Supreme Court rules on 'straw purchaser' gun law

A divided Supreme Court sided with gun control groups and the Obama administration Monday, ruling that the federal ban on "straw" purchases of guns can be enforced even if the ultimate buyer is legally allowed to own a gun.

The justices ruled 5-4 that the law applied to a Virginia man who bought a gun with the intention of transferring it to a relative in Pennsylvania who was not prohibited from owning firearms.

Thanks for the heads up. Since I’ve never bought a firearm as a gift I never read those instructions before. You are correct. The defendant in this case just needed to say he bought the firearm as a gift.

What he did shouldn’t be illegal, but to your point ...

He took money from a relative to buy a gun for said relative. He “lied” on the ATF form 4473 when he declared himself as the actual buyer. He was not the actual buyer.

I’m thinking that those ONE BILLION! GUNS in our possession (coupled with the willingness to use them) might also be helpful in retaining our Creator-endowed rights.

Regardless of how the Supremes might rule.

The defendant in this case just needed to say he bought the firearm as a gift.

Which would have worked, except for that whole check with the dollar amount and what it was for thingy they found in the evidence chain. Had it been in cash, or had the check not had the memo line foolishly stating what it was for, no issue.

I don’t think this has anything to do with gifting a firearm to a relative. This guy bought a Glock for his uncle using a police discount he was eligible for. So it seems that this guy lied on his 4473 in order to save his uncle a few bucks. And the uncle giving him a check for $400 3 days before he purchased the handgun didn’t help much either.

A "straw purchase" is usually connoted as a purchase for resale, not for a gift

And that is what happen. The uncle actually paid in advance by check "Glock 19 handgun" written in the memo line

The straw purchasers mistake was getting a check and a written description of the gun he wanted from the ultimate buyer. And, the writing was laying around when his place was searched. It did not matter that the ultimate purchaser was legally able to own it.

He should have bought it for himself with his own money, then, if he decided he did not like it, resell it legally to the ultimate purchaser.

This was not purchased as a gift. The ultimate buyer handed the guy convicted a check in advance of the purchase with a written description of what he wanted. That is NOT a gift.

Kalgan is announcing her ignorance in this opinion. You are correct that there is no legal federal gun registration. She does appear to be condoning a de facto registration though.
Kennedy is horrible on almost ALL criminal procedure cases, so this (in my view) was more about “law and order” to him than it was gun control.
We really need the WH in 2016 and to replace at least one of those 5 with a good Constitutional pro life libertarian.

My guess is that you bought the Mossberg for yourself - so you could enjoy teaching your son how to shoot your Mossberg 500. [By the way, nice choice; FAR better than a S&W 500 for a kid!]

The communists controlled SC is a perfect example of how far in the toilet America has gone. America is finished and thanks to the communists empire that has control. Only solution is to wipe the entire Federal system off the map and start over. As far as the SC there should be term limits and should include both the Senate and the House.
