State Backs Down, Won’t Euthanize Baby Whose Father Shook Her So Hard He Put Her in a Coma

After the governor of the state of Maine stepped up to the plate to go to bat for a little girl whose life was in peril, bureaucratic officials have backed off an attempt to end the life of a baby victimized by her own father.

Last week, Gov. Paul LePage vowed to protect a little baby whose life is at stake and who state officials wanted to kill by putting a DNR order in place without her parents’ consent.

Alliance Defending Freedom attorneys filed a friend-of-the-court brief with the Maine Supreme Judicial Court in support of a mother pleading with the state for her child’s life after the father allegedly shook her and caused significant injury. The Maine Department of Health and Human Services is fighting the mother in court because she wants to give the baby a fighting chance to live while the state wants to hasten her death by withdrawing critical life support.

LePage vowed to defy the state Supreme Court if necessary to protect the little girl, named Aleah Peaslee.

Now, Alliance Defending Freedom Senior Counsel Steven Aden tells LifeNews that the Maine Department of Health and Human Services has decided to no longer withdraw critical life support from a brain-injured baby and allow a mother to make medical decisions on her daughter’s behalf.

He said: “Everyone deserves a fighting chance to live. We are pleased the health department is affirming the mother’s parental rights and the right to save her daughter’s life. This decision also reaffirms Mainers’ interest in life and the integrity of the medical profession. The state should dismiss its appeal with the Maine Supreme Judicial Court to avoid setting a dangerous precedent which risks violating parental rights.”

The father, who has been indicted on charged of aggravated assault, originally told authorities he had dropped the six-month-old girl while the mother, Virginia Trask, wasn’t home but later admitted to shaking the baby. Because doctors told the parents at one point that the child, who went into a coma, could die within minutes, they agreed to a “do not resuscitate” order.

Hospital staff placed the child in the mother’s arms to die, but the child continued to breathe on her own and opened her eyes. After days went by in this fashion, the parents cancelled the DNR order, and the child later came out of the coma and became alert. Despite this, medical personnel wanted to reinstate the DNR order because they said the baby’s condition was still grave, but the parents would not agree.

The Maine Department of Health and Human Services then sought and obtained authority from a state judge to implement the DNR order, contrary to the parents’ wishes and without terminating the mother’s parental rights. The judge concluded that it would be in A.P.’s “best interest” to endure “a cascading series of events that would inevitably lead to her death.”

A teenage mother is fighting a do-not-resuscitate order imposed over her objections on her brain-damaged daughter, saying she should be responsible for medical decisions. Child welfare officials who intervened after the baby was severely injured say life-saving measures in the event she stops breathing would only prolong her suffering. The mother, Virginia Trask, originally agreed to the do-not-resuscitate order. At one point, the infant was removed from life support and placed in her arms to die, then opened her eyes and began breathing. The Roman Catholic Diocese of Maine and Christian Civic League of Maine are joining the Alliance Defending...

“Aleah Peaslee was 6 months old in December when she was shaken by her father at their Augusta home while the youngster’s mother was at work, prosecutors say. The girl, now in foster care, suffered profound injuries that have left her a spastic quadriplegic who cannot see or hear and who relies on a feeding tube for nutrition.”

“She will never advance beyond an ‘an early infantile level,’ cannot suck or swallow and exhibits a high-pitched ‘neurological cry’ that she suggests she’s in pain, according to court documents. Her brain injuries are so severe that she’ll suffer a premature death, state attorneys said. Her foster mother observed, ‘She’s just miserable.’”

“However, a state judge who gave child welfare officials authority to make medical decisions doesn’t put as much stock in the judgment of either parent and noted that the mother has visited her daughter ‘only a handful of times.’ The judge found that ‘neither parent can be counted on to be physically or emotionally available to make the necessary informed decision when needed.’”

“The judge said also noted a potential conflict of interest regarding the father, who is no longer involved in the decision-making. Charges against him could be upgraded to manslaughter or even murder if Aleah dies, and the mother previously expressed an interest with reuniting with him, court documents indicated.”

So, goody, you have an immature 18-year old mother who would prolong the death of her daughter in order to keep her sweetie from being charged with her death, and you have the pro-life movement prolonging the death of some innocent victim in the name of - what? - I have no idea. It’s not mercy, and it sure isn’t Christian. We are not talking about taking her off food or off medications, we are talking about Do Not Resuscitate. This is just cruel and heartless. Say your goodbyes knowing that when the baby’s heart stops, God is calling her home.

You may find it odd, but we in the pro-life movement OPPOSE killing innocent children just because they are disabled.

This is EXACTLY what people like you were saying about Haleigh Poutre nine years ago. YOU want to put a DNR on someone who may surprise us all and get better just as Haleigh did.

It could not possibly be that the immature 18 year old simply loves her baby, now, could it? Most mothers will hold on to hope until the very end. Do you deny this young mother hope, particularly when her severely injured infant continues to breathe on her own, when removed from the respirator? This infant deserves a chance. She’s not a dog to be put down for the State’s convenience.

In reading over your posting history, it seems that you ALWAYS come down in favor of letting a person die rather than saving their life.

I can't quite tell where you stand on abortion, but you seem okay with the homosexual agenda.

What is it that makes you crave suffering in others? I’m pro life, and against abortion on all cases. I don’t want the state to have the power to end lives because they’re inconvenient. But I also know that people die. Every one of us. It’s merely a question of when and where. I’ve seen post after post of yours for years now, where you seem to have some bizarre fetish not for prolonging life but instead dragging out the process of death— as if you must somehow extract every possible amount of suffering before the dying can be released from your torture. If they start to pass on they must be jerked back to suffer more, and more. It’s kinda horrifying.

How long do you wait to bury someone who’s medically dead? A couple weeks? A month? After all there might be some miracle and they’ll just suddenly sit up and start breathing again. Do you wait for them to actually smell bad?

But whatever... Please stop calling yourself pro-life. Whatever it is you are, it’s something far different and frankly frightening.
