Marijuana Patient Sues After Firm Won't Hire Her

A graduate student has sued a textile company for refusing to hire her for a two-month internship because she uses medical marijuana to treat frequent and debilitating migraine headaches, a decision her lawyer calls discrimination.

Christine Callaghan, who is studying textiles at the University of Rhode Island, sued Westerly-based Darlington Fabrics Corp. and its parent, the Moore Company, on Wednesday. The Rhode Island chapter of the American Civil Liberties Union, which is representing Callaghan, said it believes it's the first lawsuit of its kind in the state.

That alone is a reason not to hire her. Who wants to bring in a new employee who tells you up front that they are "frequently debilitated" by ANYTHING. Just imagine several times every week or so when they get so "debilitated" they tell the boss they have to leave early to go home and toque up.

Oh well, there are lots of ways to get Disability checks, this may be one of them.

Excuse me, but I believe that the law is important. I have nothing against anyone changing Federal narcotics law(s), but until then the law should be enforced. You seem to disagree. That's fine.

I used to suffer from brutal migraines and smoking weed made them worse. Thankfully they only lasted ten years then stopped.

She has no case because a company would refuse to hire anyone taking a prescription medication that could interfere with job performance.

Interesting point. If someone is taking prescription vicodin (which has been know to make one woozy) would the company be within their rights not to hire of fire that person? I would say yes, but I bet there would be lawsuits about that too.

Someone I know was advised to use pot because of migrane headaches. Not sure if the dr prescribed or he advised. Not sure what Maine law requires for legal use. The job involved driving a company car. One day he rolled the car. Company ordered a blood test. Failed. Fired. It was in the pre-employment agreement that he signed.

Marijuana use is still a Federal crime. Case dismissed.

Under what legal authority?
This is to ask, what in the Constitution allows the federal government to do so?

She should try to get a pilot’s license and then apply for a job as a pilot. It looks like now, they’ll just have to take her.
Then, she’ll have another way to get high.

But seriously, employers should never reveal why they are not going to hire a candidate. If drug tests are used, the results should not be revealed to a candidate (have the candidate sign a statement attesting to this). After the employee is hired, and drug testing is utilized, there has to be a clear policy for termination with regards to positive drug testing. Employers must be certain that they have a confirmed (mass spec) positive test.

Alcohol is legal. We don’t permit drinking on the job. There
are plenty of applicants that are not drug impaired.
