How smart is Ted Cruz?

Smarts don’t always equate to common sense. In the case of Sen. Ted Cruz (R-Tex.), there is an inverse relationship between the two. I’m told by smart lawyers that he has a sharp legal mind, can think on his feet and has remarkable recall for facts, cases and even page numbers of the briefs. But his political judgment has become distorted by ambition.

Interestingly, he no longer is touting the line that Republicans unwilling to join the suicide squad ”own” Obamacare. Perhaps someone told him that among the obnoxious and untrue things he has said, this ranks at the top and will put him crosswise with a majority of those GOP senatorial candidates running in 2014.

A Cruz presidential run into 2016 would be interesting, if not downright amusing. An early rebuke in his young career might be a beneficial dose of cold water — or devastating to a pol who, even among senators, is excessively convinced of his own exceptionalism.

Cruz is not the guy to build the party or a governing majority (which requires moderate Republicans). But he is just the person to build up Ted Cruz. In fact, he is masterful.

Every U.S. citizen is also a U.S. National but not all U.S. Nationals are U.S. Citizens (folks born in unincorporated territories like American Samoa).
Senator Cruz qualifies as a U.S. National AND a Citizen of the United States at Birth under Title 8 of the U.S. Code Section 1401 point G.

The following shall be nationals and citizens of the United States at birth:
(g) “a person born outside the geographical limits of the United States and its outlying possessions of parents one of whom is an alien, and the other a citizen of the United States who, prior to the birth of such person, was physically present in the United States or its outlying possessions for a period or periods totaling not less than five years, at least two of which were after attaining the age of fourteen years: Provided, That any periods of honorable service in the Armed Forces of the United States, or periods of employment with the United States Government or with an international organization as that term is defined in section 288 of title 22 by such citizen parent, or any periods during which such citizen parent is physically present abroad as the dependent unmarried son or daughter and a member of the household of a person;”

The only remaining question (which should have been taken up by the Supreme Court for Obama) is to have a definitive, once and for all answer on whether there is any difference between a Citizen of the United States at Birth under the 14th Amendment and a Natural Born Citizen under Article 2.

Yes, and the constitution is like the girl who dated all your friends, after Obama has had his way. Showing any respect for it would be unmanly.

It’s our turn to give a poke and brag about it. That’s what I say. The first Law we make, as president, should be to outlaw Democrats. Put them in jail and kick the stuffing out of them. We just tell them the constituents told us to do it. Or maybe we say it’s part of Of Obamacare.

You won't need much jail space. Just sign them up for Obamacare and they won't live long enough to be jailed. Obamacare will also kill enough young people to solve any long-term Medicare funding issues.

In the end, things always seem to work out for the best.

The title of section 301 is “Nationals and Citizens at Birth”.

Section 301, like other sections, grants citizenship.

§§ 302 - 307 grants citizenship to persons in a particular US Territory within date constraints. In some instances citizenship is granted at birth, in other instances citizenship is granted as of a particular date.

§ 301(a)(2) grants citizenship to a person born in the United States to a member of an Indian... tribe

§ 301(a)(7) grants citizenship to a persons born outside the US and outlying possession, subject to various constraints

These Sections are under the heading of Chapter 1, "Nationality at Birth and by Collective Naturalization". The Sections specify various classes of persons to be collectively naturalized. Citizenship is granted by law at the time specified by law.

As distinguished from collective naturalization, an individual may be naturalized by applying for and completing a process. Various Sections of Chapter 2 specify who is qualified to apply for and what process must be completed by an individual for that individual to be naturalized. N.B. the individual is naturalized as an individual, not as a member of a group.

We just audit the bastards until they commit suicide. Since it’s legal now, why not? Maybe we audit MSM big shots first. Then splash their tax returns on the Internet. The IRS can just plead the fifth for eight years. Works for me.

And of course is "Title 8 of the U.S. Code Section 1401 point G." constitutional? That's all I'm axin', Germanicus. WTF is the problem up there at the SCOTUS? If they say it's OK, I could go for this Cruz fellow myself!

Let's move on this before the Mombasa MF and his faithful RINO-dogs appoint Raúl Castro or Gorbachev to the court, OK?

If you want to prove that someone born in a foreign country to a foreign father and US citizen mother, rather than sneering at people who make rational comments and sound arguments, you’d do better to cite some legal sources that are sound and rational to back up your claim.

Of course you can’t. But saying “idiot” in caps is not a rational or adult way to debate.

I suppose you think the freak in the WH is a NBC too, then?

Nothing he is saying is rational or well thought out. Everything he is espousing is stupid and not worthy of anything but derision. Therefor that is what he gets. He has been demonstrated as a blithering idiot, so he needs to be put in his place.

IMHO they are bringing all this up so that if the Rs pick Cruz as the candidate, they can jump out and claim that because he’s not born on US soil, he’s not a NBC. And since Zero has a fake birth cert. fakely claiming he was born in the US, he’s “okay”.

In fact I am so certain of this I could bet on it.

As for being a Natural Born Citizen, He is either BORN a Citizen, which he was, OR he became a citizen through an overt legal act, which never occurred.

There are ONLY 2 forms of citizens in this country, Birthright, Natural Born, citizens by virtue of their birth and Naturalized Citizens. That is all. If you didn't BECOME a citizen through a Naturalization Process, than ergo you are a Natural Born Citizen. You can be born ANYWHERE in the World to a U.S Citizen and be a Natural Born Citizen. Happens all the time. People have children while on vacation, or in the diplomatic services, as members of the U. S. Armed forces serving abroad or while working abroad for an oil company. I suppose all these children are NOT Natural Born Citizens either

He is a citizen by virtue of his birth, not through a naturalization procedure. That makes him a Natural Born Citizen.
