The Tucson City Council is expected to enact two local firearms ordinances, in violation of State firearms preemption laws, at their meeting on Wednesday, May 29.
The first ordinance will create a $100 fine if a person does not report the loss or theft of their firearm within 48 hours from the time it was stolen or the owner “should have known” it was stolen. Why go after the person who stole a firearm when they can punish the owner instead?
The second ordinance is an attempt to locally enact a bill (HB 2631) that failed at the state legislature. If a police officer believes a person, with criminal negligence (undefined), discharged a firearm within city limits, they may request a blood or breath test for alcohol levels. If you refuse, they may obtain a warrant and require you undergo a blood alcohol test. If you own a firearm you must an alcohol abuser, right?

The Tucson City Council meeting is scheduled to start at 5:30 PM on Wednesday, May 29 and will be held at 255 W. Alameda, in downtown Tucson.
These never-ending attempts of elected officials to ignore state law and impose their own fears and prejudices on those they were elected to serve are reprehensible. What a shame that they attempt to be master, rather than public servants.

If he holds true to form, our state AG will let the city council know before they meet that their proposed action is illegal and they will face prosecution if they carry out their proposal.
That’s what he did with the city of Bisbee and their civil union ordinance from 2 months ago.

They also passed the ordinance Bisbee got called out for. Mr. Horne has some cleaning up to do in Old Tucson. Somebody shouldn’t have to be falsely charged and fined for something first. If I have a gun stolen, I’m on the hook for a hundred bucks? WTF?
Oddly enough, these two ordinances might survive, because they were written with craftiness in mind. This does not in any way mean that they were written in good faith.
The first one, the stolen gun fine, is probably based on the idea of a “known gun” being used in a crime, then its owner claiming that their gun was “lost or stolen” some time in the past. They use it as a plot device a lot on crime dramas on TV.
The second ordinance is the “holiday” ordinance of dumbasses, usually drunken, firing their guns into the air. In Phoenix, they bought an expensive audio system to triangulate where the dumbasses are doing this, but unless the dumbass continues to fire long enough for the police to get there and witness it, forget giving them a huge fine.
The rationale in Tucson is that at least they can be busted for public intoxication.

So, you are gone on a three day weekend or a week’s vacation and come home to find your place ransacked and your guns gone. YOU ARE AT FAULT?
