If they didn’t have any right to it, then they would have to prove their case in a court of law. They may have gotten physical possession, but if there is no warrant, they cannot show that they should have it legally. If they weren’t supposed to have it legally, there’s “no evidence” ... :-) ...

Right - one of those small digital ones - but then, I’ve read if you secretly record a converstion then it’s wire tapping .... I have a recording camera in my car with a microphone - it runs when I drive ....

Put a sticker on your drivers side window indicating that all conversations with the driver are being recorded. Building owners do this all the time to prevent “wire tapping” from cameras on premesis.

Police beat up and sometimes kill people for resisting unlawful arrests all the time and get away with it.

Depends upon the laws of the state in which you reside. Here it’s perfectly legal to record a conversation so long as one party to that conversation is aware. In other words, it’s only illegal if an individual or entity that was not a party to the conversation recorded it without disclosing that fact.

I have a Fujifilm AX350 with a 64GB memory chip. I can record up to four hours if need be. I just run it in shooting mode and erase the chip at the end of the day.
