Allowing Lower Court Rulings on Same-Sex Marriage to Stand-Tragic, Indefensible & Judicial Activism
Senator Ted Cruz Official Website ^ | October 6, 2014 | U.S. Sen. Ted Cruz

Posted on 10/06/2014 3:23:04 PM PDT by BurningOak

WASHINGTON, DC -- U.S. Sen. Ted Cruz, R-Texas, today issued the following statement regarding the Supreme Court’s decision to reject requests from five States to review state laws that prohibit same-sex marriage.

“The Supreme Court’s decision to let rulings by lower court judges stand that redefine marriage is both tragic and indefensible,” said Sen. Cruz. “By refusing to rule if the States can define marriage, the Supreme Court is abdicating its duty to uphold the Constitution. The fact that the Supreme Court Justices, without providing any explanation whatsoever, have permitted lower courts to strike down so many state marriage laws is astonishing.

“This is judicial activism at its worst. The Constitution entrusts state legislatures, elected by the People, to define marriage consistent with the values and mores of their citizens. Unelected judges should not be imposing their policy preferences to subvert the considered judgments of democratically elected legislatures.

“The Supreme Court is, de facto, applying an extremely broad interpretation to the 14th Amendment without saying a word – an action that is likely to have far-reaching consequences. Because of the Court’s decision today, 11 States will likely now be forced to legalize same-sex marriage: Virginia, Indiana, Wisconsin, Oklahoma, Utah, North Carolina, South Carolina, West Virginia, Kansas, Colorado, and Wyoming. And this action paves the way for laws prohibiting same-sex marriage to be overturned in any state.

This thread has opened my eyes to something. We look for some white Knight to be put into the white house to do our bidding. We look for “someone else” to stand for us and until then we are impotent. We look at the “guy in the White House” to make everything Okay. We are giving too much power to the POTUS! We say we hate that Obama is a dictator. Then why are we waiting for another one to come and “save” us? We need to get off our butts and be heard. The recent past and current time has shown that we will allow whomever is in the White House to do whatever the heck they want. We are at their whim.

Oklahoma isn’t backing down:

“The people of Oklahoma have the right to determine how marriage is defined. In 2004, Oklahomans exercised that right, voting by a margin of 3-1 to define marriage as the union of one man and one woman.

“The will of the people has now been overridden by unelected federal justices, accountable to no one. That is both undemocratic and a violation of states’ rights. Rather than allowing states to make their own policies that reflect the values and views of their residents, federal judges have inserted themselves into a state issue to pursue their own agendas.

“Today’s decision has been cast by the media as a victory for gay rights. What has been ignored, however, is the right of Oklahomans – and Americans in every state – to write their own laws and govern themselves as they see fit. Those rights have once again been trampled by an arrogant, out-of -control federal government that wants to substitute Oklahoma values with Washington, D.C. values.”

Rep. Sally Kern also released a statement on today’s decision.

“Oklahoma, or any state for that matter, should not have unelected judges who are not accountable to the people deciding what the laws will be,” said Kern. “Oklahoma voters, at 76 percent, defined marriage a one man and one woman. I am calling on my colleagues and the governor to stand in unity that Oklahoma will let Oklahoma decide what marriage is and should be. Every child deserves a mother and a father, and only natural marriage provides that.”

So in conclusion, Oklahoma will ultimately take away the financial benefits associated with marriage. Then eventually stop performing marriages at any state government entity.

I truly hope the gays decide not to take the Churches to court. That will push their public support back into the stone ages in Oklahoma.

Some examples:

Yeah sure...BS!

His roommate Craig Mazin is a lefty that roomed with him at the lefty Ivy League loon nest known as Princeton.

And the only rags that are giving this idiot his 15 seconds of fame are lefty rags such as Slate or DailyVomit etc.

WHICH MEANS you are reading lefty crap on the internet, why?

Doesn’t matter, it won’t work.

Here’s a piece that sets the record straight:

Please do not contact me again...you act like you are on drugs. I am just not on anyone’s bandwagon yet, as I am still researching the conservative possibilities.

I did not like some of the comments. As for Princeton University, all Universities lean left, but Republicans also send their children there.

You act like there is some kind of conspiracy against CRUZ....everyone here was wanting to vote in a few others when they first came on the scene and later wished they had taken some time to research.

Truth resides in many places even a donkey can speak for God, the Bible says so. I gave you a comment someone who knew him had said, nothing more, you do with it as you please.

LEAVE ME OUT OF IT! 2016 IS TWO YEARS AWAY AND I WILL DO MY OWN RESEARCH. Things too good to be true usually are!

You’ve got to be kidding me. Sadly, you aren’t. I’ve heard many local conservatives just roll over and let government go ahead and expand. It’s for our safety/security/own good.

Have you done your homework?

One of Cruz’ rejected amendments to the Gang of Eight bill was to increase the H1-B visas from 65,000 to 325,000. You think there are 260,000 Von Braun and Einsteins out there that we are missing out on every year? He clearly believes the myth of STEM worker shortages.

You say Cruz is not for mass immigration, and then talk about illegal immigration. I concede that he has been very good on illegal immigration, second only to Sessions perhaps. But mass immigration includes legal immigration too. In fact it’s more about our too-high levels of Democrat-importing legal immigration.

When Senator Sessions (the best we have on immigration) introduced an amendment to the atrocious Gang of Eight bill to clamp down on low-skilled legal immigration, Cruz voted against it. And in doing so he rattled off a bunch of nonsense and platitudes about immigration that really is beneath someone of Cruz’ intellect. And in doing so he bragged about his amendments to expand legal immigration!

Still think Cruz is against mass immigration?

To be fair Cruz does have good scores at Numbers USA, but they seem mostly to be based on his vote against the Gang of Eight bill. They don’t punish him for his amendments to increase immigration, probably because they weren’t part of a final bill. And I do seem to recall reading once where Cruz supports ending extended family chain migration, but I can’t find it now. And I greatly admired Cruz for refusing Dewhurst’s cheap challenge to a Spanish language debate during their primary fight. But read his own words at the link below and tell me he doesn’t support increasing mass legal immigration?

It’s simple really. Either the Republicans will end mass immigration (i.e greatly reduce legal immigration) or mass immigration will end the GOP. For conservatism to have a chance going forward, mass immigration must end. Demographics is destiny, and right now immigration is driving the demography ever more towards the left.

Cruz is a brilliant man. He is charismatic and articulate. We need someone like him to champion conservative comprehensive immigration reform. He could be out there calling for an end to chain migration. He could call for abolishing the absurd Diversity Lottery visas. He could call for cutting back on refugee and asylum visas. He could follow Sessions lead and advocate for poor, working, and middle class Americans (like those 6 million absent voters you mention). Combined with his excellence on illegal immigration and he could be great.

I’m aware of the millions of working class whites who sat out the 2012 election. I agree had Romney earned their vote then he’d be president. But I was talking about your unrealistic dreams of a Cruz landslide. Obama won the popular vote by almost five million, so even if Romney had got all six million of the missing votes, he would hardly have won a landslide popular victory. He would have won a comfortable electoral college victory, but probably less than Obama’s actual victory.

And do you really think Cruz can carry California? I admire your optimism, but come on! That’s crazy.

Hispanics are natural Democrats. Plenty of polling data shows them to hold liberal views on most of the big issues. And if that isn’t proof enough, then their voting history should be.

So what do you consider to be a large portion of the Hispanic vote? Cruz didn’t win Latinos in his senate race. He, like all Republicans in Texas, owes his victory to winning an overwhelming share of the white vote.

I think you way overstate Cruz’ appeal to most Hispanics. Why would brown Mexicans in California support a white Cuban who disagrees with them on most issues?

It’s over in California. The demographics won’t allow it. The state is too diverse and it’s white population isn’t conservative enough (like in Texas). It sucks to write off a fifth of the electoral votes needed to win, but it is what it is. California is lost.

> “And do you really think Cruz can carry California? I admire your optimism, but come on! That’s crazy.”

Latinos are neither conservative or liberal. They are pro-latino. If some white union boss from SEIU tells them to vote for Hillary Clinton and they see Rafael Edward Cruz on the ballot, there is no question who they will vote for. That’s just how they are culturally. They are not Marxists or liberals, they are Latino first.

So yes, Cruz can carry California.

Romney did not carry any of the 6 million + Perot demographic and he barely carried the more important independent vote by only a percent whereas Cruz can carry the independent vote by more than 30% (Cruz can take 2/3’s of independents; see the simple math below).

Independents account for over 40% (Yep, that’s real: http://www.mcclatchydc.com/2014/01/21/215122/as-independent-voters-numbers.html) of the electorate of which 2/3’s of it number more than 40 million.

See also http://www.examiner.com/article/number-of-independent-voters-skyrockets to discern that of nearly 150 million registered voters, more than 60 million are now identifying themselves as Independent. Any wonder why this hasn’t been all over the news? Because there is no figurehead of the Independents for the news media to focus on. They don’t know how to make it into one of their soap opera like newscasts of unfolding stories.

Study why people like me register as independent. I am nauseated and disgusted with democrats and I can’t stand the smug arrogance and stupidity of the GOP. So tens upon tens of millions of people like me see Ted Cruz as the only voice that stands against both of the major parties. Read the last link above.

And note I wouldn’t care if Ted Cruz was a Zell Miller democrat. His party affiliation means nothing to me. This is important to understand in terms of the mindset of the independent voter.

Among important subgroups Cruz will carry the White women vote as did Romney but he will also carry the Latino women vote which Romney lost by a huge margin.

The analysis of numbers point to a landslide for Cruz.

Where you are going wrong is in ignoring the Independent vote and the Latino vote. Those two groups and the Perot Demographic will combine with the GOP base vote to add up to more than 90 million votes, a blowout of historical proportions.

* 39 million base GOP voters
* 41 million Indy voters
* 6.5 million Perot Blue Collar voters
* 6 million Latino voters

and of the remaining 20 million Indy voters combining with 50 million democrat voters for a total of 70 million democrat votes, there will be at least 10% that sit home because of demoralization leaving only about 63 million to vote democrat.

Total number of Americans registered to vote 146,311,000 and total number of Americans who voted in the 2012 Presidential election 131,144,000 or about 90% of registered voters;

Total number of Americans eligible to vote 206,072,000 versus the number of Americans who voted in the 2012 Presidential election 131,144,000 yields about 64% turnout.

Accounting for turnout then indeed yes, 81 mil to 56 mil, Cruz by a massive landslide in the popular vote.

You are a victim of an echo chamber drum beat that has dented your mind to think only of Dem and GOP. You can’t see beyond that because of the noisy distraction and annoying repetition, interruption and control of your information feed.

I wonder if so-called anti-gay marriage states are actually working in cahoots with pro-gay activist justices, these states possibly making anti-gay marriage laws as pawns for judges to strike down and for activist justices to ignore, both sides of the fence actually wanting to promote gay marriage?

I have said for years that the GOPe is more than happy to let the courts move us to the left and they can hide behind the court.

Jeb Bush let an old, senile, blind, family court judge kill Terry and he refused to stand up to that judge, as did our Congress by the way.

There was a time when Texas sent more $$$ to Washington than we got back. I don't think that is true of any state anymore.

States can't stop $$$ going to D.C. when it's taken out of paychecks.

Most Latinos are liberal. There is plenty of polling data that shows they consistently hold left wing views on most issues.

There isn’t exit poll data available for Texas in 2012, but pre and post election surveys show that Cruz lost the Hispanic vote even as he won a landslide victory (thanks to the white vote). Was Cruz not enough of a Latino sounding name versus Sadler? If Cruz can’t even break even with the allegedly more conservative Texas Latinos, then what chance does he have with the more liberal populations of California, New York, et al?

So I’m not ignoring the Latino vote at all. I’m just counting on it doing what it always does by giving a large majority of its support to the Democrats; somewhere in the 60-80% range.

If Cruz is the nominee he will lose the Hispanic vote and will lose California, both by large margins.
