It will be the latter. After the ADA we managers were given backdoor instructions to find ANY reason NOT to hire disabled, since upper management knew we would never get rid of them.
They hired a few token disabled but generally the ADA was the biggest anti-disabled piece of... legislation ever.

If this becomes law it won't matter. Your whole work force is now gay. Don't believe me? Try to terminate some one and you will discover that they are gay. They've just been in the closet until now but you've forced their hand.
