Depends on the circumstances. If I am approached in my car by a person who pulls a gun on me, demanding my car and I have my weapon with me, he is fair game because he is endangering my life.

It’s amazing how many people on FR have gone bonkers when a cop shoots a dog they thought were a threat to them. We scream that the cop needed to show some restraint and not exaggerate the danger to him as an excuse for being trigger-happy. But somehow this situation totally called for gunning down some punk teenager that was running away from this used car lot in the name of defending property....that again the guy was running away from!

Right, car thefts down but murder up? Not a trade off I’d consider accteptable, and I’m a licensed CCW holder.

This was a bad shoot and anyone with half a functioning brain knows that.

If you really believe that, and you aren’t just quibbling over the letter of the law, then you are part of the problem.

Thieves deserve to be shot in much greater numbers than they are now. We’d have much less “thieving” going on.

Thanks for your post. I recently completed my CCW training and have a CCW permit in my state. Part of the training and maintaining my CCW is knowing what the law is, and when a shoot is good or bad.

According to the training I had, this was a bad shoot. The second someone turns their back and runs, you cannot shoot. It doesn’t matter if it’s a car theft, or if I’m defending my family in my home. Once the perp runs and try’s fleeing the site, I have to let him go.

To do anything else turns me into the aggressor and liable for the results. That’s true in almost every state.

Those who’ve belittled my factual comments or posted comments indicating the car thief somehow should’ve been shot again or killed are complete idiots and I hope they don’t own weapons. They seem awfully anxious to kill someone.

You can’t shoot someone for stealing a car

In Texas you can shoot someone for stealing a VCR if you don't think there is any other way to recover your property.

Logically, this doesn't follow. The initiating action is by the thief. His act of "turning around" or running does not necessarily mean an end to the confrontation. Especially if they are making off with your property.

Yes, I understand how the law works. This does not mean I have to agree with it.

Yes, I understand some pusillanimous types would rather we didn't shoot thieves and think we're "blood thirsty" for thinking thieves need to be shot. Your opinion is noted.

In this particular case, the theft was under Florida law, and “burglary” means:

“1. Entering a dwelling, a structure, or a conveyance with the intent to commit an offense therein, unless the premises are at the time open to the public or the defendant is licensed or invited to enter . . .”

Here “conveyance” is defined under Florida Law as “any motor vehicle, ship, vessel, railroad car, trailer, aircraft, or sleeping car”

If the thieves entered one of the cars they intended to steal, that would qualify as burglary under the applicable statute; the old common law definition that restricted “burglary” to a dwelling is long gone. In any case the possession of the stolen car keys would qualify as theft at nighttime, which also justifies deadly force in TX law. The TX law would have protected the shooter, if TX had jurisdiction (Johnny’s point).

In the actual event, Florida law on deadly force applies:

I suspect the shooter is in big trouble. The fact that he shot a criminal doesn’t mother me much. The fact that he did so unlawfully worries me a lot more because law-abiding gun owners are already under threat, and even the most understandable gun crimes increase that threat.

Some might say: He was insured, so why worry? If the insurance eventually replaces his cost for the stolen cars, that won’t help him to support himself and his family in the weeks or months that he is waiting for the payment, for new inventory, and to finally sell those cars. These young criminals were putting the business owner’s livelihood at extreme risk. I can’t work up any sympathy at all for the thieves.

No, you clearly don’t understand how the law works.

The second a perp flees the situation, the conflict is legally over. If you pursue the perp and shoot/shoot and kill them, you are the aggressor in the eyes of the law.

If I shoot someone breaking INTO my house, that’s a good shoot. If that perp sees I have a gun and jumps out the window and I shoot him in my front yard, I’m the aggressor and liable for his death.

You think I should be able to shoot him in my front yard and get away with it.

The law calls that manslaughter at best, murder at worst.

You want to be a murderer, you suffer the consequences since you’re apparently hot to shoot someone. You better hope I’m not on your jury when you do.
