WASHINGTON (AP) President Barack Obama does not plan to announce his choice for attorney general before the November elections, shielding the nomination from the midterm election politics while setting up a potential year-end showdown with the lame duck Senate.
Senate Democrats have asked Obama to wait so controversy doesn't arise over whether they will support a specific nominee, and the delay gives Obama more time to consider his options.

If the GOP wins the Senate in the midterm, can the 45 current Senators block a vote before the term expires?
I can't imagine they'd be able to fast track a committee hearing and then a full vote in less than two months.
I'd expect a recess appointment.

Doubtful that they can block a vote. Since Harry Reid changed the Senate rules on filibusters, they can vote on the nominee without fear of a GOP filibuster. Since this is a presidential nominee, I think the filibuster can’t be used.
Anyone who knows more please let me know. I hope I’m wrong because I could see Obama nominate a very radical nominee but be confident of confirm.scion with the bare majority of 51 votes in the lame duck session.

The President's decision to delay the announcement of his choice for Attorney General until after elections have passed could only mean two things. One, the majority of Americans won't like his nominee. Two, he feels certain that his party will control the Senate and, thus, confirm his choice after the elections next month. Remember how strangely disengaged and cocky Mr. Obama was about his 2012 re-election? Its “deja vu all over again.” This game is rigged.
