Ninth Circuit Upholds Ban On U.S. Flag Shirts

Rights: A Ninth Circuit Court ruling that students can't wear American flag T-shirts because they may offend Mexican students celebrating Cinco de Mayo is a ridiculous yet dangerous assault on the First Amendment.

On Sept. 17, more than four years after Live Oak High School in Morgan Hill, Calif., sent students home for wearing American flag t-shirts, an 11-judge Ninth Circuit Court of Appeals panel ruled that it was the right choice, "tailored to avert violence and focused on student safety."

The decision upheld the court's three-judge ruling in February that justified the school's actions based on tensions between Mexican and American students. Past events, Judge M. Margaret McKeown wrote, "made it reasonable for school officials to proceed as though the threat of a potentially violent disturbance was real."

After 9/11, a friend of mine gave me a t-shirt that included the American Flag. I have never worn it, as I am not sure that proper flag etiquette (http://americanflagfoundation.org/wp-content/uploads/2011/02/Flag_Law-from-Library-of-Congress2.pdf) could be suitably observed.

The Flag Code addresses the impropriety of using the flag as an article of personal adornment, a design on items of temporary use, and item of clothing.42 The evident purpose of these suggested restraints is to limit the commercial or common usage of the flag and, thus, maintain its dignity. The 1976 amendments to the Code recognized the wearing of a flag patch or pin on the left side (near the heart) of uniforms of military personnel, firemen, policemen, and members of patriotic organizations.43 The Code also states that the flag should never be used for advertising purposes in any manner whatsoever.

So..... if we're also "offended" and concerned about oh say for ex. the nudie rallies for [___fill-in whatever prog cause here__]" that go on constantly on PUBLIC streets in San Francisco in front of all manner of hapless citizens who happen to be walking along the street including children, in Pelosi's district - do we have to become (or threaten to become) violent like LaRaza does about the American flag to get 9 Circ's attention?

So what they are saying is Mexican Americans can’t control their emotions - but Americans can?

The students should engage in civil disobedience and wear the American flag shirts. Dare those in power to suspend the students. Dare them to suspend them indefinitely. The schools can’t stand to have empty seats in their indoctrination centers, especially when funding is at risk.

Cinco de Mayo is not Sept 17th. Are we to assume that students will not be able to wear the American flag shirts on two or more days, perhaps on King Kameamah day, too?
