Open carry -- Illegally detained

A video of illustrating your 2nd Amendment rights in Arlington Tx.

The message here is that you can and will be detained if you open carry in Texas.

A well regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms shall not be infringed.

Looks sort of infringed to me.

Is said to have occurred on 20 Nov 2013

The Police handcuffed the open carriers but did not arrest them or search them. They did however run the plates of their cars. The Police asked for I.D., the handcuffed men refused to give them I.D. They were released.

It is interesting that everybody kept their cool and that helped things go smoothly. However being handcuffed but not disarmed is kind of an interesting thread the needle approach by the Police.

However as I have said many times, the power of The State has eclipsed the power of the individual as expressed in the Bill of Rights. Our only approach to weakening State is to Defund it where we can politically. Education is another option. This confrontation came AFTER a concealed carry rally at the same location which was not harassed. So many interesting things about this contact with Law Enforcement in Tx.

I can’t read the article. Are they openly carrying long guns or handguns?

Try opening it in a new browser tab, or window. That worked for me. They were long guns, open handgun carry is illegal in Texas. According to this cop, long gun carry in Texas is perfectly legal, but officially discouraged.

Perfectly legal but officially discouraged. That means officialdom wants to outlaw the practice but doesn’t have the votes to do it, so they will harass you against the public will.

Being handcuffed prevents you from leaving voluntarily, and that constitutes arrest.

Too much talking by victims. Police waiting for them to say something incriminating.

Right, but try facing the power of The State handcuffed and not getting nervous. Some people chatter when nervous.

The cop basically says it is common courtesy for him to handcuff people carrying rifles lol.

Handcuffing them sounds like prior restraint, a violation of civil rights.

Article I, Section 23 of the Texas State Constitution:
RIGHT TO KEEP AND BEAR ARMS "Every citizen shall have the right to keep and bear arms in the lawful defense of himself or the State; but the Legislature shall have power, by law, to regulate the wearing of arms, with a view to prevent crime."

Article I, Section 29
PROVISIONS OF BILL OF RIGHTS EXCEPTED FROM POWERS OF GOVERNMENT; TO FOREVER REMAIN INVIOLATE. "To guard against transgressions of the high powers herein delegated, we declare that everything in this "Bill of Rights" is excepted out of the general powers of government, and shall forever remain inviolate, and all laws contrary thereto, or to the following provisions, shall be void.

In ancient Rome, it was illegal to shackle a citizen for any reason.

Of course being a citizen no longer means anything in the U.S.

Every state needs constitutional carry: if you’re legally entitled to own a gun, you can carry whatever you’d like wherever you’d like however you’d like.

another such incident of open carry happened in central Texas where a retired solider was openly carrying an assault rifle. He too was arrested, took it to court and was assessed a $1500 fine.

Texas isn’t an open carry state, should be, but it’s not. Can’t fault the cops for enforcing the law.

Q: Can I carry a firearm on my person?

A: Yes, with proper licensing (Concealed Handgun License) you may carry a pistol or revolver on your person so long as it remains concealed. Long guns (rifles / shotguns) do not have to be concealed, but must be carried in a manner not calculated to cause alarm, and do not require a license.

Q: Can I strap a gun on my hip in Texas?

A: No, with some exceptions. Open carry is not legal in Texas, but you may open carry on your own property, in the commission of a sporting activity (competition, shooting ranges, etc.), and while engaged in hunting.

As I see it, this Texas “Open Carry” law hangs on this ambiguous clause: “must be carried in a manner not calculated to cause alarm”

Now, what in the Hell does that mean?

If the people of Texas don’t like this “Open Carry” law, they should petition their elected representatives to change it, and if their elected representatives refuse to change the law, the people of Texas should vote them out of office.

But, until this law is changed, the people of Texas violate this law at their own peril, as it should be in a State where the “Rule of Law” prevails.

I agree with you.

Unfortunately, at this time, we do not have open carry in Texas. IOW—it’s against the law, and you can be arrested for it.

"Officials" lack the legitimate authority to discourage legal behavior. When they do so, the become usurpers and tyrants.

That last part would be more accurately stated "so they will violate your human, constitutional, civil rights under color of the law. That's a felony, by the way.
