPCA. "We don't believe that a particular breed should be pinpointed for that." "All dogs, if you don't train them and show them love, can turn out to be mean animals," said Rodney Taylor, of Prince George's County Animal Management. "It has a lot to do with the owner and how you raise the pet."

The Maryland Court of Appeals decision dealt with the case of a young boy who suffered life-threatening injuries when he was attacked by a pit bull.

I know that have never bred dogs, or you would know that breeding for temperament is just as important as breeding for type.

I also know that you seem to have the class of a dog.

You are correct. Individual dog breeds are bred for specific traits, and some (most?) Pitts are/were bred to fight. Look at the type of people that have them (for the most part, only generalizing here!) and you can see why they are they way they are.

I am a breeder (GSDs) and certain bloodlines have certain traits, and if you select for specific traits, and if you know what you are doing, you will get what you want.

Bottom line: it is the fault of the breeders, and people that fought them, that developed the breed as it is now, not the dog's fault. The dangerous aspect of them can be bred out of them, but it would take 3-5 generations of CAREFUL breeding to see some progress, and you will never get it all out of the breed. (Example: hip dysplasia in GSDs runs about 18% and has done so for about 20 years. It will most likely never get lower, due to a few individual dogs that were used to develop the breed. Some traits that were heavily selected for early in the development of the breed will never entirely go away...)

I don't like any sort of anti-dog legislation: it is mostly ignorant, and another example of judges/lawyers thinking they know more than anyone else, and that they can "fix things" better than anyone else, regardless of qualifications and knowledge.

All dogs are inherently dangerous.
If you examine their mouths you'll find hard pointy calcified structures capable of causing damage to soft tissue.

Why are victims of dogs other than "pit bulls" not afforded the same protection under the law?

Pit bull owners can do what they want.

But they should keep in mind that there are many people like me.

If your pit attacks me, I’m coming back and shooting your dog and beating you with a baseball bat.

If your pit attacks one of my kids, I’m shooting your dog and shooting you.

I recall another recent story about a ‘vigilante’ shooting several pit bulls, but this dirtbag must get his kicks poisoning any dog.

There have been liberals forever.

My pit stays on my property. If you are on my property without my permission you better forget the pit because I'll be the one you need to fear.

God just made him that way but I still have to control him on a leash and keep him fenced in the yard so a car doesn't run over him.

I'm on the road quite a bit and it is so upsetting to see a dog wandering by itself along the road or crossing it.
I can't imagine being so thoughtless with my dog.
If I can I track down the owner and let them know their dog is in danger.

Maintaining control of your dog is one of the pillars of responsible dog ownership.

It doesn't mean your dog can never be off leash
but it must be in a context that is safe for him and for other people.

How much?

How much breeding was required to "breed in" the fighting instinct? And fighting what/whom? Dogs? Humans? Is 90 years enough to breed it out?

And please provide your educational/professional qualifications, because frankly you sound like any other internet expert/blowhard.
