U.S. Attorney Carmen Ortiz said her office is weighing an appeal against a Tewksbury motel owner who criticized her for prosecutorial bullying last week after he won his battle in the feds’ three-year bid to seize his business, citing drug busts on the property.
“This case was strictly a law-enforcement effort to crack down on what was seen as a pattern of using the motel to further the commission of drug crimes for nearly three decades,” Ortiz said in a statement. “We are weighing our options with respect to appeal.”
Russ Caswell, owner of Motel Caswell, told the Herald he thought the case was “bullying by the government” and felt vindicated when a judge sided with him after his court victory last week.

This Ortiz character is also the person who took over the prosecution of Aaron Swartz, the hacktivist guy who killed himself and set off the “Anonymous” hack of the DOJ yesterday.
Apparently, the state of Massachusetts was going to let the guy off with a stern warning. Before they could, Ms. Ortiz stepped in and decided to prosecute Swartz and “make an example” of him.
This fed sure seems like she’s let the power go to her head.
Sadly as a defense attorney I can say that the system only has the appearance of fairness. In reality the Feds can squash pretty much anyone at any time for any reason.
This country is under such a vast covering of laws and regulation that all the government has to do is pick out the target then it can decide which laws were “broken”.
This is true from the top of the federal government right down to the local level.
If you don’t believe me just go sit and watch an intersection in town for a few hours. See how many people actually come to a legally complete stop before going right on red or passing a stop sign.
The percentage of those that do will be well below 10%.
But watch which ones the COPS pull over.
It really comes down to the quality of the people responsible for enforcing the laws. If they are good and honorable then we don’t have to fear bad laws. If they are evil, then no law will protect you from their corruption.
The law is set up to make us all criminals if the government chooses.
‘Weighing their options’....statists can’t take a loss in fair (or unfair) fight.
I wish I hadn’t read that...the part about her considering a run for Governor makes me ill.
Unfortunately I agree with you.
They can get anyone they like any time they want.
They have unlimited resources and enough laws to find you in violation of at least one of them.
You can fight city hall, but your chances of winning are slim.If they don’t get you now thay can lay dormant fo a while and get you later.
In an incredible coincidence, it's owners of late model Toyotas, VWs, BMWs, Lexuses (Lexi?), etc. In another incredible coincidence, they all appear to have the ability and willingness to pay rather than muck up the courts contesting their tickets, due to commitments to jobs, family and volunteerism.
The jalopies and white vans containing the indigent or the Mexican or both are given a wide berth.

Yes, it is. From what I’ve read..what he did by posting documents was NOT illegal. More government overreach. And this particular one is way overboard.

Ortiz isn’t a person. She’s symbolic of an attitude. It’s one that pervades liberalism.
We need to return to the term “Peace Officer”. Law Enforcement just takes all the brains out of the equation.
