Victory in Palmer v. D.C. (DC handgun ban struckdown)

Justice never sleeps…. not even on a Saturday afternoon, when this opinion was just handed down.

In light of Heller, McDonald, and their progeny, there is no longer any basis on which this Court can conclude that the District of Columbia’s total ban on the public carrying of ready-to-use handguns outside the home is constitutional under any level of scrutiny. Therefore, the Court finds that the District of Columbia’s complete ban on the carrying of handguns in public is unconstitutional. Accordingly, the Court grants Plaintiffs’ motion for summary judgment and enjoins Defendants from enforcing the home limitations of D.C. Code § 7-2502.02(a)(4) and enforcing D.C. Code § 22-4504(a) unless and until such time as the District of Columbia adopts a licensing mechanism consistent with constitutional standards enabling people to exercise their Second Amendment right to bear arms.4 Furthermore, this injunction prohibits the District from completely banning the carrying of handguns in public for self-defense by otherwise qualified non-residents based solely on the fact that they are not residents of the District.

Great news. Hopefully a similar suit will result in MA being forced to end their “local authority”where the local chief decides if you get a permit to carry in public or a permit to hunt/go to the range only.

i.e Springfield residents are usually given a permit to only carry in you house or unloaded and locked to the range, while one town over they issue a “all lawful purpose” permit that let’s you carry where legal. The person with the ALP permit can carry in any city or town they want, even one next door where residents are denied that right simply because the chief dosen’t want citizens carrying firearms.

I wonder if this will void the conviction of that poor guy who had an empty shot shell in his car, or the guy going to the VA(?) who had a pistol locked in his trunk.

I feel the same way....never have been to DC and never plan to go. If they change their gun laws perhaps.....

That’s a good article. Mr. Heller is right in noting that it’s likely to be a decision that lasts for hours perhaps days until a stay is requested and most likely issued by the District court or appeals court. We can only hope that the courts go ahead and bust the DC governments chops while the case is appealed.

Can this be used as a basis for establishing reciprocity with other states’ CCW? I.e. would my Texas CCW be good in D.C.?

I have never been to DC.

The Smithsonian museum is worth the trip. Our nation's early years are well-remembered there, and a good study of those years reveals heroic happenings ... especially those surrounding Benedict Arnold.

Regarding Arnold, he is among the best battle commanders America ever had, but Arnold wasn't popular with congressional leaders and said "politicians" screwed Arnold over financiallly ... big time.

Recommended reading: the classics ... "Arundel" and "Rabble in Arms" ... by Kenneth Roberts.

Another impressive Arnold record can be found at West Point, where his action at Lexington is remembered. It was Arnold - disobeying orders - who led the charge at Lexington that resulted in Arnold's capturing a British Army
