Auto dealer owner shoots teen who tries to steal car, deputies say

Detectives say Jonas Charles ambushed teens who returned to lot after stealing keys....

Instead of waiting for authorities to arrive, Charles took the law into his own hands and ignored the 15-year-old's plea not to shoot him, detectives said.

Charles then chased the wounded teen, yelling at him and firing another shot while on the phone with a BSO dispatcher, detectives said.

A lawyer knows that the Texas statutes clearly state the words “crime, theft, and others that demonstrate the unlawful taking of one’s property or violation of felonious infractions.

You are certainly NOT from Texas.

Up until recently horse thievery was a capital offense in Montana. But I never saw anybody prosecuted for it, much less hanged.

Our inalienable rights are to life liberty and PROPERTY....TJ enlarged it to a more encompassing and jingle worthy “pursuit of happiness”.

We were quickly approaching anarchy because of the erosion of self defense over time. Thankfully, that tide has been turned.

Likewise, property rights and defense thereof needs to be addressed. Otherwise our property becomes a 24/7 yard sale with every price zero for a fast moving perp.

Our society continues to spiral into barbarity and anarchy at the behest of the big brother government.

The question to debate should be “what SHOULD a man be able do” in defense of property to avoid societal anarchy and protect the rights of the real victim....not what is he/she currently permitted to do.

We all know the answer.

In Texas property cannot be reprocessed on private property unless (1) the property owner gives you (written) permission to do so or (2) you get a writ of sequestration to repossess and it must be done with an officer of the law present.

In my early days I worked at a loan company and was well aware of the laws.

It varies by state, but if the kid was not trying to escape after being caught, I’m pretty sure that the shooter is going to prison for quite some time.

Al Sharpton and Jesse Jackson will be all over this. Oops; maybe not, the shooter is black.

Depends on where one lives. When I was in blue state Maryland, I could. There, deadly force in defense of property is legal.

I now live in Virginia, a state with much better gun laws. However, deadly force cannot be used here to defend property.

I suppose this permission happens when the borrower enters into the original loan contract. Seems fair to me. Repo situations are not the same as theft situations, to me. But then Ive had lots of occasions of people owing me money back in the day.

Why not? It is property & I have a right to defend MY property!!!

IF someone comes onto MY property to take ANYTHING I will defend it-—and myself.

I don’t care if it is a vehicle—a bale of hay—a toolbox—whatever- IT IS MINE. Not something that I should simply give up to a thief.

You are correct about the contract to secure property for a loan and the repossession thereof if in default.

However, here in Texas you cannot physically remove property under lien (on the lien holder’s private property) without a writ of sequestration and law enforcement present.

The loan contract only states that the customer agrees to repossession if it gets in default and does not grant the loan company the right to enter “at will” to take possession of it.

The contract only gives the loan company the RIGHT to repossess......if done through the legal process.

There’s a reason that this case makes me uncomfortable. First, these were cars in a lot, covered by insurance, I’m sure. It was nothing like a carjacking, where peoples’ lives or safety is threatened.
Second, I have been in a fair number of situations, housesitting, for example, where I have been using other peoples’ cars. It’s a little farfetched, but what if a well-meaning neighbor or somebody misunderstood and shot me?
Sometimes people use less than perfect judgement when they have to make split second decisions. But this guy actually had about 24 hours to prepare for this scenario. As soon as the keys disappeared, he had a pretty good idea that something like this would be happening soon. Others on the thread have suggested ways he could have stopped them without hurting or killing them.

Seriously if you have a gun, keep it locked up, and stop living in some fantasy world where this is actually praised as a “service”.

You are on the phone with the cops chasing a 15 year old that is wounded, and you shoot him in the back? You seriously think that’s some real hero stuff?

Car thief or not, this guy had poor skills and turned his defensive firearm into an offensive one at the wrong time.
