According to a new witness, the 17-year-old overpowered George Zimmerman for at least part of their struggle and pinned him to the ground in moments before the killing.
"Where I first walked out there, the black guy was on top and the only reason I can tell that was because the guy that was on the ground under him at that point wrestling was definitely a lighter color," the witness said in an interview with Florida prosecutors.
Zimmerman, who is awaiting trial on a charge of second-degree, was found to have suffered injuries to his nose and the back of his head by medics who examined after the shooting in February.
The wounds are consistent with the 28-year-old's claim that Martin threw him down and repeatedly bashed his head against the pavement as they fought on a residential estate in Sanford, Florida. Martin was also found to have a slight injury to his hand, as if he had struck something...

And now we know why the feds are fishing to file ‘hate crime’ charges, because they’d already seen these pictures, and knew that under Florida law, the shooting was justified. The tactic will be to throw out all the injuries suffered, as that was a result of the ‘hate crime.’

Zimmerman has admitted to killing Martin, claiming it was in self-defense. There is such a thing as justified killing, and at least some people don’t assume it was murder if you use the relatively neutral term “killer.” “Killer,” of course, has negative connotations, and to be on the safe side news reports usually fall back on the safety of phrases like “alleged killer” and “purported killer.”

What will be the elements of the crime, in that case? I realize that state and federal laws diverge, but they still recognize self-defense on the federal level, don’t they? In order to remove Zimmerman’s justifiable homicide claim they’d have to prove his mindset was that of a racist out for blood. Which means they’d have to prove he “profiled” Martin, and that therefore the perfectly legal following and confronting were part of a subtle plot to provoke Martin into giving him an excuse for murder.
No, not only that. They have to prove that the profiling was irrational and based not on readily apparent facts but on Zimmerman’s racism. I don’t think there’s any way to prove it, really, unless he ran a White(/s of assorted Hispanic/Jewish/Black Descent) Power! blog, or something. But I don’t understand thought crime law in general, so don’t ask me.
Do you have a manner of proving what you were thinking? I don't. I don't know anyone who can provide something like that. The government certainly has no known ability to prove what someone was thinking.
The government will claim one thing, the defense another, and a jury gets to exercise their vast mind reading powers and send a man to jail. 'Hate crimes' and any other 'thought crime' needs to be wiped from the books.
The government's case in a nutshell: It was Martin's race that was the determinator for the interaction, based upon Zimmerman's prejudice against minorities. He would be asked on the stand if he would have acted the same if it was a white woman jogging in the neighborhood, or a white man walking a dog, he'll say no, but, and the government will end the questioning there. They'll submit the record of calls to 911 from Zimmerman (none) for these other confrontations.
I think that if the feds do file (civil rights) hate crime charges against Zimmerman, that Zimmerman's going to jail if it gets before a jury. Zimmerman's only hope for avoiding it is having a long record of calls to police for a variety of incidents involving all races. Because the Florida case is dead in the water at this point.

Well, if the experts are sure that the voice screaming for help belongs to the man on top, then he must have been suffering pretty badly. Maybe from that bruised knuckle?
