Lincoln's "actions were unconstitutional and he knew it," writes Napolitano, for "the rights of the states to secede from the Union . . . [are] clearly implicit in the Constitution, since it was the states that ratified the Constitution . . ." Lincoln's view "was a far departure from the approach of Thomas Jefferson, who recognized states' rights above those of the Union." Judge Napolitano also reminds his readers that the issue of using force to keep a state in the union was in fact debated -- and rejected -- at the Constitutional Convention as part of the "Virginia Plan."

Jailing politicians and some of the other things were definitely unconstitutional

but were they necessary?

Not really. Unfortunately, the public school systems have not educated the students on the truth so a discussion now is needed to do that. Everyone comes out of public school thinking Abe was Honest Abe, a poor man that grew up in a little log cabin and only wanted to free black people. Very few people know history and what actually transpired during that period on both sides of the States.

A Dixiecrat was a States Rights small government man, the states come first, not the Federal government.

"We stand for the segregation of the races and the racial integrity of each race...We oppose the elimination of segregation, the repeal of miscegenation statutes...We oppose and condemn the action of the Democratic Convention in sponsoring a civil rights program calling for the elimination of segregation, social equality by Federal fiat, regulation of private employment practices, voting, and local law enforcement..."

Those were from the Dixiecrat Platform in 1948. Very small government unless you're on the receiving end.

Not just the US but just the southern States. The North was a pure as the wind driven snow.

I will go further that that.

Black teachers were getting in front of black students in substantial numbers. They were becoming proper roll models, standing up in front of the class wearing “Class A” clothes, making a good salary based on having a good education and going to work being productive every day.

Couldn’t have that. Something had to change.

So they bussed the students, as the students needed the message that they couldn’t get a proper education with a black teacher. They needed a white teacher so they wouldn’t get the message that education and work was the ticket to a better life.

There were the same fraction of “A” black students after busing as before. The B,C,D black student fractions collapsed. They essentially gave up.

See, it is harder to fool the “A” students.

That would be the Dixiecrats’ Strom Thurmond who ran for Pres. the one with a mixed race daughter that he fathered on a underage daughter of a family servant?

That kind of racial integrity?

Me, acting in a ‘Devils Advocate’ sort of way,

isn’t ‘US’ still bickering about the Civil War (War Between the States), which ended 150 (give or take) years ago and which no one involved is alive though a lot have ancestors that were, WHAT is the difference in the Blacks still discussing Slavery or thinking they(or WE) were directly involved in it?

Both subjects deserve to be discussed and parsed BUT not in the essence that ANYONE is owed anything.

I grew up in New York, and busing was a big deal in the North. My parents were both teachers, and of course everyone knew that busing happened. We sat on the buses!

Likewise and busing sure beat walking the 8 miles to school.

Not true. A significant fraction of Democrats continued to support the US against the insurrection.

Lincoln moderated his policies to make sure it stayed that way. Part of that was selecting Democrat generals whose local popularity helped bring along their constituency.

The descendants of slaves still talk about slavery for the same reason that the descendants of Confederates still talk about the loss of the Civil War. They feel like their clans have been scarred.

It takes time for folks to pick themselves up and to carry on. Some are faster than others.
