Kansas Secretary of State to Eric Holder: Stay Out of Kansas – You Don’t Understand the Constitution

Kansas signed the Second Amendment Protection Act (SB 102) into law last month.
The bill protects gun owners from from new federal gun control laws and would actually make it illegal to enforce those laws within the state of Kansas.

Eric Holder threatened Kansas last week calling the new state law unconstitutional.

In response Kansas Secretary of State Kris Kobach, fired back.
The general gist of the message was, “You’re wrong. You don’t understand the Constitution. Bring it on.”

Kobach insisted the State of Kansas was determined to restore the Constitution to protect the right of its citizens to keep and bear arms.
So far, Holder has not responded.

I think that will be a bridge too far for any court.

Read Wickard v. Filburn. The Supremes really did go that far.

Yeah, I forgot he went even further.

If it hadn’t been about marijuana, I think it would’ve been a bigger deal around here.

I read an analysis recently that said his opinion on Obamacare started to walk back some of his crazy interstate commerce thinking.

The feds will claim the steel for the barrel came from Pittsburg, PA.

Actually, I expect that. They will argue that the steel, the wood, the polymers, the springs, or some other components come from interstate commerce or that their components or raw materials come from interstate commerce. This could, depending on how broadly the Supremes choose to rule, either overturn Wickard v. Filburn or turn the Commerce Clause into a license to regulate everything.

HB872 now in the House in Texas awaiting committee approval before it goes to the full House for a vote.

I think it was replaced by H.B. 1076. HB 1076 has passed the House (with no amendments!) and has been passed to the Senate.

This is where it may need some help from us.

The Fuller Brush Company had a factory (at one time) in the time I was born.

Should be a lot of cheap land out that way with lots of conservative folks to be employed in it.

Might be a place for other companies to open businesses.

Galena, Kansas - at one time - was known for its lead mines. Of course, that is on the Southeastern end of Kansas.

Dodge City is Western Kansas with lots of wide open spaces.

Or does he think that since he is O-bozo's Attorney General he can do whatever he wants?

The ICC can be (and has been) expanded to regulate practically any commercial activity.

Government health-care will be expanded to regulate practically all personal activity. Everything from the chair you sit in to who you are allowed to have sex with.

Total control of everything is the goal and it will come so incrementally that nobody alive will even remember true freedom. I hope the system collapses before then...

I think it was replaced by H.B. 1076

FWIW, One does not replace the other. They are two separate bills. HB1076 says any new Fed laws unenforceable in Texas. This bill has passed the House and is waiting for Senate vote. HB872 says guns/ammo/accessories (including suppressors) made in Texas and stay in Texas not subject to any Fed regulation. This bill has not been voted out of committee.

Bummer on the open carry. I’m a fan of both open and concealed. I prefer open when I’m out of the city limits, but concealed inside city limits. I’m not as familiar with TX laws, is open carry of handguns completely banned, or banned in certain areas/times?

Everyone needs to know where their line is drawn.

Some lines are a lot better than others, in addition.

They have used a similar excuse to what you mentioned by stating a business was using utilities which may be supplying power or fuel from other states.

Unfortunately we no longer have a single person with the backbone of the Founders to challenge such stupidity coming from an affirmative action lottery winner.

Eventually they we state that the air that was consumed by the workers in the Kansas factory came from another state.

The interstate commerce clause needs to be removed by force if necessary and replaced with something limited to the very few rights assigned to the Federal government.

No open carry unless you are hunting in the woods, or have a license to shoot alligators and I don't know that we have a law about alligators.

Hunting rifles are different as you can carry a rifle - need a Texas hunter to tell us about that.

However, if you are a member of the New Black Panthers you can wear a black ski mask and have a shotgun and stand in front of the Texas Republican State Convention building. Here's the story:

Back several years ago, my husband, who was the Republican County Chairman in a Texas county, and I went to the state convention in Houston at the convention center.

He couldn't walk long distances, so we always had an electric wheel chair for him. Clinton was president and my husband had a cap on that read, “Jail To The Chief”. We were coming back from lunch and went through a park concrete path to get there. Before we got to the street to cross to go inside the center, I went ahead of him so I could go the ladies room and would meet him at our seats.

So, I have crossed the street and am in the center. He is rolling along in his wheelchair about to get to the street. Then, he isn't moving anymore as about 10 New Black Panthers surrounded him. Each is wearing a black ski mask and all have shotguns. My husband was a fearless fighter against Democrats and all evil people. He started chewing them out in a loud voice for being there with guns. Now, he's in a wheelchair but it didn't matter to him.

About this time I realized something was happening because officials locked the doors to the outside. If I had known he was stuck in the middle of the Panthers, I would have used a chair and broken out that window and gotten to him and killed every Panther there with my bare hands.

There were Houston police officers standing in front of the convention center and watching this happen right in front of them across that street. We were told later that the mayor said not to bother the panthers.

Bill couldn't get through the Panthers and kept yelling at them. A reporter showed up and took pictures. THEN, APPEARED ONE TEXAS RANGER. He wasn't a big guy, but he crossed the street into the middle of the Panthers and told them to move away from the man in the wheelchair and to leave there. They didn't mess with the Texas Ranger. They left. My husband crossed the street and entered the building.

That night, we were in a Texas official's party room and the news came on and there was Bill on the TV, yelling at the Panthers from his wheelchair with his cap, “Jail To The Chief” showing prominently.

That story is still told among Texas Republicans.
