Ortiz to motel owner: We’re not done yet
Boston Herald ^ | January 27, 2013 | Eric Smith

U.S. Attorney Carmen Ortiz said her office is weighing an appeal against a Tewksbury motel owner who criticized her for prosecutorial bullying last week after he won his battle in the feds’ three-year bid to seize his business, citing drug busts on the property.

“This case was strictly a law-enforcement effort to crack down on what was seen as a pattern of using the motel to further the commission of drug crimes for nearly three decades,” Ortiz said in a statement. “We are weighing our options with respect to appeal.”

Russ Caswell, owner of Motel Caswell, told the Herald he thought the case was “bullying by the government” and felt vindicated when a judge sided with him after his court victory last week.

How is the average person supposed to fight the legal resources of the federal government? It is akin to an octogenarian getting into the ring with the Incredible Hulk, hoping that the referee will be fair and call it before he's mashed into jelly.

This Ortiz character is also the person who took over the prosecution of Aaron Swartz, the hacktivist guy who killed himself and set off the “Anonymous” hack of the DOJ yesterday.

Apparently, the state of Massachusetts was going to let the guy off with a stern warning. Before they could, Ms. Ortiz stepped in and decided to prosecute Swartz and “make an example” of him.

This fed sure seems like she’s let the power go to her head.

Sadly as a defense attorney I can say that the system only has the appearance of fairness. In reality the Feds can squash pretty much anyone at any time for any reason.
This country is under such a vast covering of laws and regulation that all the government has to do is pick out the target then it can decide which laws were “broken”.
This is true from the top of the federal government right down to the local level.
If you don’t believe me just go sit and watch an intersection in town for a few hours. See how many people actually come to a legally complete stop before going right on red or passing a stop sign.
The percentage of those that do will be well below 10%.
But watch which ones the COPS pull over.
It really comes down to the quality of the people responsible for enforcing the laws. If they are good and honorable then we don’t have to fear bad laws. If they are evil, then no law will protect you from their corruption.
The law is set up to make us all criminals if the government chooses.

‘Weighing their options’....statists can’t take a loss in fair (or unfair) fight.

Unfortunately I agree with you.

They can get anyone they like any time they want.

They have unlimited resources and enough laws to find you in violation of at least one of them.

You can fight city hall, but your chances of winning are slim.If they don’t get you now thay can lay dormant fo a while and get you later.

And given the amount of people the "progressive" education system and popular culture has molded over the past fifty years, it is no surprise that there seems to be more and more people in positions of authority who are not morally fit for them and lack a respect for the founding principles that built this country. Reaping what we sow and all that.

It is good to know that there are defense attorneys like you out there fighting for the average guy, though. Plus, there do seem to be more and more conservatively minded groups forming to combat government overreach, like that organization that helped the Sackett family out when the EPA was suing them for bazillions of dollars for trying to build a house. If I ever won Powerball or something I'd bankroll 'em.

But watch which ones the COPS pull over.

In an incredible coincidence, it's owners of late model Toyotas, VWs, BMWs, Lexuses (Lexi?), etc. In another incredible coincidence, they all appear to have the ability and willingness to pay rather than muck up the courts contesting their tickets, due to commitments to jobs, family and volunteerism.

The jalopies and white vans containing the indigent or the Mexican or both are given a wide berth.

I particularly enjoyed reading the part about her being a restaurant hostess until she was hired by the U. S. Justice Criminal Division.

You just can’t make up qualifications like that.

Yes, it is. From what I’ve read..what he did by posting documents was NOT illegal. More government overreach. And this particular one is way overboard.

Perhaps Mr. Caswell visited that restaurant all those years ago and didn't leave a tip?

The Obama Admin is over-populated with AwP, from the top down.

AwP = A-hole(s) with Power

Thus begins the process of making an example of the little guy in order to terrorize the larger community, as the federal government walks the path to absolute power.

But Caswell’s legal team found there was actually more drug activity at surrounding addresses and suspected the government was going after Caswell, who has no criminal record, because his mortgage-free property is worth more than $1 million.

In the good old days, they would have just killed him.

Ranch-coveting officials settle for killing owner Five police agencies staged bogus drug raid on rich eccentric to acquire 200-acre spread

To Los Angeles County officials, the fact that Don Scott got killed in his own house during a futile raid to seize a non-existent 4,000-plant marijuana farm is just one of the unfortunate facts of life in the narcotics enforcement business. It doesn't mean that sheriff's deputies did anything wrong.

"Sometimes people get warned and we don't find anything," Gary Spencer, the lead deputy on the raid and the one who shot Scott, told an L.A. Times reporter in 1997, "so I don't consider it botched. I wouldn't call it botched because that would say that it was a mistake to have gone there in the first place, and I don't believe that."

Ortiz isn’t a person. She’s symbolic of an attitude. It’s one that pervades liberalism.

We need to return to the term “Peace Officer”. Law Enforcement just takes all the brains out of the equation.
